Roll Call Present 3 - Chair Michael McDonald, Vice Chair Jack Tracy, and Board Member Linda Moreno Also present were Board Counsel , Jim Sanchez, Deputy City Attorney III, Jennifer DeRuosi and Acting Secretary Designee, Yvonne Teixeira. 2. Approval of Minutes A. ID 21-218 January 13, 2021 On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the Minutes for January 13, 2021 be approved. The motion carried by the following vote: Aye: 3 - Chair McDonald, Vice Chair Tracy and Board Member Moreno At 9:02 AM the Board convened into Closed Session 3. Old Business City of Fresno ***Subject to Mayoral Veto Page 1 Civil Service Board Meeting Minutes - Final February 2, 2021 A. ID 21-219 Reschedule Meeting(s) to conduct a Public Employee Discipline Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the Hearing be scheduled for April 6 and 7, 2021. The motion carried by the following vote: Aye: 3 - Chair McDonald, Vice Chair Tracy and Board Member Moreno Deputy City Attorney III, Jennifer DeRuosi was present on behalf of the Appointing Authority. Present on behalf of the Appellant were Attorneys at Law David Garcia and Vismaad Gondara. The Hearing on Appeal was scheduled for April 6 and 7, 2021. B. ID 21-221 Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Vice Chair Tracy, seconded by Board Member Moreno, that the Findings, Decision and Order After Hearing be approved. The motion carried by the following vote: Aye: 3 - Chair McDonald, Vice Chair Tracy and Board Member Moreno 4. Hearing on Appeal A. ID 21-220 Closed Session - Continued Public Employee Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Deputy City Attorney II, Jennifer DeRuosi was present on behalf of the Appointing Authority. Neither the Appellant or Representative were present. The Board was presented with a Joint Stipulation and Order to Continue Hearing Dates. The Board unanimously approved the Joint Stipulation and tentatively scheduled the Hearing for March 8, 2021 or March 15, 2021, based on the Appellant's availability. At 9:27 AM the Board reconvened into Open Session and the decisions of the Board were announced in accordance with the Brown Act.
