ROLL CALL Present 4 - Chairperson Michael McDonald, Board Member Linda Moreno, Board Member Marina Magdaleno, and Todd L. Cregar Absent 1 - Vice Chair Jack Tracy Board Counsel James McCann was present and represented the Board. Also present were Acting Secretary Michael Torosian, Supervising Deputy City Attorney Jennifer DeRuosi, Chief Assistant City Attorney Erica Camarena, Deputy City Attorney lll Mao Lee and Director of Personnel Marissa Sanchez. 2. APPROVAL OF MINUTES A. ID 22-839 May 16, 2022 On motion of Board Member Magdaleno, seconded by Board Member Moreno, that the above Action Item be APPROVED. The motion carried by the following vote: Aye: 4 - Chairperson McDonald, Board Member Moreno, Board Member Magdaleno and Cregar Absent: 1 - Vice Chair Tracy At 9:00 am the Board convened into Closed Session 3. OLD BUSINESS A. ID 22-840 Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] On motion of Board Member Magdaleno, seconded by Board Member Moreno, that the above Action Item be APPROVED AND RETURNED SIGNED. HEARING ON APPEAL A. ID 22-841 Closed Session - Continued Public Discipline/Dismissal/Release [Pursuant to Government Code Section 54954] Present on behalf of the Appointing Authority were: Supervising Deputy City Attorney Jennifer DeRuosi, Chief Assistant City Attorney Erica Camarena and Deputy City Attorney lll Mao Lee Present on behalf of the Appellant were: The Appellant, Attorney at Law, Eric Acevedo Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 11:42 AM, following summaries and closing remarks from the parties, the Board convened into Executive Session to deliberate the matter. At 1:47 PM, the Board reconvened into Closed Session and voted on the charges as read by Michael Torosian , Acting Secretary Designee. Present for report of Decision from the Board on behalf of the Appointing Authority were Supervising Deputy City Attorney Jennifer DeRuosi, Chief Assistant City Attorney Erica Camarena, Deputy City Attorney lll Mao Lee. There was no representation present on behalf of the Appellant. Also present were Board Counsel, James McCann , Acting Secretary Designee Michael Torosian. The motion carried by the following vote: Aye: 3 Board Member Moreno, Board Member Magdaleno and Board Member Creger No:1 Chairperson McDonald The charge of violation of Fresno Municipal Code Section 3-286(a) as set forth in the Order was Not Sustained with a 3-1 vote. The charge of violation of Fresno Municipal Code Section 3-286(b)(4) as set forth in the Order was Not Sustained with a 3-1 vote. The charge of violation of City Attorney Office Policy and Procedures - Paragraph 3 - Mission and Culture Statements as set forth in the Order was Not Sustained with a 3-1 vote. The charge of violation of City of Fresno Administrative Order (AO) 2-16 as set forth in the Order was Not Sustained with a 3-1 vote. 5. UNSCHEDULED COMMUNICATION None 6.
