Also present were Acting Secretary Designee Brooke Anderson, Assistant City Attorney Jennifer DeRuosi, Deputy City Attorney III Mao Lee, Deputy City Attorney III Brian Velez, Senior Paralegal Malicha Nanez, and Assistant Director of Personnel Services Jennifer Misner. 2. OLD BUSINESS Executive session at 9:04, closed session at 9:33 A. ID 23-1136 Closed Session-Government Code Section 54957-Continued Public Employee Discipline/Dismissal/Release-Review of Findings [Pursuant to Fresno Municipal Code Section 3-283] At 9:04 AM, the Board convened into executive session to deliberate on the hearing officer's recommended findings. At 9:33 AM the Board reconvened into closed session and voted on motion of Board Member Cregar, seconded by Board Member Moreno, that the hearing officer's recommended findings be REJECTED and imposed discipline be modified to a 30-day suspension. The motion carried by the following vote: Aye: 3 -Vice Chair Tracy, Board Member Moreno, and Board Member Cregar Absent: Chairperson McDonald 4. NEW BUSINESS A. The Hearing was scheduled for December 12, 2023 and December 13, 2023 at 9:00 AM. B. ID 23-1138 Closed session - Government Code Section 54957 Public Employee Discipline/Dismissal/Release - Schedule Meeting(s) to Conduct Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Assistant City Attorney, Jennifer DeRuosi was present on behalf of the Appointing Authority. Attorney at Law, Roger Wilson and Appellant was present. The Hearing was scheduled for January 22, 2024 at 9:00 AM. C. ID 23-1139 Closed session - Government Code Section 54957 Public Employee Discipline/Dismissal/Release - Schedule Meeting(s) to Conduct Appeal Hearing [Pursuant to Fresno Municipal Code Section 3-284] Deputy City Attorney III, Mao Lee was present on behalf of the Appointing Authority and the Appellant was not present. The Hearing was scheduled for October 11, 2023 and October 12, 2023 at 9:00 AM. 5. HEARING ON APPEAL A. ID 23-1142 Closed session - Government Code Section 54957 Public Employee Discipline/Dismissal/Release [Pursuant to Fresno Municipal Code Section 3-284] At 9:44 AM the Board convened into Closed Session and the Hearing on Appeal began. Present on behalf of Appointing Authority was Assistant City Attorney, Jennifer DeRuosi and Assistant Director of Transportation, Joe Vargas. Present on behalf of the Appellant was Attorney at Law, Roger Wilson and the Appellant. Witnesses were sequestered and the reading of the Order was waived by the parties. Exhibits of evidence were presented during testimony and they were filed and moved into the record. At 4:18 PM all parties agreed to reconvene at 9:00 AM on July 26, 2023 to continue the Hearing on Appeal. At 4:18 PM, the first day of the hearing was concluded.
