Wilbur Commissioner – Shannon McCulligh Commissioner – Vacant Tuesday, October 24, 2023 9:30 AM Council Chambers Special Meeting The Mobilehome Park Rent Review and Stabilization Commission met in regular session in the Council Chamber at Fresno City Hall on the date and time above written. 1. CALL TO ORDER / 9:30 A.M. ROLL CALL Office of the City Clerk staff called the meeting to order at 9:35 A.M. 2. PLEDGE OF ALLEGIANCE City Attorney Papazian led the Pledge of Allegiance. 3. PROCEDURES City Attorney Papazian explained the meeting procedures to the Commissioners. 4. APPROVAL OF AGENDA City Attorneys Papazian and Badhesha announced the following changes to the agenda: Item ID 23-1569 - regarding scheduling of hearing for La Hacienda Mobile Estate Rent Increase Application - was removed from the agenda by staff. Item ID 23-1567 - regarding consideration and adoption of the Fresno Mobilehome Park Rent Review and Stabilization Commission Bylaws - updated Bylaws will be considered today by the commission. The motion carried by the following vote: Aye: 4 - Chair Moncada, Vice Chair Wilbur, Commissioner Mcculligh and Commissioner Zuniga 5. GENERAL ADMINISTRATION 5.-A. ID 23-1566 Election of the Fresno Mobilehome Park Rent Review and Stabilization Commission Chairperson and Vice Chairperson Upon call, Patrisha Shawn addressed the Commission. There were no other comments from the public. COMMISSIONER MONCADA ELECTED CHAIR COMMISSIONER WILBUR ELECTED VICE CHAR On motion of Commissioner Zuniga, seconded by Commissioner Mcculligh, to elect Commissioner Moncada as the Chair and Commissioner Wilbur as the Vice Char of the Commission, that the above Action Item be APPROVED. The motion carried by the following vote: Aye: 4 - Chair Moncada, Vice Chair Wilbur, Commissioner Mcculligh and Commissioner Zuniga 5.-B. ID 23-1567 Consideration and Adoption of the Fresno Mobilehome Park Rent Review and Stabilization Commission Bylaws Upon call, Patrisha Shawn and Kim Sands addressed the Commission. There were no other comments from the public. On motion of Vice Chair Wilbur, seconded by Commissioner Mcculligh, that the above Action Item be APPROVED. The motion carried by the following vote: Aye: 4 - Chair Moncada, Vice Chair Wilbur, Commissioner Mcculligh and Commissioner Zuniga 5.-C. ID 23-1568 Consideration and Adoption of the Fresno Mobilehome Park Rent Review and Stabilization Commission Calendar for Fiscal Year 2023-2024 Upon call, Leticia Casillas Luqover and Marya Thompson addressed the Commission. There were no other comments from the public. City of Fresno ***Subject to Mayoral Veto Page 2 Mobilehome Park Rent Review Meeting Minutes October 24, 2023 and Stabilization Commission On motion of Vice Chair Wilbur, seconded by Commissioner Mcculligh, the motion to hold Commission meetings on the second Tuesday, once a month at 6:00 P.M. that the above Action Item be APPROVED. The motion carried by the following vote: Aye: 4 - Chair Moncada, Vice Chair Wilbur, Commissioner Mcculligh and Commissioner Zuniga 5.-D. ID 23-1569 Scheduling of Hearing for La Hacienda Mobile Estate Rent Increase Application Removed by staff. 6. INFORMATIONAL REPORTS 6.-A. ID 23-1570 WORKSHOP: Overview of the Role of the Mobilehome Park Rent Review and Stabilization Commission and Applicable Open Meeting Laws Presented by: City Attorney’s Office City Attorney Freeman presented the workshop. 7. REPORTS BY COMMISSIONERS There were no reports from the Commissioners. 8. CONTINUED MATTERS 9. NEW MATTERS 10. UNSCHEDULED ORAL COMMUNICATION Upon call, Patrisha Shawn, David Willis, Kim Sands and Linda Martinez addressed the Commission. There were no other comments from the public. 11. ADJOURNMENT Chair Moncada announced the next meeting will be held on Tuesday November 14 at 6:00 P.M. at City Hall and adjourned the meeting at 10:44 A.M. The above minutes were approved by unanimous vote of the Mobilehome Park Rent Review and Stabilization Commission during the November 14, 2023, regular meeting. PUBLIC PARTICIPATION – Public participation during Fresno City Council meetings is always encouraged and can occur in one of the two following ways: 1) Participate In Person: Council Chambers, City Hall, 2nd Floor, 2600 Fresno Street, Fresno, CA 93721 a) To speak during a City Council meeting in person: fill out a speaker card (available in the Council Chamber) and place it in the speaker card collection basket at the front of the Council Chamber. You may also approach the speaker podium upon the Council President’s call for public comment. 2) Participate Remotely via Zoom: https://fresno-gov.zoom.us/webinar/register/WN_-xCfuYBaRsuG_orSb0GoHA a) The above link will allow you to register in advance for remote participation in the meeting via the Zoom platform. After registering, you will receive a confirmation email containing additional details about joining the meeting. b) To speak during a City Council meeting while attending remotely: while in the Zoom application, click on the icon labeled “Participants” at the bottom of the screen. Then select “RaiseHand” at the bottom of the Participants window. Your digital hand will now be raised. You will be asked to “unmute” when your name is called to speak. You will not be visible via video and there will be no opportunity to share your screen. All public speakers will have up to 3 minutes to address Council pursuant to Rule No. 10 of the Rules of Procedure for the City Council of the City of Fresno (available in the City Clerk’s Office). PROCEDURES For each matter considered by the Commission, there will first be a staff presentation, followed by a presentation from the mobilehome park Owner applying for a rent increase, then a presentation from a representative of mobilehome park’s Residents' Committee. Testimony from supporters of the application will then be taken, followed by testimony from those in opposition. The mobilehome park Owner and Residents' Committee representative will each have the right to a final rebuttal presentation prior to closing the public hearing. Pursuant to Rule 10 (c) of the Rules of Procedure for the City Council of the City of Fresno (available in the City Clerk’s Office) governing length of public debate, all public testimony from those in support and in opposition of the rent increase application will be limited to three minutes per person. The three lights on the podium next to the microphone will indicate the amount of time remaining for the speaker. The green light will be turned on when the speaker begins. The yellow light will come on with a soft bell ring when one minute is remaining. The speaker should be completing the testimony by the time the red light comes on with a final bell indicating time has expired. All public testimony must be presented to the Commission at the podium. Any testimony that references race, religion, ethnicity, economic status, national origin, or any other classification protected under state or federal law in a derogatory manner shall be deemed irrelevant and will not be considered by the Commission in making its determinations. 4.
