A. ID17-1069 Consideration of Conditional Use Permit Application
C-17-050ABCUP, 5979 West Shaw Avenue; located on the
southeast corner of West Shaw and North Hayes Avenues
(Council District 1) - Development and Resource Management
Department.
Based upon the evaluation contained in this report, staff
recommends that the Planning Commission take the following
action:
1. DENY Conditional Use Permit Application No. C-17-050,

requesting authorization to establish a State of California
Alcoholic Beverage Control (ABC) Type 21 License (Off Sale
General - sale of beer, wine, and distilled spirits for consumption
off the premises where sold)) to buy and sell beer, wine, and
distilled spirits at a future development on the subject property.
a. Based upon substantial evidence detailed in this staff report,
staff has determined that Findings A, B, C, and D contained in
Section 15-5306 of the Fresno Municipal Code cannot be made.
Therefore, the Conditional Use Permit cannot be approved.
Chair Torossian and Sodhi-Layne disclosed that they were contacted by the
applicant, George Beal.
Will Tackett, Supervising Planner, presented the proposed project.

Commissioner Bray spoke.
Clay Gilpin with the EDC and Pamela Par spoke in support of the proposed
project.
Bill Benai and Jessica Sethi spoke in opposition of the proposed project.
Beal addressed concerns.
Clark asked Beal to confirm the relocation of the license from the High
Speed Rail impacted business to this new location.
Beal confirmed that the license is a relocation from his High Speed Rail
impacted business off of West Herndon Avenue for a total of 9 licenses in
the census tract.
All seven Commissioners voiced their opinion.
Bonique Emerson, City Planning Manager with DARM, spoke in clarification
to how the allowable licenses are calculated by the Alcoholic Beverage

Control Department.
Tackett made the clarrification that "No Single Sales" are permitted as part
of the Code and the Conditions of Approval.
Beal agreed to the Condition that "No Single Sales" be permitted.
DENY THE STAFF RECOMMENDATION, ADOPT THE CEQA
CATEGORICAL EXEMPTION OF A CLASS 32, AND APPROVE THE
CONDITIONAL USE PERMIT FINDING THAT EXCEPTION C OF FMC
15-2706-E.5 CAN BE MADE.
On motion of Chairperson Torossian, seconded by Commissioner
Sodhi-Layne, that the above Action Item be approved. The motion
carried by the following vote:

requesting to establish a State of California Alcoholic Beverage
Control Type 20 alcohol license (Package Store - sale of beer
and wine for consumption off the premises where sold) for a
proposed convenience store.
Phillip Siegrist, Planner with DARM, presented the proposed project.
George Beal, the applicant, resented the project.
Commissioner Vang and Commissioner Sodhi-Layne spoke.

For each matter considered by the Commission, there will first be a staff presentation,
followed by a presentation from the project applicant. Testimony from supporters of the
project will then be taken, followed by testimony from those in opposition. The applicant
will have the right to a final rebuttal presentation prior to closing the public hearing.
In accordance with section 13 of Article 2 of the Planning Commission Rules and
Regulations governing length of public debate, all public testimony from those in
support and in opposition of the project will be limited to three minutes per person. The
three lights on the podium next to the microphone will indicate the amount of time
remaining for the speaker. The green light will be turned on when the speaker begins .
The yellow light will come on with a soft bell ring when one minute is remaining. The
speaker should be completing the testimony by the time the red light comes on with a
final bell indicating time has expired. All public testimony must be presented to the
Commission at the podium. Any testimony that references race, religion, ethnicity,
economic status, national origin, or any other classification protected under state or
federal law in a derogatory manner shall be deemed irrelevant and will not be
considered by the Commission in making its land use determinations.
If you challenge these land use matters in court, you may be limited to raising only
those issues you or someone else raised in oral or written testimony or before the
close of the hearing.
