A. ID17-1347 Hearing to Consider Supplemental Environmental Impact Report
(SEIR) No. 10151 (State Clearinghouse (SCH) No.
2017031030), Development Permit No. D-16-088 and Variance
Application No. V-17-01 for the Producers Dairy Project located
on the south side of East Belmont Avenue between North Ferger
and North Roosevelt Avenues in the City of Fresno. (Council
District 3 - Baines)
Upon the evaluation and consideration of the requested
approvals for this Project, staff concludes that the proposed
SEIR, Development Permit Application No. D-16-088 and
Variance Application No. V-17-001 are appropriate for the project
site. Therefore, staff recommends the Planning Commission
take the following actions:
1. RECOMMEND CERTIFICATION (to the City Council) of
Supplemental Final EIR
No. 10151 (SCH No. 2017031030), for the Producers Dairy
Project located at
450 East Belmont Avenue; and,
a. RECOMMEND ADOPTION of Findings of Fact as required by
Public Resources Code Section 21081(a) and CEQA Guidelines,
Section 15091; and,
b. RECOMMEND ADOPTION of a Mitigation Monitoring and
Reporting Program as required by Public Resources Code
Section 21081.6 and CEQA Guidelines Section 15097; and,
c. RECOMMEND ADOPTION of the Statement of Overriding
Considerations as required by Public Resources Code, Section
21081(b) and CEQA Guidelines, Section 15093.
2. RECOMMEND APPROVAL of Development Permit
Application No. D-16-088
(subject to the attached Conditions of Approval dated October
4, 2017).
3. RECOMMEND APPROVAL Variance Application No. V-17-
001.

No. ANX-17-004/R-17-008/C-16-062, filed by Bill Robinson of
Sol Development, on behalf of Mari Zakaryan. These
applications pertain to approximately 7.80 acres of property
located on the north side of East Alluvial Avenue between North
Willow and North Paula Avenues.
1. RECOMMEND APPROVAL (to the City Council) of the
Finding of Conformity to the Fresno General Plan Master
Environmental Impact Report, which was prepared for purposes

2. RECOMMEND APPROVAL (to the City Council) of Pre-zone

Fresno RS-3 (Single Family Residential, Low Density) and RS-5
(Single Family Residential, Medium Density) zone districts;
subject to the findings included within the staff report.
3. RECOMMEND APPROVAL (to the City Council) of
Annexation Application No. ANX-17-004 to initiate annexation
proceedings for detachment from the Fresno County Fire
Protection District and the Kings River Conservation District and
annexation to the City of Fresno; subject to the findings included
within the staff report.
4. RECOMMEND APPROVAL (to the City Council) of
Conditional Use Permit Application No. C-17-062, which
proposes the construction of a 25 bedroom residential care
facility on a 2.38 acre portion of the project site; subject to the
Conditions of Approval dated October 4, 2017 and the findings
included within the staff report.

For each matter considered by the Commission, there will first be a staff presentation,
followed by a presentation from the project applicant. Testimony from supporters of the
project will then be taken, followed by testimony from those in opposition. The applicant will
have the right to a final rebuttal presentation prior to closing the public hearing.
In accordance with section 13 of Article 2 of the Planning Commission Rules and
Regulations governing length of public debate, all public testimony from those in support
and in opposition of the project will be limited to three minutes per person. The three lights
on the podium next to the microphone will indicate the amount of time remaining for the
speaker. The green light will be turned on when the speaker begins. The yellow light will
come on with a soft bell ring when one minute is remaining. The speaker should be
completing the testimony by the time the red light comes on with a final bell indicating time
has expired. All public testimony must be presented to the Commission at the podium. Any
testimony that references race, religion, ethinicity, economic status, national orgin, or any
other classification protected under state or federal law in a derogatory manner shall be
deemed irrelevant and will not be considered by the Commission in making its land use
determinations.
If you challenge these land use matters in court, you may be limited to raising only those
issues you or someone else raised in oral or written testimony or before the close of the
hearing.
