APPROVE Vesting Tentative Tract Map No. T-6265/UGM for a 25-lot single family residential subdivision subject to adoption of the Fresno Municipal Code Findings and compliance with the Conditions of Approval, included within the Staff Report to the Planning Commission dated March 4, 2020. (Council District 6) 1. APPROVE Planned Development Permit No. P19-04842 subject to compliance with the Conditions of Approval dated March 4, 2020. 3. APPROVE Vesting Tentative Tract Map No. T-6275 subject to compliance with the Conditions of Approval dated March 4, 2020. Israel Trejo, Supervising Planner, presented the project to the Commission. Commissioners Diaz and Vang asked questions regarding the Planned Development and feedback from the surrounding neighbors. Staff clarified. Gary Giannetta, project applicant, spoke in favor of the project. No one from the public spoke in favor or in opposition of the project. A new item was presented to the Commission. Staff explained this new item was a minor change to the Public Utilities - Sanitary Services Conditions of Approval. Chair Bray brought the item back to the dais for consideration. MOTION TO APPROVE STAFF RECOMMENDATION. On motion of Commissioner Diaz, seconded by Commissioner Vang, that the above Action Item be approved. RECOMMEND APPROVAL (to the City Council) of the adoption of Environmental Assessment No. P19-02898/P19- 04890, dated February 7, 2020, a Negative Declaration for the proposed project pursuant to the California Environmental Quality Act (CEQA). 2. RECOMMEND APPROVAL (to the City Council) of findings pursuant to Government Code Section 65863(b)(2) that there is substantial evidence in the record that remaining sites identified in the Housing Element can accommodate the City of Fresno’s share of the Regional Housing Needs Assessment (RHNA). 3. RECOMMEND APPROVAL (to the City Council) of Rezone Application No. P19-04890 requesting authorization to remove conditions of zoning on 0.44 acres located on the east side of North Arthur Avenue south of West Shaw Avenue. 4. RECOMMEND APPROVAL (to the City Council) of Development Permit Application No. P19-02898 requesting authorization to construct a seven-unit multi-family development in a RM-1 (Residential Multi-Family - Medium High Density) zone district, subject to compliance with Conditions of Approval dated March 4, 2020. Robert Holt, Planner III, presented the project to the Commission. Commissioner Diaz and Chair Bray asked questions regarding square footage, proposed setbacks, and the neighborhood meeting. Staff clarified. Esteban Pauli, project applicant, spoke in favor or the project. Commissioner asked questions regarding the neighborhood meeting. Applicant clarified. No one from the public spoke in favor of the project. City of Fresno ***Subject to Mayoral Veto Page 5 Planning Commission Meeting Minutes March 4, 2020 Two members from the public spoke in opposition of the project citing concerns regarding parking and rent price/demographics. Applicant addressed rent cost question. Israel Trejo, Supervising Planner, clarified parking requirements. MOTION TO APPROVE STAFF RECOMMENDATION. On motion of Commissioner Diaz, seconded by Commissioner Hardie, that the above Action Item be approved. PROCEDURES - PROCEDIMIENTOS - KEV SAB LAJ For each matter considered by the Commission, there will first be a staff presentation, followed by a presentation from the project applicant. Testimony from supporters of the project will then be taken, followed by testimony from those in opposition. The applicant will have the right to a final rebuttal presentation prior to closing the public hearing. In accordance with section 13 of Article 2 of the Planning Commission Rules and Regulations governing length of public debate, all public testimony from those in support and in opposition of the project will be limited to three minutes per person. The three lights on the podium next to the microphone will indicate the amount of time remaining for the speaker. The green light will be turned on when the speaker begins. The yellow light will come on with a soft bell ring when one minute is remaining. The speaker should be completing the testimony by the time the red light comes on with a final bell indicating time has expired. All public testimony must be presented to the Commission at the podium. Any testimony that references race, religion, ethnicity, economic status, national origin, or any other classification protected under state or federal law in a derogatory manner shall be deemed irrelevant and will not be considered by the Commission in making its land use determinations. If you challenge these land use matters in court, you may be limited to raising only those issues you or someone else raised in oral or written testimony or before the close of the hearing.
