MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road January 17, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:00 PM. The Pledge of Allegiance was recited and Eileen Moss gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Don Carroll, Craig Hill, Bette Hubrich and Eileen Moss and Mayor Todd Stevenson STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Cody Cardan, Steve Davis, Dana Rimington, and Jeff Thornton Agenda Item: 2. APPROVAL OF MINUTES OF MEETING – January 3, 2012 Council Member Don Carroll made a motion to approve the draft of the minutes of January 3, 2012, with corrections. Council Member Bette Hubrich seconded the motion and it passed unanimously. 3. SPECIAL PRESENTATIONS 07:03 There were no special presentations made. 4. NEW BUSINESS A. Audit Report/FY 2010-2011 – Wood-Richards and Associates Cody Cardan of Wood-Richards and Associates gave the annual audit report for Fruit Heights City for the year ended June 30, 2011. Overall the city has done an excellent job considering today’s economy and with the decline in building permits. The city has done a very good job with budgeting. However, there is no cash in the water fund due to a deficit. During the audit it was discovered that the city does not have a formal documented review of the bank statements. The city has now implemented a procedure using a checklist that provides this control monthly. Three funds were over budget, totaling 1 Fruit Heights City Council Meeting January 17, 2012 about $17,000. The city manager has agreed to limit this spending and open the budget late in the year to allow for variances. His office also recommends the city’s fidelity bond cover all employees that handle the city’s cash. Mr. Cardan stated City Manager Brandon Green and City Accountant Steve Davis are doing an excellent job with the financial records. He stated all funds on contract for Class C road funds should be placed in an interest bearing account. He reminded the council that the city needs to have a plan in writing for use of the impact fees because some are reaching their six-year time limit. The budget and financial records look very good in the city. B. Discuss/Approve/Deny the Open Space Zoning Ordinance 23:50 City Planner Jeff Oyler presented the council with a draft of the new Open Space Zoning District and the proposed Future Land Use Map to the council. The two districts proposed are the Open Space Conservation District and the Open Space Recreational District. The Open Space Conservation District allows undeveloped natural land, trails or pathways, access driveways and parking areas for trailheads, cemeteries and public water storage facilities. The Open Space Recreational District allows parks, trails, and temporary commercial uses. City Planner Oyler stated that this designation is for future land uses. This proposal does not prevent a landowner from developing land, but it will come before the city prior to development. He stated that if the city decides to allow horses on trails, it will be made a part of the Trails Master Plan. Council Member Don Carroll questioned if the city can apply this zoning to the U.S. Forest Service land and if the city can enforce it on their land. City Planner Oyler stated he will look into what other cities are doing and talk with the city attorney about zoning USFS property. The city will hold a public hearing on this ordinance before adopting it. C. Approve a Resolution Regarding Contributions to URS 46:30 City Manager Brandon Green presented Resolution 2012-01, a resolution of the Fruit Heights City Council ratifying and confirming the city’s election to pick up 13.37% of the required member contribution for all eligible employees required to contribute to the Utah Retirement System contribution retirement plan. 2 Fruit Heights City Council Meeting January 17, 2012 Council Member Bette Hubrich stated she objects to the word “pick up” in the resolution and would prefer the word “provide” or “contribute” be used in its place. Council Member Don Carroll questioned if there is more than 13.37% being provided and the city is only picking up that portion. He stated he doesn’t think there is enough information to make a decision tonight. City Manager Green stated he will verify the language with the city attorney and see if there is something else the employees are contributing so that it reads correctly. Mayor Todd Stevenson tabled this item until more information is available. D. Discussion on Board of Adjustment Member 51:08 Mayor Todd Stevenson stated the terms of David Fjeldsted and Jeff Thornton have expired and David Fjeldsted has filled his term limit on the Board of Adjustment. Mayor Stevenson asked the council for recommendations of people to fill that position. He requested the council members email him their suggestions. Mayor Stevenson stated the Board of Adjustment would best be served by having someone appointed who lives in the Raymond Road/Country Road neighborhood, but all names will be considered. Susan Price has served as an alternate member and she will now become a regular member and the new person appointed to the Board of Adjustment will serve as the alternate member. This item will be on a future agenda. D. City Council Assignments 56:24 Mayor Todd Stevenson made the City Council Oversight Assignments. He made the following assignments: COUNCIL MEMBER OVERSIGHT ASSIGNMENT Craig Hill: Planning Commission Liaison; Zoning; Mayor Pro Tempore Bette Hubrich: Parks Planning and Development; Recreation Liaison; ULCT Legislative Policy Committee. Don Carroll: Public Safety; City Streets; Water, Sewer and Storm Water Utilities Diane Anderson: Youth City Council; Civic Activities Eileen Moss: Emergency Planning Liaison; Citizen Corps Council Mayor Todd Stevenson will continue to serve on the Davis County Council of Governments; Wasatch Front Regional Council Alternate; Wasatch Integrated Waste 3 Fruit Heights City Council Meeting January 17, 2012 Management Administrative Control Board Vice Chair; and Chamber of Commerce Board of Governors. Council Member Don Carroll agreed to attend some of the Citizen Corps Committee meetings as part of his public safety assignment. Council Member Bette Hubrich made a motion to approve the recommendation of Mayor Stevenson and appoint Council Member Craig Hill to serve as Mayor Pro Tempore. Council Member Eileen Moss seconded the motion and it passed unanimously. 5. OLD BUSINESS A. Adopt the Rules of Meeting Procedure and Order Policy 1:12:30 Mayor Todd Stevenson stated this item was discussed at the last council meeting and tonight the council is presented with a clean copy of the proposed policy. The council went over the policy page by page and corrected formatting and typing errors. It was recommended that the Planning Commission will follow the Rules of Meeting Procedure and Order Policy as it applies to them. No action was taken. B. Discussion on City Recycling Program 1:41:00 Mayor Todd Stevenson stated the council is having a preliminary discussion to consider a recycling program in Fruit Heights. City Manager Brandon Green stated he met with Steve Robinson of Robinson Waste and a representative from Rocky Mountain Recycling regarding a recycling program in Fruit Heights. Council Member Eileen Moss suggested the rate for a second garbage could be raised to encourage people to recycle. She stated that about one third of the city has a second garbage can now and would be a prime target to have a recycling can instead. Mayor Todd Stevenson stated some residents may have difficulty finding space for three garbage cans outside of their home. He would like the citizens to have the option of having smaller cans. Council Member Diane Anderson stated the cost of the recycling program will be a concern to the residents. The city will need to convince the public that it is worth the cost to have a recycling program. She stated a recycling can would require the 4 Fruit Heights City Council Meeting January 17, 2012 residents to sort their garbage and that is another issue. It would require a second garbage can in their kitchen to separate the garbage. Mayor Stevenson stated he will talk to Nathan Rich from the landfill and invite him to come to a city council meeting. 6. CONSENT CALENDAR 2:03:01 Check Register – December Council Member Eileen Moss made a motion to approve the check register for December. Council Member Don Carroll seconded the motion and it passed unanimously. 7. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. B. City Planner’s Report No report was made. C. City Manager’s Report City Manager Brandon Green stated he spoke to Clint Thacker with Davis County Animal Control office regarding farmers having more than three cats on their property. He explained that if there are cats that don’t belong to anybody, they are considered community cats. The Animal Control office is not concerned with community cats. There isn’t a community dog rule, however. A homeowner may have two dogs and they can have a third dog if it is a dog from the animal shelter. Council Member Eileen Moss requested the residents who walk their dogs on Mountain Road be reminded to clean up after their dogs, in accordance with city ordinances. There is an illegal sign on Highway 89 in the UDOT right of way advertising Henry Walker Homes. City Manager Green stated he will inform the developer that is an illegal sign. City Manager Green will remind the Hawkins Corporation to clear the snow off of the sidewalk on Mountain Road. 5 Fruit Heights City Council Meeting January 17, 2012 D. City Council Members’ Reports Council Member Eileen Moss stated there is CERT refresher course scheduled for January 28 at city hall. Lana Carter will make a presentation on the chain of command line of authority through the CERT program. A CERT class is being held every Thursday night in Kaysville. Council Member Bette Hubrich reported that there is a preparedness class tomorrow evening at city hall at 7 PM on preparedness items that can be purchased. April 17 is the Utah Shakeout and the city will participate in it. Council Member Don Carroll complimented the city staff for the way they removed the snow from the streets. Council Member Diane Anderson asked for direction from the council members regarding how to start the Youth City Council. It was suggested she contact the high school Key Club and put a notice in the Ridgerunner. Council Members Diane Anderson, Bette Hubrich and Eileen Moss stated they would like to attend the ULCT Local Officials’ Day with the State Legislature on January 25. 8. CLOSED MEETING A closed meeting was not held. 9. ADJOURNMENT Council Member Craig Hill made a motion to adjourn, seconded by Council Member Diane Anderson and the meeting adjourned at 9:20 PM.
