MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road March 6, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:00 PM. The Pledge of Allegiance was recited and Don Carroll gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Don Carroll, Craig Hill, Bette Hubrich and Eileen Moss and Mayor Todd Stevenson STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones and City Planner Jeff Oyler. Recording Secretary Susan Cranford was excused. VISITORS: Edward Spendlove, Susan Webster, Verla Raymond, Gene Raymond, Tina LePendu, Luke Morgan, Josh Berghout, Tanner England, and Jordan Ivie Agenda Item: 2. APPROVAL OF MINUTES OF MEETING – February 21, 2012 Council Member Eileen Moss made a motion to approve the minutes of February 21, 2012, as amended. Council Member Bette Hubrich seconded the motion and it was approved unanimously. 3. SPECIAL PRESENTATIONS 06:32 Items from the Public There were no items presented 4. NEW BUSINESS 07:00 A. Mosquito Abatement Program (Tina LePendu) Resident Tina LePendu serves on the Mosquito Abatement Board and brought the council members up to date with the board’s activities. She stated the Mosquito Abatement District sprayed for larva and adult mosquitoes on 9565 acres in Davis County last year. Catch basins, storm drains, tree holes and fish ponds are treated. She stated Professor Robert Peterson of Montana State University studied risk assessment of insecticide and concluded that the risk of exposure to the West Nile Virus is greater than any risk associated with being exposed to the pesticide. 1 Fruit Heights City Council Meeting March 6, 2012 B. Discuss/Approve/Deny Title 2A of the Fruit Heights Municipal Code Regarding Government City Manager Brandon Green reviewed the proposed ordinance of Title 2A of the Fruit Heights Municipal Code with the council. The ordinance covers the City Council, Mayor, elections, legislation and constitutional issues of the city code. Council Member Craig Hill made a motion to approve Ordinance 2012-03, an Ordinance enacting and codifying Title 2A of the Fruit Heights Municipal Code regarding government, including provisions related to the City Council, Mayor, elections, legislation and constitutional taking issues, and repealing Chapter 5 of the existing Title 1 of the Fruit Heights Municipal Code regarding similar provisions. Council Member Don Carroll seconded the motion and it passed with the following vote: AYES: Anderson, Carroll, Hill, Hubrich, Moss NAYS: None 5. OLD BUSINESS Discuss/Approve/Deny Final Approval for Open Space Zoning District 37:10 City Planner Jeff Oyler reviewed Chapter 8, Article F: Open Space Zoning District with the city council. The ordinance has been updated in accordance with the council’s requests made at the last council meeting. He stated that tonight the council will only be discussing the verbiage in the ordinance. Discussions will be held at a later date on applying the open space zoning districts to the General Plan and any specific property in the city. At that time, public hearings will be held and affected property owners will be notified. A Future Land Use Map will also be in the General Plan. The Planning Commission recommends approval. City Planner Oyler stated the new Open Space Zoning District will include a recreation and conservation zone. City Engineer Brandon Jones stated the General Plan and the Future Land Use Map are used as guiding documents for the city. The council directed staff to bring the proposed ordinance back with a numbered ordinance for the council’s approval and signature. 6. CONSENT CALENDAR 1:01:10 Budget Report – February No action was taken. 2 Fruit Heights City Council Meeting March 6, 2012 7. STRATEGIC PLANNING A. City General Fund B. Capital Projects Fund C. B & C Road Funds City Manager Brandon Green stated that he expects next year’s revenue and expenditures in the General Fund to remain close to this year’s numbers. When the city is at build-out, the city will not be able to rely on building permits for revenue. The city may have to increase utility rates to support the infrastructure. Property tax revenue will go up when there are more homes in the city. Mayor Todd Stevenson stated that it is the intent of the city to maintain the quality of living that the residents are used to having. Council Member Don Carroll stated the city needs to get out of the habit of robbing from the General Fund to pay into other funds. The city should not increase taxes to pay for the Enterprise Fund. He stated he appreciate the efforts of the council and the City Manager to get the Enterprise Funds self-sustaining. Council Member Bette Hubrich requested staff send her a notice stating when the RidgeRunner comes out, who is writing in it and what the deadlines are for submitting articles. City Manager Green stated he will put the information in the drop box for council members. City Manager Green stated there is not as much money in the B and C road funds as in previous years. The B and C road fund is funded by state taxes. The city plans to make improvements to Nicholls Road, west of Highway 89. Nicholls Road project will probably be done in phases. 8. DEPARTMENT AND CITY OFFICIAL REPORTS 1:31:05 A. City Engineer’s Report No report was made. B. City Planner’s Report City Planner Jeff Oyler reported several people have called him about selling hot dogs and drinks at Nicholls Park. If the city council wants that to happen, the city will have to approve an expenditure to create a location. The city will need to install a slab, drainage, water, sewer, and electricity to the site. The Planning Commission will work on the wording of an ordinance if the City Council will approve the expenditure for the slab and utilities installation. Council Member Don Carroll stated that before the city spends a lot of money, the city needs to consider that fewer youth are playing baseball 3 every year. Fruit Heights City Council Meeting March 6, 2012 C. City Manager’s Report 1:43:15 City Manager Brandon Green reported he received a call from the city’s web provider, CivicPlus. They have a new framework to deliver their websites with more upgrades. The council requested the City Manager to look into it and stated they will rely on staff’s recommendation. D. City Council Members’ Reports Council Member Eileen Moss asked for an update of the progress of the North Mountain Road negotiation with two property owners and was informed the City Manager continues to work on it. She reported there is an Emergency Preparedness Fair in Farmington at the junior high on April 21 and residents of Fruit Heights are invited to participate. During the Utah Shake Out on April 17 the citizens of Fruit Heights are encouraged to communicate with their neighborhood coordinators and area coordinators within fifteen minutes of the mock disaster. Emergency Manager Darren Frandsen will make a report to the city council the evening of the Shake Out. Council Member Bette Hubrich reported she had a meeting with residents Steve Petty and Curtis Tanner to discuss the trail in the hollow at Nicholls Park. They will walk the trail on Friday. Rocky Mountain Recycling wants to be involved in discussions regarding a city recycling program. She is looking for someone to chair the city clean- up day. Craig Hill reported Ivory Homes will be coming to the council with Phase III of the Orchard Farms development and may be asking for approval of the last phase in the fall. E. Mayor’s Report No report was made. Council Member Don Carroll made a motion to move into a closed session to discuss litigation. Council Member Diane Anderson seconded the motion and it passed unanimously. The council went into a closed session at 9:15 PM. 9. CLOSED MEETING Litigation Regarding Real Estate Matters The City Council went into a closed meeting to discuss current litigation. 10.
