MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road November 20, 2012 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order by Mayor Todd Stevenson at 7:00 PM. The Pledge of Allegiance was recited and Bette Hubrich gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Don Carroll, Bette Hubrich and Eileen Moss and Mayor Todd Stevenson. Council Member Diane Anderson and Craig Hill were excused. STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Alexis West, Gary Wright Agenda Item: 2. APPROVAL OF MINUTES OF MEETING – November 8, 2012 Council Member Bette Hubrich made a motion to approve the minutes of November 8, 2012, with corrections. Council Member Eileen Moss seconded the motion and it passed unanimously by those in attendance. 3. SPECIAL PRESENTATIONS No special presentations were made. 4. NEW BUSINESS A. Discuss/Approve/Deny Guarantee Period for the LDS Church (77 South Orchard Drive) City Manager Brandon Green stated the new LDS Church on Orchard Drive is ready to move into their one-year Guarantee (Warranty) Period. An outstanding issue is the detention basin across the street from the church. There are low spots in the detention basin that do not drain properly. City Manager Green stated the contractor has been made aware of the problem and will take care of it when the weather is better. 1 Fruit Heights City Council Meeting November 20, 2012 Staff recommends that the development begin the one-year warranty period starting November 20, 2012. Prior to the subdivision being fully accepted by the city, the developer shall have all outstanding repairs completed. City Manager Green stated staff will begin working on the Zoning Ordinance regarding the water tank that Kaysville will someday build on their lot near the new church. Council Member Eileen Moss made a motion to approve the request for the Orchard Drive Church Subdivision to enter their Warranty Period subject to completion of the items discussed on the memorandum of September 24, 2012, from Jones and Associates and recognizing there is a need to work on the detention basin in the area so there is no standing water. Council Member Don Carroll seconded the motion and it passed unanimously by those in attendance. B. Discuss/Approve/Deny Mountain Splendor Estates (Approximately 1352 E. Peachtree Lane) Guarantee Period 10:45 City Manager Brandon Green stated staff has inspected the Mountain Splendor Subdivision Phases I and II and determined that all required improvements have been properly installed with the exception of the sidewalk, which has not been completed. The agreement the city has with the developer is that the sidewalk will be poured as homes are being built. If the time comes close to the end of the warranty period and all the homes are not completed, the city would like to see the entire sidewalk poured so some sections are not missing. Council Member Eileen Moss suggested the sidewalks be completed three months prior to the end of the warranty period so there is sufficient time for the city to get any spots repaired. Developer Gary Wright stated the curb and sidewalk are contiguous in this subdivision. If the sidewalks are poured now, the approaches will have to be cut and then replaced as houses are built. He requested that the city extend the warranty period on the sidewalk beyond the warranty date on the subdivision. City Engineer Brandon Jones stated staff agrees with putting everything in the subdivision into the guarantee period now with the exception of the sidewalk. The guarantee period for the sidewalk would start at a later date. Council Member Eileen Moss made a motion to accept Mountain Splendor Subdivision Phase I and Phase II into their warranty period with compliance of the memorandums put together by Jones and Associates dated September 24, 2012, with the sidewalk not being part of that warranty period and with the note that the sidewalk needs to be completed within the subdivision prior to the end of the warranty period for Mountain Splendor Phase I and Phase II. Council Member Don Carroll seconded the motion and it passed unanimously by those in attendance. 2 Fruit Heights City Council Meeting November 20, 2012 C. Discussion on Implementing a New Enterprise Fund for Land Drain Systems 18:50 City Manager Brandon Green stated he talked with the City Attorney, Todd Godfrey, about the city’s plan to implement a new land drain utility fee in the new fiscal year. A public hearing will be held to notify the public of the city’s intent of the new enterprise fund. The fund will be used to maintain and construct land drain systems throughout the city. Council Member Eileen Moss stated she is opposed to the city starting new land drain systems in areas of the city that never had a land drain to start with. She stated she understands there may be a situation where a subdivider needs to put a land drain into an area in his development and the city may need to extend it. She doesn’t see that the city has any responsibility to go in and pay for a land drain in an existing subdivision. Council Member Don Carroll stated the Storm Drain Committee asked staff to outline the land drain projects that may need repair work and bring it to the committee for review. He stated that if a land drain is affecting the infrastructure, the city may have to put in a new land drain. City Engineer Brandon Jones stated the fund is not being set up to start new projects. He recommended that the council does not close the door on the ability to do capital projects, however. There may be a future date when the council wants to do more than maintenance of a land drain. City Engineer Jones stated the Country Road land drain project will be funded with the General Fund this year. D. Discuss/Approve 2013 Tentative Meeting/Events Schedule The City Council discussed the tentative meeting schedule for 2013 and made some recommendations. Council Member Bette Hubrich made a motion to approve the calendar for 2013 as amended. Council Member Don Carroll seconded the motion and it passed unanimously. The new calendar will be posted and published as required by state statute. 5. OLD BUSINESS 36:09 Continued Discussion on Recycling Program City Manager Brandon Green stated the City Attorney recommends the city not ask for a formal request for proposal from recycling companies until the city has more 3 Fruit Heights City Council Meeting November 20, 2012 information. He recommends the city decide how often the pick-up should be and request the hauler provide a specific size, make and method of distribution of the cans. City Manager Green stated that the city has a contract with Robinson Waste and technically the city cannot contract with another hauler for recycling without permission from Robinson Waste until 2015. Prior to receiving the information from the city attorney, Council Member Craig Hill asked some questions of Mountain West Curbside Recycling and that information was presented to the council for their information. Robinson Waste had already sent their estimated costs to City Manager Green and that information was also presented. Mayor Todd Stevenson stated neither response is a result of any request for proposal. It was decided that Mayor Todd Stevenson will meet with City Manager Green to work out details of a proposed recycling program and present it to the City Council. The City Council will then vote on whether to table the issue or move ahead. If the council votes to move ahead with a recycling program, a public hearing will be scheduled to present the proposal to the public and receive public input. Based on the response of the public hearing and the information in the proposal, the council will then make a final determination. It was decided to set a target date of February 19 for a public hearing on recycling, if one is necessary. The council will target January 22 for the storm drain public hearing. 6. CONSENT CALENDAR A. Check Register – September and October Council Member Don Carroll made a motion to approve the check registers for September and October. Council Member Bette Hubrich seconded the motion and it passed unanimously by those in attendance. B. Budget Report – October The Budget Report was not available and this item was tabled. 7. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. 4 Fruit Heights City Council Meeting November 20, 2012 B. City Planner’s Report City Planner Jeff Oyler reported he had a recent conversation with a member of the Trust for Public Lands who heard about the city’s interest of 100 acres on the hillside from Senator Orrin Hatch’s office. City Planner Oyler assured him that the Bonneville Shoreline Trail and public access to the property will still be maintained and available if the city acquires the property. He stated that the city may consider the property for a cemetery location in the future. C. City Manager’s Report City Manager Brandon Green reported the city’s insurance carrier says the loss of copper wiring on the lights on the pedestrian overpass (POV) will be covered by the city’s insurance. He is still dealing with repairing some other lights throughout the city. City Manager Green presented a proposed letter to residents on Country Road to the council for review. The purpose of the letter is to inform the residents on Country Road about construction of the land drain. The Scope of Work on the Country Road Project list was drawn up by City Engineer Brandon Jones and presented to the council. City Manager Green stated a water main on Mountain Road recently broke. It affected the water pressure in the south end of Fruit Heights. He received many phone calls from residents late at night about loss of water pressure in the area. The council discussed ways to disperse information to residents in situations like this. It was suggested a notice be posted on Twitter and Facebook by the City Manager for such situations. The council commended the Public Works staff for their quick response and fixing the break in the line. The Trails Committee has gathered a huge pile of wood from the Baer Canyon hollow and Robinson Waste will deliver a dumpster to the hollow at no charge. D. City Council Members’ Reports Council Member Bette Hubrich reported Fruit Heights was represented at the clean-up of the recent storm on the East Coast. She and Council Member Diane Anderson gathered and delivered six large boxes with 3200 batteries, 100 flashlights and hundreds of pairs of gloves to victims of Hurricane Sandy. E.
