MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road January 21, 2014 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order at 7:00 PM by Mayor Don Carroll. The Pledge of Allegiance was led by Diane Anderson and a prayer was given by Craig Hill. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Julia Busche, Craig Hill, Eileen Moss and Scot Poole and Mayor Don Carroll STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Cody Cardon Agenda Item: 2. APPROVAL OF MINUTES OF MEETINGS – January 7, 2014, and January 8, 2014 Council Member Diane Anderson made a motion to approve the minutes of January 7, 2014, as written. Council Member Julia Busche seconded the motion and the motion passed unanimously. Council Member Scot Poole made a motion to approve the minutes of January 8, 2014, as written. Council Member Diane Anderson seconded the motion and it was approved unanimously. 3. SPECIAL PRESENTATIONS Items from the Public There were no items from the public presented. 4. NEW BUSINESS A. 2013 Fruit Heights City Audit Report – Cody Cardon, Wood Richards and Associates Cody Cardon of Wood, Richards and Associates, reported on the 2013 audit of Fruit Heights City. Mr. Cardon gave a brief history of the General Fund of Fruit Heights. He 1 Fruit Heights City Council Meeting January 21, 2014 then reviewed the schedule of revenues, expenditures and changes to fund balances for the fiscal year ending June 30, 2013. He informed the Mayor and City Council that the State of Utah now requires cities to charge city departments the same fees that residents are charged. He also recommended a study be done on the allocation of administrative costs. It was also recommended that the city allocate resources to provide training on the requirements of the Government Records Access Management Act (GRAMA). The city is also required to use the impact fee monies collected to be spent or at least dedicated within six years from the date of receipt. The city needs to spend at least $76,000 from the park impact fees by the end of FY 2013-14. Mr. Cardon reported the city funds are being managed very well and the city is in good financial shape. B. Discuss Weber Basin Agreement and Their Request to Locate a Well at Nicholls Park 0:24:56 City Manager Brandon Green stated Weber Basin Water Conservancy District is interested in locating a few wells along the Highway 89 corridor and would like to place a well at Nicholls Park in Fruit Heights. The City Attorney has indicated that the city may lease an area in Nicholls Park but the city cannot sell any land within Nicholls Park. After discussion, the City Council directed the City Manager to further pursue the possibility of drawing up a lease agreement with Weber Basin and agreed that the city should receive something in kind. City Manager Green stated he will discuss drawing up a lease agreement with the City Attorney and request a benefit to the city be part of the agreement. C. Discuss Nicholls Road Agreement with Davis County Golf Course 0:48:45 City Manager Brandon Green stated that Fruit Heights has an agreement with Davis County regarding the Nicholls Road improvement project that extends in front of the entrance to the Davis Golf Course. It was agreed that the county would pay for their frontage of 735 feet along the parking area to the east side of the practice green. However, Tony Thompson of Davis County has now indicated that the county would not be paying for the 203 feet of property that they were leasing from the city because it was not part of their frontage. City Manager Green feels that the portion of the land being leased is clearly for the use of the golf course and is the county’s responsibility to pay for the those improvements. The city has the responsibility to maintain, repair, replace the sidewalk, curb, gutter and 2 Fruit Heights City Council Meeting January 21, 2014 street for many years beyond the 100 years that the county is leasing the property. The county pays the city $1 a year for the lease. City Manager Green stated the City Attorney agrees that the county does have a responsibility to pay for the improvements. He suggests that the Mayor meet with the County Commissioners and discuss the issues. Mayor Don Carroll stated he will meet with County Commissioner John Petroff next week and discuss this issue with him. D. Discuss Filling Two Vacancies on the Board of Adjustment 0:57:25 Mayor Don Carroll stated he recommends resident Bill Starkweather be appointed to the Fruit Heights City Board of Adjustments. Council Member Julia Busche made a motion to appoint Bill Starkweather to the Fruit Heights Board of Adjustments. Council Member Craig Hill seconded the motion and it passed unanimously. 5. OLD BUSINESS A. Discuss/Approve/Deny Bids for Kitchen Appliances 1:01:10 City Manager Brandon Green stated he has received only two bids for kitchen appliances. He has decided that black appliances in the basement kitchen will require less maintenance. Discussion of this item was tabled. B. Discuss/Approve Basement Uses and Rental Contract 1:10:19 City Manager Brandon Green presented a proposed list of approved uses for the City Hall basement. The City Council discussed placing limitations on some types of activities. It was decided that restrictions should be in place when the basement is used for commercial purposes. It was suggested that alcohol should not be served at events held at City Hall and each activity should be looked at individually. It was decided that the room will not be reserved more than six months in advance. City sponsored activities will have precedent over the rental of the room. The associated work placed on staff with renting the basement to the public needs to be considered. It was suggested that fees be a part of the rental agreement. Whether or not to allow a large tent on the grounds needs to be considered. Tent stakes may damage the 3 Fruit Heights City Council Meeting January 21, 2014 underground sprinklers and rescheduling of the sprinkling system would have to be considered. City Manager Green will propose a list of rental fees to present to the City Council for approval at a future City Council meeting. 6. CONSENT CALENDAR Check Register – November, December 2013 1:22:55 Council Member Craig Hill made a motion to approve the check resister for November and December 2013. Council Member Diane Anderson seconded the motion and it was approved unanimously. Council Member Scot Poole requested a list of the General Ledger accounts so he will have a reference to what the account numbers refer to. 7. DEPARTMENT AND CITY OFFICIAL REPORTS A. City Engineer’s Report No report was made. B. City Planner’s Report City Planner Jeff Oyler stated some cities have eliminated their Board of Adjustments because there are so few appeals made for them to consider. He stated that the Fruit Heights City Board of Adjustments meets once a year to select a chairman but has not had a matter of business to conduct for about four years. The council members stated they would like to keep the city’s Board of Adjustments for now. He also reported that he submitted a request for a grant on behalf of the city for some trail money. If granted, it will allow the construction of the Bonneville Shoreline Trail from Farmington to Baer Canyon across the Hinckley property. The grant is $25,000 and some city park money could be used on the trail also. It was suggested that some type of restroom facilities could be considered as part of the trail. C. City Manager’s Report City Manager Green reported that the city’s recycling program is at a standstill because the city cannot compete with the free recycling being offered by Mountain West Recycling Company. There are a lot of residents who want a city recycling program. A letter will be sent to residents with the next utility bill explaining the situation. Mayor Don Carroll stated that residents will be informed that the program has been put on hold and they are to be referred to the Mountain West Recycling program. In 17 months the 4 Fruit Heights City Council Meeting January 21, 2014 city’s garbage contract will be up for renewal and he suggested this item be reviewed at that time. Council Member Anderson suggested the public also be reminded they can take their recycling to the landfill for free also. D. City Council Members’ Reports 1:49:37 Council Member Eileen Moss requested mentioning that the Emergency Preparedness Committee has water purification kits for sale in the RidgeRunner and on the city’s website. Council Member Scot Poole reported he is seeking volunteers to sign up to work on the trails and requested an announcement be placed in the Ridgerunner. Council Member Julia Busche reported that recently some thieves were spotted in the Hidden Springs area. A resident saw them at a neighbor’s home and reported it to the sheriff’s office who then responded within 20 seconds. The individuals had been on an all-night crime spree and were apprehended. She suggested all residents install a good outdoor lighting system at their homes. E. Mayor’s Report 1:56:55 Mayor Don Carroll distributed a list of City Council Oversight Assignments. City Manager Green stated he will put a notice in the Ridgerunner about the type of mailbox that is recommended to be installed in streets where there is snow. The weight of the snow pushes over many styles of mailboxes. 8. COMING CALENDAR EVENTS A. Local Officials Day at the Legislature – Wednesday, January 29, 2014, 7:30 AM to 2:00 PM – Youth City Council is also invited B. Newly Elected Officials Training Saturday, February 8, 2014, 8 AM to 1:30 PM – Salt Lake City Hall No action was taken. 9. CLOSED MEETING Hinckley Agreement Council Member Craig Hill made a motion to move into a closed meeting to discuss the sale, purchase or exchange of real property. Council Member Julia Busche seconded the motion and it was approved unanimously. The meeting went into closed session at 9:16 PM. Council Member Diane Anderson made a motion to move out of the closed meeting. The motion was seconded by Council Member Julia Busche and the motion was approved unanimously. The closed session ended at 9:39 PM. 10. ADJOURNMENT Council Member Craig Hill made a motion to adjourn, seconded by Council Member Eileen Moss.
