MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road April 8, 2014 REGULAR MEETING The regular meeting of the Fruit Heights City Council was called to order at 7:03 PM by Mayor Don Carroll. The Pledge of Allegiance was led by Craig Hill and Jeff Oyler gave a prayer for the opening ceremony. COUNCIL MEMBERS PRESENT: Council Members Julia Busche, Craig Hill, Eileen Moss and Mayor Don Carroll. Council Members Diane Anderson and Scot Poole were excused. STAFF PRESENT: City Manager Brandon Green, City Engineer Brandon Jones, City Planner Jeff Oyler and Recording Secretary Susan Cranford VISITORS: Mike Peterson, Casey Cumming, Sue Cumming, Howard McRoberts, Conner Powell, Tricia Green, Tammy Wursten, Pat Gould, Bill Gould, Kimberly Wagner, Claire Wagner, Jade Sewell and Brody Sewell Agenda Item: 2. APPROVAL OF MINUTES OF PREVIOUS MEETING – March 4, 2014 Council Member Craig Hill made a motion to approve the draft of the minutes of March 4, 2014, with corrections. Council Member Julia Busche seconded the motion and it passed unanimously by those in attendance. 3. SPECIAL PRESENTATION 05:00 There were no special presentations made. 4. NEW BUSINESS 4.1. Discussion on Requests for Additional Recreational Uses at City Park 4.1.1. Pickleball: Casey Cummings Casey Cummings requested the City Council consider installing pickleball courts in Fruit Heights. He stated the popularity of this sport is growing rapidly. It is played by all ages. The closest pickleball courts are in Bountiful, Roy and Ogden. Pickleball is a cross between tennis, ping pong and badminton and is played with paddles and a whiffle ball. It is played on a court a little smaller than a tennis court. 1 Fruit Heights City Council Meeting April 8, 2014 Mr. Cummings answered questions of the Council members and stated the nets used on the outdoor courts are usually taken down in the winter. He suggested that holding pickleball tournaments would be a way of raising funds for building the courts. Resident Howard McRoberts stated he has been playing pickleball for about four years. There are over 250 members in the Ogden Pickleball Association. Ogden now has eight pickleball courts. He stated the St. George area has 40 pickleball courts and plans to build 12 more. He suggested placing a pickleball court in Nicholls Park where the sand volleyball court now exists. City Manager Brandon Green stated the installation cost for a pickleball court is around $25,000. Mayor Don Carroll stated Fruit Heights does not have a Recreation Department to handle events such as suggested. Staff could take care of maintenance of a pickleball facility but not scheduling and booking events. Mr. McRoberts stated his pickleball organization could volunteer to handle the scheduling. 4.1.2. Frisbee Golf (Disc Golf) 28:34 Farmington resident, Mike Peterson, requested the City Council consider placing a disc golf course in the wooded areas of Nicholls Park. He stated disc golf is a game where players throw a disc into a basket or target over a course of 9, 18, or 27 holes. The game is similar to golf. Disc golf is a game that every age can play. It is a low impact activity that gets people walking. There are over 5000 courses in the nation. The estimated cost to build a disc golf course is about $5000. Mr. Peterson stated the nearest disc golf course is in Riverdale. He stated the disc golf players in the area are willing to volunteer their help in installing a course. Jade Sewell stated he is willing to donate all design work and drawings for the disc golf course. Mayor Don Carroll stated the Trails Committee will discuss this proposal and ensure a disc golf course does not conflict with their plans for a trail in the hollow at Nicholls Park. Council Member Julie Busche requested Mr. Peterson and Mr. Sewell leave their contact information with her and she will take it to the Trails Committee. 4.1.3. Basketball Court: Kimberly Wagner 43:20 Resident Kimberly Wagner requested the City Council consider placing an outdoor basketball court in Fruit Heights. She suggested the area east of the restrooms in the park surrounding City Hall (Harvey Park). She stated that Council Member Julia 2 Fruit Heights City Council Meeting April 8, 2014 Busche informed her that an outdoor basketball court was included in the city’s General Plan at Harvey Park. Mrs. Wagner stated that the estimated cost for a basketball court is around $50,000. City Manager Brandon Green stated the $50,000 price includes several hoops. It may be possible to begin with a court and two hoops, with the option of adding more hoops if the city finds there is a demand. 4.2. Arbor Day Proclamation and Eagle Scout Project: Conner Powell/Eagle Scout 49:42 Boy Scout Conner Powell of Troop 515 made a presentation to the City Council for his Eagle Scout project. He would like to do a project for the residents of Fruit Heights at Nicholls Park. He proposes to replace some fallen trees at Nicholls Park that were destroyed during the windstorm in 2011. He has received $600 from the 2014 Utah Arbor Day Grant Fund to replace some of the trees. With the money he received, he would like to plant three lacebark elm trees. He will match the fund with in-kind donations for the installation of the trees. He asked for the Mayor’s and City Council’s support by signing the Arbor Day Proclamation recognizing April 25, 2014, as Arbor Day. Mayor Don Carroll requested Conner meet with the Public Works Department about a source of water for the trees. Council Member Julie Busche stated she is the liaison with the Trails Committee and will work with Conner to get an approved place for the trees. 4.3. City Owned Facilities Policy 58:40 City Manager Brandon Green stated that the basement of city hall is now available for rent by residents. The City Attorney recommends the City Council approve a Facilities Policy to protect the city from unforeseen events. City Manager Green presented the policy as drawn up by the City Attorney. The council discussed the purchase of a piano for the basement. It was decided that the purchase of an upright piano will be considered during budget hearings. If the city finds that there is a demand for the piano, the Council may then discuss the purchase of a more expensive style of piano in the future. The Council may also consider upgrading the acoustics and storage space for the piano. 3 Fruit Heights City Council Meeting April 8, 2014 City Manager Brandon Green stated the occupancy limit of the basement is 70 people. 4.4. Animal Care and Control Contract 1:16:50 City Manager Brandon Green stated it is time to renew the Davis County Animal Care and Control contract. The rates are lower this year because the Animal Control office received fewer nuisance animal pickup calls in Fruit Heights last year. Council Member Eileen Moss made a motion to approve the 2014 Interlocal Cooperation Agreement between Davis County and the City of Fruit Heights for Animal Control Services. Council Member Craig Hill seconded the motion and it passed unanimously by those in attendance. 4.5. Discuss/Approve/Deny Request to Purchase Additional Culinary Water Shares from Weber Basin Water Conservancy District 1:16:50 City Manager Brandon Green stated that staff sees the need to purchase additional Tier 2 water shares from Weber Basin to accommodate future building in the city. The city will not be using these shares at this time, but once this block of water is sold, the cost for the next block of water will increase drastically. Staff recommends the purchase of an additional 150 acre feet of water at a cost of $53,821.50. Council Member Craig Hill stated that it is critical to note that Weber Basin is almost out of available Tier 2 water. City Engineer Brandon Jones stated that if all the shares are not necessary, he doubts Fruit Heights would be allowed to transfer unused shares of water to another entity. City Planner Jeff Oyler stated about 100 acres of property remains in the city to be developed. Council Member Eileen Moss stated she does not feel that the city needs another 150 acre feet. She is concerned that the city would be paying for something that won’t be used. Mayor Don Carroll stated he would like the City Engineer to analyze when the city will start using the new water shares. Council Member Craig Hill requested the City Engineer also include an analysis of water used in the city during the first quarter of 2014. City Engineer Jones stated he will also look into the possibility of getting two or three contracts with Weber Basin for 25 or 50 acre feet each. Then, if the city decides it does not need that much water, perhaps one of the contracts could be dissolved later. 4 Fruit Heights City Council Meeting April 8, 2014 Mayor Carroll stated the council will postpone a decision until more information is available. 4.6. Discussion Regarding Changes to Spring Clean-up 1:49:20 City Manager Brandon Green stated that the last phase of construction along Nicholls Road has taken about 40 feet from the city’s stock pile space. It is now a very narrow entrance and it would be difficult to use that area for green waste dumpsters during the spring clean-up. Over the years the clean-up program has gradually dwindled as more residents participate in the city sponsored Green Waste Recycling program. City Manager Green proposes allowing residents to take their green waste to the landfill for no cost during April 26 to May 3, 2014. The city will issue vouchers for green waste that the residents can pick up at city hall. City Manager Green displayed the proposed vouchers that will be distributed to the residents. Council Member Julie Busche made a motion to approve the spring clean-up vouchers to be picked up at city hall by residents between April 21 and April 26 for green waste. Council Member Eileen Moss seconded the motion and it passed unanimously by those in attendance. Council Member Busche will place this item on the city’s social media sites. 5. OLD BUSINESS 5.1. Update on Sprinkling System City Manager Brandon Green stated the council previously approved the purchase of a Rainbird weather monitoring system for city properties. A representative from Rainbird has now informed him that the technology has changed regarding the proposed weather station and everything is done with cellular service. The new program will use a wafer that sits at a monitoring station. This system costs significantly less than the weather station. Residents will not be able to tie into the system at City Hall but they will have a program offered for water conservation that allows them to purchase the wafers at a reduced rate. City Manager Green is gathering the costs for the new system and will present it to the council at a later meeting. 5.2. Discussion on 2014 Streets Assessment 2:00:35 City Engineer Brandon Jones presented a map of the city streets showing the condition of the streets. The condition of the streets was divided into six different categories ranging from critical condition to excellent condition. City Engineer Jones stated he will bring a list of the remaining surface life of the streets to a future City Council meeting. 5 Fruit Heights City Council Meeting April 8, 2014 That will allow the council members to look at the cost of capital improvement projects for the roads while approving next year’s budget. 5.3. Update on the Well Repairs at the Mountain Road Pump House 2:10:20 City Manager Green stated that a new pump needs to be purchased for the well on Mountain Road. He will get the costs and bring it back to the council for approval. No action was taken. 5.4. Discussion on Horse Corral and Barn at Hinckley Park After the Closed Meeting ended at 9:52 PM, the City Council discussed this agenda item. City Manager Brandon Green stated he met with Bob Hinckley had informed him the city will remove the barn on the hillside because it is a liability. A concrete pad and hitching post will remain. 5.5. Cemetery Update 2:12:00 Mayor Don Carroll stated he and City Manager Brandon Green met with Senator Orrin Hatch’s office regarding the property on the east bench that the city hopes to use for a cemetery. That property was originally sold to the federal government and because of that, they cannot turn it over to the city unless the city pays fair market value of around 2.5 to 3 million dollars. An Environmental Protection Act (EPA) study on the property would also have to be done on the property. Senator Hatch’s office is going to find out if the original EPA study that was done on the property ten years ago is still valid. At this time Senator Hatch’s office will not put the matter to a vote before the Senate because he does not think there is support to push it through. The city could trade property to the federal government for the 100 acres in question. However, the city only needs about 40 acres for a cemetery. Mayor Carroll recommended that the council continue to look at other options for a cemetery. 5.6. Discuss/Approve/Deny Basement Rental Amount City Manager Brandon Green stated he now thinks the rates for renting the basement at City Hall need to be raised. Currently the city charges a $100 deposit and he has found that maintenance costs for the basement are more expensive than he originally thought they would be. He recommends a $150 deposit be charged with a refund of $50. 6 Fruit Heights City Council Meeting April 8, 2014 Council Member Julia Busche made a motion to raise the rental amount to a $150 deposit with a $50 refund (if it is left in order) for a 24 hour rental plus $10 an hour for all uses. Council Member Craig Hill seconded the motion and it passed unanimously by those in attendance. Mayor Don Carroll requested the rental fees and uses should be reviewed on a regular basis by the city. 6. CONSENT CALENDAR 6.1. Check Register: March 2:26:55 Council Member Craig Hill made a motion to approve the check register. The motion was seconded by Council Member Eileen Moss and it passed unanimously by those in attendance. 6.2. Budget Report: March City Manager Brandon Green stated the budget report was not available and it will be available at a future meeting. 7. UPCOMING CALENDAR EVENTS 7.1. Utah Shake Out, April 17, 2014 Council Member Eileen Moss stated the Fruit Heights Citizen Corps Committee (CCC) is requesting residents put out a green card in their window during the Utah Shake Out on April 17. City Manager Brandon Green has received word that a yellow card is to be used. Council Member Moss will work with City Manager Green to correct the mistake tomorrow. 7.2. Spring Clean-up Date, April 26, 2014 7.3. Tri-City Emergency Preparedness Fair, May 3, 2014 7.4. Adopt Tentative Budget for FY 2014-15 May 6, 2014 7.5. Set Date for Tour of W/MN Facilities Mayor Don Carroll stated he will set the date for the tour of the Waste Management facilities later because Nathan Rich is tied up with other matters for a couple of months. 9. CITY COUNCIL AND CITY STAFF REPORTS Council Member Julie Busche reported:  Name tags for the council members would be helpful when attending meetings outside of the city office. She also requested tee shirts for City Council members 7 Fruit Heights City Council Meeting April 8, 2014 and staff to be worn while working on the trail. City Manager Brandon Green stated he will have the cost for the purchase of those items on the next City Council Agenda.  She stated she sent out emails to drum up support for more help on the Nicholls Park trail. She would like to see a website link to the trail on the city’s website.  She has received word that youth that are paintballing in Nicholls Hollow. She requested the Sheriff’s Office be informed at tomorrow night’s meeting with the Sheriff’s Office. Mayor Don Carroll stated the city may need an ordinance or policy regarding activities such as that in the city.  She walked the Hidden Springs Trail and stated it is in good condition. Council Member Eileen Moss stated she is looking for more vendors for emergency preparedness products for the Emergency Fair on May 3. Council Member Craig Hill recommended that the letter that is annually sent out to donors for Founders Day be sent out soon. Mayor Don Carroll stated that tomorrow night is a safety awareness meeting that will be held at City Hall. It is an Eagle Scout project with cooperation of the Sheriff’s Office. This portion of the regular meeting ended at 9:47 PM. 8. CLOSED MEETING Discussion on Purchase of Real Property Council Member Craig Hill made a motion to move into a closed meeting to discuss the purchase of real property. Council Member Eileen Moss seconded the motion and it passed unanimously by those in attendance. The City Council went back into an open meeting at 9:52 PM. Council Member Eileen Moss made a motion to adjourn, seconded by Council Member Craig Hill. The meeting ended at 10:10 PM.
