Minutes City Council Meeting Fruit Heights City 910 South Mountain Road March 10, 2020 1. WELCOME: Mayor John Pohlman called the meeting to order at 7:02 pm. 2. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was recited by Scott Groberg The meeting was opened with Council Member Julia Busche offering a word of prayer. COUNCIL MEMBERS PRESENT: Mayor John Pohlman and Council Members Diane Anderson, Gary Anderson, Julia Busche, Jeanne Groberg, and Eileen Moss were all present. CITY STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler, City Engineer Brandon Jones and City Public Works Superintendent Darren Frandsen were present. VISITORS: Jim and Linda Crismer with War Dog K-9’s Mazzie and Geli, Youth City Council representative Hannah Davis, Paul Nielson, Scott Groberg, Micah Dally, Micah Poor, Ridge Hassan DECLARATION OF CONFLICT(S) OF INTEREST: City Council had none. 3. PUBLIC COMMENTS: None 4. REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETING: Minutes from the February **, 2020 were not available to be approved. SPECIAL PRESENTAION(S) Youth City Council Member Hannah Davis presented to the City Council what the YCC has been working on. o They are hosting an Art Contest and have asked the City Council to help judge the art that they collect. They are asking that all Art be submitted to the City Office by April 15, 2020. o They are planning on hosting the City’s annual Easter Egg hunt which is scheduled for April 11, 2020 at 10:00 am The Mayor and City Council expressed their appreciation to the Youth City Council for their work and efforts. 5. CITY BUSINESS: 5.1 Residents Jim and Linda Crismer addressed the City Council about their work with Mission K-9 and Congressman Stewart’s office. The Crismer’s informed the City 1  March 10, 2020 Council that Congressman Stewart’s office recently approved $200K to help bring dogs home that have been serving in wars. In honor of these war dog veterans, March 13th is being recognized in the State of Utah as War Dog Veterans Day. Mr. and Mrs. Crismer also updated the City Council on the Vietnam Veterans Walls in Layton and indicated that they have hired a local sculpture, Linda Torrid, to produce a replica of a War Dog Memorial Statue that is modeled after Mazzie, Jim and Linda’s Veteran K-9. They anticipate the cost to be between $50,000.00 - $55,000.00. To date, they have been able to raise $20,000.00 and have several plans in place to help them raise the remaining $35,000.00 including a significant grant from Layton City. The Crismer’ have visited several Cities in Davis County soliciting donations, and are visiting Fruit Heights City also seeking a donation. After a discussion on the issue, a motion was made by City Council Member Julia Busche to approve a $500.00 donation to the War Dog Memorial. The Motion was seconded by City Council Member Diane Anderson and was passed unanimously by the Council. 5.2 Discuss/Review/Approve/Deny, Whispering Oaks Subdivision First Amendment. City Manager Green reported to the City Council that he had spent significant time researching the history of the East Oaks and Whispering Oaks Subdivision. After considerable research and time it appears that the East Oaks Subdivision has adequate Right-of-Way to install a sidewalk at a future date, however, when the Whispering Oaks Subdivision was approved, The Planning Commission and City Council didn’t require that the Right-of-Way include sidewalk. A note was placed on the plat indicating that a 5’ sidewalk could be installed but that the sidewalk would be outside the Right-of-Way, thus the reason for the “jog” in the subdivision plat. The City Engineer, City Planner, Public Work Director, and City Manager met to review the Whispering Oaks Subdivision Plat and determined that if sidewalk were to be installed up East Oaks Drive it would likely only be installed along one side of the road and not likely installed on both sides of East Oaks Drive because of grading, retaining, utility, and topography challenges. City Planner Jeff Oyler also addressed the power utility easement that exists on lot 7 of the subdivision. The City has required that the developer address the easement with Rocky Mountain Power and provide a letter to the City outlining the setback requirements along the easement. Brian Bare, the developer, has obtained a letter from Rocky Mountain Power that stipulates that any home that is constructed on this lot needs to maintain a 7.5 ft horizontal setback with a 13.5 vertical clearance from the home to the powerline. After a lengthy discussion regarding the subdivision plat, City Council Member Julia Busche made a motion to approve the Whispering Oaks Subdivision Plat as approved by the Planning Commission and as presented to the City Council for Final Plat approval, with Council Member Diane Anderson seconding the motion. This motion failed for lack of support. 2  March 10, 2020 A second motion was made by City Council Member Eileen Moss which included that an Improvement Agreement and Grant of Lien be filed with the subdivision plat which would require that the property owners provide an easement and install the sidewalk at a future date as determined by the City. All such required work will be the responsibility of the property owner(s). City Council Jeanne Groberg seconded that motion, the motion passes 3-1. City Planner Oyler indicated to the City Council that he will prepare the required document and have it signed by the developer, Brian Bare, prior to the plat being recorded with Davis County. 6. CITY COUNCIL REPORTS a. City Council Member Julia Busche reported on the City’s preparations for the Great Utah Shake Out which will occur on Thursday April 16th at 10:15am 7. CITY STAFF REPORTS: a. UDOT continues to move a lot of dirt along the future south bound offramp at 400 N. In addition, UDOT will be closing the Park-and-Ride lot for a period of two months while they work to install culinary and secondary water lines in Country Way. Residents should also expect temporary detours and road closures along the east side of Hwy-89 as UDOT relocates other utility lines. b. The City is advertising for a City Council and Planning Commission Secretary/Recorder for the meetings and the minutes. 8. COMMUNICATION ITEMS: 9. ELECTRONIC MEETING: Not held. 10. CLOSED MEETING: Not held. ADJOURNMENT: Council Member Julia Busche made a motion to adjourn the meeting. Council Member Eileen Moss seconded the motion. It was approved unanimously, and the meeting was adjourned at 8:33 pm The City’s next City Council meeting is scheduled for April 7, 2020 at 7:00 pm.
