MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road August 3, 2021 WELCOME: Mayor Pro Tem Julia Busche called the meeting to order at 7:02 pm. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Council Member Diane Anderson, and the meeting was opened with Council Member Jeanne Groberg offering a word of prayer. COUNCIL MEMBERS PRESENT: Council Members Diane Anderson, Julia Busche, Jeanne Groberg, and Eileen Moss were all present. Mayor John Pohlman and Council Member Gary Anderson were excused. CITY STAFF PRESENT: City Manager Brandon Green, Public Works Superintendent Darren Frandsen and City Recording Secretary Amy Gardiner were present. VISITORS: Aubry Bennion, Paula Stephenson, Carol Elliott, Doug Clift, George Ray, Hailey Halliday, Colby Cox, Sergeant Trease, Laura Hubrich, Ron Hubrich, Jerry LeBaron, Kristie Kearns, Mike Ramero, and Rance Pickering were present. TRAINING: Council Member Diane Anderson presented a training with information found in the Utah League of Cities and Towns handbook. She read from the handbook the difference between a public hearing and a public meeting and how the City Council should act in both cases. She reminded the Council that City Council Meetings are public and for the public good. She reminded the Council to keep in mind the unseen public that are viewing the meetings online and reading the minutes online as well. She suggested two things to remember: 1) Council Members should be clear about topics they are discussing and 2) Council members should be very aware of their audience. She also commented that the City minutes become a historical record of what decisions and accomplishments the Council makes respecting the public interest of Fruit Heights City. CONFLICT OF INTEREST: None. PUBLIC COMMENTS: Doug Clift commented about the situation of Fruit Height City parks. He would like to see one on the north side of town and possibly one located at the Webster property on Mountain Road and Green Road with the possible new proposed subdivision in that area. He feels like the park would be a reminder of what Fruit Heights used to be. REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETINGS: City Council Meeting May 18, 2021 City Council members discussed the draft minutes that previously had been provided to them for the May 18, 2021 City Council Meeting and suggested changes. After discussion, Council Member Diane Anderson made a motion to approve the minutes for the May 18, 2021 City Council meeting as revised in the preceding discussion. The motion was seconded by Council Member Eileen Moss and it was approved unanimously. SPECIAL PRESENTATIONS: Youth City Council: Colby Cox (YCC Mayor) and Hailey Halliday (YCC Member) reported on the Blood Drive that was held on July 23, 2021. They also talked about their upcoming plans of hosting the 5K Run held at the Founders Day celebration. They have a new member orientation on August 28, 2021 noting the new members will be picked from nine received applications. The new Youth City Council will be sworn in at the City Council Meeting on September 7, 2021. Founders Day Planning (Jerry LeBaron) Jerry LeBaron discussed the final plans for the upcoming Founders Day. He noted some concern about parking and traffic for the event with ongoing road construction in the area. He discussed needs for assistance with setting up for the event and reviewed the agenda for the evening. He indicated 200 swag bags had been prepared for the event. Other topics discussed included the band, the stage, chairs, tables, a future bowery, power cords, helicopter landing, historian’s display, food trucks, train rides, K-9 unit, animal shelter, portable restrooms, volunteers, name tags, awnings, a golf scramble tournament, fireworks and other activities. The City Council thanked Jerry and Dennise LeBaron for all their work. Presentation from UDOT Rance Pickering, Segment Manager for Oak Hill Constructors, reported that he has worked all around the State of Utah and Fruit Heights has been great to work with on the UDOT US-89 project. He recognized City Manager Brandon Green and Public Works Superintendent Darren Frandsen for working with the UDOT on the project and helping the project stay on schedule. He presented both of them with a plaque to recognize their efforts on the project. After the presentation of the plaques and photos, Rance Pickering gave an update of the UDOT US-89 project, which covered: • The recent opening of the 200/400 North interchange ahead of schedule with significant media coverage • The fact that the interchange is operational but the work is ongoing in the area • The closing of access to/from Nicholls Road at US 89 for construction of the bridge over the highway requiring drivers to use the 200/400 North interchange to cross the highway • The beginning of construction of the frontage road and highway southbound lanes between Eagle Way and Green Road • The ongoing sewer and water line installation at 1350 East (Golden Circle) Aubry Bennion of Oak Hills Constructors and Council Member Julia Busche discussed the use of Facebook for public communications regarding the UDOT US-89 project. Both felt like it was a great way for people to express their opinions and be heard. The City Council, the City staff and the staff from Oak Hills Constructors also discussed various safety concerns with the project. Davis County Sheriff Report (Sergeant R. Trease) Sergeant R. Trease reported on the Sheriff’s hours and incidents in the City from June 1, 2021 to August 2, 2021. The hours averaged about 80 per week and 11 per day for a total of 726 hours. He also discussed with the City Council and the City Staff the traffic citations and driver speeds on Mountain Road. They have mostly been giving warnings. The largest incidents in this time period included a domestic violence assault and hit and run at Cherry Hill, a suspicious vehicle at the Fruit Loops Mountain Bike Trailhead, a drug offense at Nicholls Park, a missing persons report, a welfare check/mental health check, and a bicycle theft at Cherry Hill. CITY BUSINESS: Review/Discuss/Approve/Deny Amendment 1 to Pond Maintenance and Ownership Cooperative Agreement Between UDOT and Fruit Heights City Amendment (Brandon Green) City Manager Brandon Green had previously provided the Council with a copy of the First Amendment to the Pond Maintenance and Ownership Cooperative Agreement Between UDOT and Fruit Heights City. City Manager Brandon Green took the time to review the different ponds in the Fruit Heights area that are subject to this agreement and the City’s maintenance obligations for those ponds. Council Member Jeanne Groberg pointed out that the amendment adds the City’s maintenance obligation of the Ward Road Pond (Pond “O”) located north of Ward Road and west of US-89. City Manager Brandon Green reviewed the maintenance and responsibility the City will have with this pond. He also explained the pond will be annexed into the City since it collects the storm water runoff from Fruit Heights as well as runoff from UDOT. Following discussion, Council Member Diane Anderson made a motion to approve the Amendment 1 Pond Maintenance and Ownership Cooperative Agreement Between UDOT and Fruit Heights City Amendment. The motion was seconded by Council Member Eileen Moss and it was approved unanimously. CONSENT CALENDAR: None. INFORMATION ITEMS/UPCOMING EVENTS: Council Member Julia Busche reviewed upcoming events including: August 7 - Founders Day August 17 - Truth in Taxation Hearing August 23 - Planning Commission Meeting CITY COUNCIL & STAFF REPORTS: Council Member Jeanne Groberg reported that YCC has been having a busy summer. She also discussed the Utah League of Cities and Towns Convention which will be held at the end of September. City Manager Brandon Green encouraged the City Council Members to let him know if they wanted to attend. Council Member Eileen Moss suggested that dead-end signs be posted on Oakmont Lane and Baer Canyon Road as well. She says there are a lot of drivers looking to exit City neighborhoods and they mistakenly enter these dead-end streets. Council Member Eileen Moss made a motion to adjourn the meeting. Council Member Jeanne Groberg seconded the motion. It was approved unanimously, and the meeting was adjourned at 8:32 pm.
