FRUIT HEIGHTS CITY COUNCIL MEETING AGENDA NOTICE IS HEREBY GIVEN THAT THE FRUIT HEIGHTS CITY COUNCIL WILL HOLD A REGULAR MEETING AT 7:00 PM ON SEPTEMBER 19, 2023 AT FRUIT HEIGHTS CITY HALL, 910 SOUTH MOUNTAIN ROAD, FRUIT HEIGHTS CITY, UTAH. CONSULTING ENGINEERS MEMORANDUM TO: Fruit Heights City Mayor and City Council FROM: Zac Burk, PE Fruit Heights City Engineer CC: Jacob Smith – Fruit Heights City Manager Darren Frandsen – Fruit Heights City Assistant City Manager RE: Impact Fee Facilities Plan & Rate Study Proposal – Culinary Water Award Recommendation Memo Date: September 12, 2023 ______________________________________________________________________________ On July 31st of this year, our office published a Request for Proposal (RFP) to develop an up-to- date and complete Impact Fee Facilities Plan (IFFP) and associated rate study as part of the Culinary Water Capital Facilities Plan. The proposal had a submittal deadline of September 1st, 2023. Two proposals were received and evaluated based on the following criteria: 1. Scope of Work – Conformance with the general scope of Work listed in this RFP; approach to the Work 2. Experience – Firm’s experience performing similar work; references; project team qualifications 3. Schedule – Proposed schedule; ability to meet past projects’ schedules 4. Fee – Total proposed fee; hourly rates The weighted percentages are as follows: Item Weighted Percentage Scope of Work/Approach 25 Experience/References 30 Time Schedule 25 Fee 20 Total 100 A total of four individuals were selected to evaluate and score the proposals based on these criteria, two (2) from Jones and Associates and two (2) from Fruit Heights City. The compiled 2023 IFFP – Culinary Water Page 2 of 2 Award Recommendation Memo September 12, 2023 results from this committee are attached to this memo. The results favor Zions Public Finance as the strongest candidate. If the Council agrees with this recommendation, please pass a motion accepting the proposal and awarding the IFFP study to Zions Public Finance. We will prepare the Contract Agreement and Notice of Award for the City to sign. Raymond Inc.) AN ORDINANCE ANNEXING REAL PROPERTY KNOWN AS PARCEL NUMBER 11-120-0006 EXTENDING THE CORPORATE LIMITS OF THE CITY WHEREAS, Samuel G. Raymond Inc., the owners of certain real property described below, submitted an annexation application on October 26, 2021, and therefore desire to annex such real property to the corporate limits of Fruit Heights City, Utah; and WHEREAS, the City has determined that the property known as Parcel Number 11-120-0006 is part of an existing unincorporated property contiguous to Fruit Heights; and WHEREAS, this property is identified in the Fruit Heights City Annexation Policy Plan Expansion Area Map; and WHEREAS, on September 19, 2023, the Fruit Heights City Council Approved Ordinance #2023-002 B accepting Samuel G. Raymond Inc. petition for annexation; and WHEREAS, on January 4, 2022, the Fruit Heights City Council received the required Notice of Certification from the City Recorder certifying that the annexation petition meets the requirements of State law; and WHEREAS, the Fruit Heights City Council held a public hearing on the Samuel G. Raymond Inc. Annexation application on April 19, 2022 at 7:20 p.m.; and WHEREAS, the City Council determined in a public meeting on April 19, 2022, that in their judgment, this annexation meets the standards set forth in the Utah State Code,10-2-425, and the noticing requirements therein have been satisfied; and WHEREAS, the Fruit Heights City Council deems it to be in the best interest of the City and its citizens to annex the real property described herein to Fruit Heights City. NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF FRUIT HEIGHTS, UTAH: SECTION I: Repealer. If any provisions of the City's Code heretofore adopted are inconsistent herewith they are hereby repealed SECTION II: Enactment. That the following described real property is hereby annexed to Fruit Heights City, and the corporate limits of the City are hereby extended to include said real property: ALL OF PARCEL 11-120-0006 BEING A PART OF THE SE QUARTER OF SECTION 36, TOWNSHIP 4 NORTH, RANGE 1 WEST, SALT LAKE BASE AND MERIDIAN, U.S. SURVEY, DESCRIBED AS FOLLOWS: BEGINNING AT A POINT ON THE EXISTING FRUIT HEIGHTS CITY BOUNDARY AND THE WESTERLY LINE OF THE SAMUEL G. PROPERTY, WHICH POINT LIES N89̊ 58'50"E ALONG THE SECTION LINE 1175.38 FEET FROM THE SOUTH 1 / 4 CORNER OF SAID SECTION 36, THENCE ALONG SAID BOUNDARY LINE N24̊ 15’00”W 1436.99 FEET TO THE 1/16TH SECTION LINE; THENCE ALONG SAID 1/16TH SECTION LINE S89̊ 50’05”E 715.94 FEET TO THE SE 1/16TH CORNER OF SECTION 36; THENCE S00̊ 03’03”W 1308.08 FEET ALONG THE 1/16TH SECTION LINE TO THE SOUTH LINE OF SECTION 36; THENCE ALONG SAID SECTION LINE S89̊ 58’50 ‘W 124.58 FEET TO THE POINT OF BEGINNING. CONTAINING 549,875 SQUARE FEET OR 12.623 ACRES SECTION III: Zoning. Upon annexation, this property is assigned the R-1-12 land use zoning district as shown on the attached map. SECTION IV: Recordation. That the City Recorder is directed to file a certified copy of the plat of said real property and a certified copy of this ordinance of annexation with the Davis County Recorder. SECTION V: Severability. If any section, subsection, sentence, clause or phrase of this ordinance is declared invalid or unconstitutional by a court of competent jurisdiction, said portion shall be severed and such declaration shall not affect the validity of the remainder of the said ordinance. SECTION VI: Effective date. This ordinance shall go into effect at the expiration of the 20th day after publication or posting or the 30th day after final passage as noted below or whichever of said days is more remote from the date of passage thereof and thereupon the annexation of this property shall be deemed complete and the said territory herein described shall be deemed and held to be a part of this City, and the inhabitants thereof shall thereafter enjoy the privileges of and be subject to the Ordinances and Regulations and taxing powers of Fruit Heights City.
