MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road March 19, 2024 WELCOME: Mayor John Pohlman called the meeting to order at 7:00 pm. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Council Member Mark Cottrell, with Mayor John Pohlman conducting the opening ceremony by offering a word of prayer. COUNCIL MEMBERS PRESENT: Mayor John Pohlman, Council Members Gary Anderson, Florence Sadler, Eileen Moss, Council Member George Ray, Council Member Mark Cottrell. CITY STAFF PRESENT: City Manager Darren Frandsen, Deputy Recorder Hailee Ballingham, Public Works Director Layne Leonard, City Planner Jeff Oyler. VISITORS: Robert Christiansen, Shannon Christiansen, Bob Fowler, Ben Wellman, Paula Stephenson, Linda Crismer, Jim Crismer, Cynthia Denkers, Jim Frazier, Celeste Cottrell. CITY COUNCIL TRAINING: Council Member George Ray provided training to the Council on public safety and what's required at the municipal level. Police officer classifications the following officer may exercise police officer authority only as specified or authorized by law. There are four categories law enforcement officers, correctional officers, special function officers, and federal officers for our meeting and our municipal level, Law enforcement officers (are the ones that make the most sense to us). The definition of a law enforcement officer is the law enforcement officer, the sworn and certified police officer, who is an employee of a law enforcement agency and whose primary and principal duties consist of the prevention and detection of crime and the enforcement of criminal statutes or ordinances of this state or any of its political Subdivisions. First and second-class cities are required to have police services. PUBLIC COMMENTS: A request to speak was made by Cynthia Denkers. She and her husband requested a variance or exception for an up and down rental (ADU) in Fruit Heights, Utah, as they were going on a mission and would not be occupying the dwelling themselves. She expressed concerns about the poor maintenance of homes in Fruit Heights, whether they are rented or owned, and the lack of action taken by the city to address these issues. She stated that having on-site management companies is preferable as they are more likely to ensure proper maintenance of the property. Cynthia mentioned a previous negative experience of having someone live in their house while they were on a mission, resulting in significant financial loss. This has influenced their desire to have on-site management of their property while they are away. Cynthia criticized the mayor's reasoning behind the ordinance, which is to preserve the integrity of Fruit Heights and prevent it from becoming low-income housing. She questioned the mayor's support for high-density housing, such as condos, which she believes would have a greater impact on the integrity of the city, particularly the north end with its rural feel. SPECIAL PRESENTATIONS: Davis County Sheriff reported on Quarter 4 of 2023 and Quarter 1 of 2024 CITY BUSINESS: 5.1 Appoint Darren Frandsen as Fruit Heights City Manager Council Member Eileen Moss made a motion to Extend an offer of employment to Darren Franzen to be the  next city manager. Council Member Mark Cottrell second the motion. The Council Members unanimously approved the motion. (22:58) 5.2 Fruit Heights Veterans Memorial Project. On this committee and submitted this project: June Frazier, Paula and Chuck Stephenson, Linda and Jim Krismer, Ben Wellman, and Bob and Shannon Christiansen. The need for a Veterans Memorial: Bob Christensen and Jim Frazier presented the committee’s findings that emphasizes the importance of honoring and remembering those who have served and paid the ultimate price for their country. It highlights the significance of connecting the past, present, and future generations through a monument. Existing memorials in surrounding cities. It was mentioned that neighboring cities already have memorials, indicating that Fruit Heights should also have one. They specifically mention the Centerville and Farmington memorials as examples. Proposal for the memorial: Bob and Jim present a proposal for the memorial, which includes two types of rocks. The center monument would feature the seals of the six services, along with a symbol for MIAs and POWs, and the slogan "past, present, and future." The name monument would list the names of Fruit Heights residents who have served in the military. Cost and funding: they provide cost estimates for the memorial. The central rock is priced at $3,300, while each rock with names would cost approximately $2,800. that engraved names would cost around $300 to 400 each time they come. They suggested asking people who want to have a family member's name listed to contribute $100. As a committee that volunteered to help with this project, they have already pledged to donate $6,000. The proposed location suggests placing the memorial between two flagpoles in front of Fruit Heights City Hall. This location is described as a place where families, students, and the community can gather to learn about and celebrate veterans. Council Member Cottrell stated the front of the building is going to be revamped during the summer, Council Member Anderson asked how durable the memorial will be. Bob told him the rocks are made of sandstone, which is remarkably hard and durable. They can withstand impact from a skateboard without being damaged. Council Member Cottrell talked about the engravings of names on the rocks which will cost $300 to $400, regardless of the number of names. Residents will be charged $100, and efforts will be made to reach out to veterans who were long-time residents of the city. Council Member Mark Cottrell made a motion to approve the Fruit Heights City Veterans Memorial, as has been explained here this evening. Council Member Eileen Moss Second the motion. The Council Members unanimously approved the motion (43:30) 5.3 Amendment to Law Enforcement Services Agreement, was tabled. 5.4 Award bid for the 1800 East improvements project: Darren and Layne, and the staff has work hard on the 1800 East Improvement Project over the last year. The staff and city engineer recommend awarding Staker Parson the project for the 1800 East Waterline extension. From 1800 E to View Court and the road extension from 1800 East and tie into Farmington’s Belle Court. Staker Parson was the low bid at just under $1.5 million. which was under the engineer's estimate. A million dollars of this is paid by a grant that we received about a year and a half ago. Staker Parson would like to start April 1st. 2024. Council Member Moss asked if we have this money in the budget right now? Are we going to have to ask for that money in our next budget year? City Manager Darren Frandsen stated last month the budget was amended, that was part of this grant where we had to show the state that we have the money to match that grant. Council Member Eileen Moss made a motion to approve the 1800 East Improvement Project and award the bid to Shaker Parsons Companies for a total bid of $1,460,000. Council Member Mark Cottrell seconded the motion. The Council Members unanimously approved the motion. (46:43) 5.5 Resolution 2024-007 Interlocal Agreement between Fruit Heights City and Farmington City for the 1800 East Improvements Project. Mayor John Pohlman says there is a portion of this project that is in Farmington for their road to be completed up on Bella Vista. We have met with Farmington to talk about the project. This has been their general plan since 1993 to tie that into 1800 East. Their council is 100% in support of this, along with the fire chief. He likes the idea for safety and fire. Law enforcement is also excited about this connection going through. This is the resolution, saying we agree that we will work with Farmington, and they'll pay their portion of this project. Council Member George Ray made a motion to approve Resolution 2024-007 Interlocal Agreement between Fruit Heights City and Farmington City for the 1800 East Improvement Project. Council Member Florence Sadler Seconded the motion. The Council Members unanimously approved the motion. (51:53) TABLED ITEMS: 6.1 Municipal Code Title 11A Update for new state legislation requirements. Mayor John Pohlman said this will remain tabled for this time; I don’t have anything to report on it yet. I have made many calls down to the legislature. I have not heard back. REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETINGS: City Council Meeting Minutes for February 20, 2024 Council Member Florence Sadler made a motion to approve the minutes for February 20, 2024, City Council Meeting Council Member Gary Anderson Seconded the motion. The Council Members unanimously approved the motion. (55:15) COUNCIL REPORT: Council Member Gary Anderson talked about the mosquito abatement meeting, they talked about getting a vehicle and a new trailer. That talked about a drone that can go out and spray certain parts of land they don't have easy access to. They had to get permission from the FAA to fly in those places. They're also working on giving their employees benefits. Council Member Florence Sadler: I Attended the banquet with the YCC (Youth City Council); they attended a Conference in Logan with 19 youth. They had a good time and learned valuable things. We appreciated Jeanne Groberg for getting the funding needed. She was able to round up some extra money and so that she could take all 19 youth. We also appreciate the Jacksons who supervised this conference. Council Member Eileen Moss told the council that on Monday the 25th the members of the emergency preparedness committee would be meeting at City Hall to give out packets (Family Preparedness Handbook) to new move ins or who have missed placed it. The Shakeout is coming up, it will be April 18. She has spoken with a couple of people about putting together a Traffic Committee. We have some ideas in the General Plan for traffic calming and it would be nice to have a plan on how to progress. Council Member Mark Cottrell reported on The Veterans Wall committee did a great job. The Farmington Fire Department will provide updates on service calls and concerns to the city council. The Sheriff Department has increased their visibility and involvement in the city, and they are willing to participate in city activities and provide traffic control during big events. The city staff is organizing Founders Day, which will take place on Saturday August 24, 2024 They are securing food trucks, permits, first responders, and planning games and activities. Spring cleanup is scheduled from April 5th to the 22nd, and residents will receive free vouchers for dumping green waste. They are encouraged to report the number of hours they spent cleaning up trees and other debris. so can put that onto our report for Wildfire mitigation. MAYOR REPORT: Mayor John Pohlman told Council that Wasatch Integrated Waste will be coming to the 1st City Council meeting in May to do a presentation on the recycling program. The Mayor and City Manager have been working on getting bids, so the city knows what the starting point will be. The CTC (community that care) committee will also be doing a presentation sometime in May. The mayor also asked the city council to support a single employee taking up most of the training budget for employees to further their education, including obtaining a bachelor's degree online. The allocated budget for employee education would be used for the employee pursuing the degree, but other employees would still be trained in rural water training, CDL and Stormwater. The city has previously asked employees to pursue education and allocated education budgets, but it hasn't been a common practice. There would be an expectation for the employee to stay employed with the city for a certain period, but there wouldn't be a written contractual agreement. STAFF REPORT: City Planner Jeff Oyler reported he has been reading the bills that were passed by this year’s legislature and did not see anything that would give the city any relief on the subdivision ordinance. He will provide a comprehensive review at one of the next City Council meetings. Public Works Director Layne Leonard reported he has been working on the budget. The public works team has been repairing a few leaks on the spring line that fills the irrigation tank and have been changing out water meters. City Manager Darren Frandsen reported the city has received $126,000 from the CDBG grant. This money is to fix the porch. Staff has been working hard on the budget and putting the numbers together. They will have the numbers to the city council in April. ADJORNMENT: Council member Eileen Moss made a motion to adjourn the meeting with council member Gary Anderson seconding the motion.
