MINUTES CITY COUNCIL MEETING FRUIT HEIGHTS CITY 910 South Mountain Road January 7, 2025 WELCOME: Mayor Pohlman called the meeting to order at 7:00 pm. PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Mayor Pohlman with Council Member Moss conducting the opening ceremony by prayer. COUNCIL MEMBERS PRESENT: Mayor John Pohlman, Council Members Gary Anderson, Mark Cottrell, Eileen Moss, and Florence Sadler. CITY STAFF PRESENT: City Manager Darren Frandsen, Public Works Director, Layne Leonard, City Planner Jeff Oyler and Deputy Recorder Hailee Ballingham. Attorney Brad Christopherson. VISITORS: Bob Fowler, Celeste Cottrell, Anne Quintes Bose, Shauna Lloyd, Jeff Dimond, Charlee Barnes, R. Shon Stevenson, Jeff Lund, Saria Ott, Blake Winslow, Nathan Rich, Jeff Call, Nancy McPherson, Lane Monson and Mary Monson. DECLARATION OF CONFILICT(S) OF INTEREST: None CITY COUNCIL TRAINING: None PRESENTATIONS: 4.1 YCC Report: Oliver, Kate, and Landon gave the YCC report. They talked about Christmas in our Community. The YCC helped with cookies and ran the food drive. They took about 600 pounds of food to the Bountiful Food Pantry. They also had a Christmas party with the Kaysville YCC. They are preparing to do their annual Day on the Hill where they learn about government processes and procedures. 4.2 Annual Training: Open and Public Meetings and Ethics Act. This training was given to the council by city attorney Christopherson. The power point is attached to the agenda packet. PUBLIC COMMENT: None DISCUSSION ITEMS: 5.1 Public Hearing for Resolution 2025-01 Update Fruit Heights City Culinary Water Rates In 2023, Fruit Heights hired Zions Bank and Jones & Associates for a water impact fee and rate study. In January 2024, the City Council approved the impact fee and first-year water rate schedules. The council plans to review each year's rates independently. The city is currently on track with revenue from water billings. Due to a 9. 5% increase in water costs from Weber Basin, the city will need to raise base fees and rates. A new rate structure for areas without secondary water for irrigation is also needed. Staff recommend changes based on the study and current revenue. Council Member Eileen Moss made a motion to open the Public Hearing for Resolution 2025-01 Update Fruit Heights City Culinary Water Rates. Council Member Gary Anderson seconded the motion, and it was unanimously approved by the council (0:10) No Public comments Council Member Florence Sadler made a motion to close the Public Hearing for Resolution 2025-01 Update Fruit Heights City Culinary Water Rates. Council Member Eileen Moss seconded the motion, and it was unanimously approved by the council (0:11) 5.2 Public Hearing for Resolution 2025-02 Update Fruit Heights Consolidated Fee Schedule. Directed by the City Council, the staff was asked to continue to keep the Consolidated Fee Schedule (CFS) current. The current updates to the CFS include the storm drain fees, SWPPP, management of the SD program, water rates, including when culinary water is used for irrigation, and updates to the building permit section. The staff is also in the process of organizing the layout of the CFS to be more user-friendly. Council Member Moss talked about the Alcoholic Beverages License, Agriculture Vendors License, Christmas Tree Sales License, Fireworks Sales License, Itinerant or Transient Merchants License, Mechanical and Electronic Amusement Device License, Pawnbrokers License, and Sexually Oriented Businesses License. They have not been updated in years, and she feels the council should look at increasing these fees. Council Member Eilleen Moss made a motion to open Public Hearing for Resolution 2025-02 Update Fruit Heights Consolidated Fee Schedule. Council Member Gary Anderson seconded the motion, and it was unanimously approved by the council (0:15) No public Comments Council Member Eileen Moss made a motion to close the Public Hearing for Resolution 2025-02 Update Fruit Heights Consolidated Fee Schedule. Council Member Mark Cottrell seconded the motion, and it was unanimously approved by the council (0:15) 5.3 Recycling Program The staff has been putting together costs for a recycling program. Hauling, administrative and toter costs: $56.25 per toter plus shipping charges. 2000 toters at $56.25 = $112,500.00. Shipping $9,679.19. Total $122,179.19. We could get a discount of $30,000.00 ($15 per toter) paid back from Integrated Waste if we bundle and own the toters. Cost to start the program would be $92,179.19. The first toter is no cost to residents, that’s part of the start-up of the program. Any additional toters would be $95.00 apiece. The price for recycling hauling is $4.00 per can this includes an admin fee. If the council would like to bundle the program the cost to a resident would go from $15.50 to $19.50 per month for a single regular garbage toter and a single recycling toter. ACTION ITEMS: 6.1 Approve/Deny Resolution 2025-01 Update Fruit Heights City Culinary Water Rates. Council Member Anderson wanted to clarify that the council is only passing the water rates for the year 2025. The mayor stated they will pass the water rates on a yearly basis, instead of approving for the next 5 years at one time. This way they can stay on top of it and not under or over charge for water. Council Member Eileen Moss made a motion to approve the Resolution 2025-01 Update Fruit Heights City Culinary Water Rates. Council Member Mark Cottrell seconded the motion. The motion was unanimously approved by the council (0:54). 6.2 Approve/Deny Resolution 2025-02 Update Fruit Heights Consolidated Fee Schedule. Council Member Moss knows the consolidated fee schedule has not been updated in many years and strongly feels there should be a 50% increase to the fees associated with the licenses in question. These licenses are more like vendors that come into the city for a short period of time. Council Member Sadler asked about the fence permit and if it was for an existing fence that might need to be repaired. City Manager Frandsen told her that permit is only for new fences. She asked if we could add that to the consolidated fee schedule to have it say New Fence Permit. Council Member Eileen Moss made a motion to approve the Consolidated Fee Schedule with the 50% increases to Alcoholic Beverages License, Agriculture Vendors License, Christmas Tree Sales License, Fireworks Sales License, Itinerant or Transient Merchants License, Mechanical and Electronic Amusement Device License, Pawnbrokers License, and Sexually Oriented Businesses License. Also to add to the New Fence Permit. Council Member Mark Cottrell seconded the motion. The motion was unanimously approved by the council. (0:58) 6.3 Approve November 15, 2024, City Council Minutes. The motion was unanimously approved by the council (0:59) TABLED ITEMS: None CALENDAR: 8.1 January 20, City office will be closed in observance of Martin Luther King Jr. Day 8.2 January 21, City Council Meeting 8.3 January 28, Planning Commission Meeting 8.4 January 29, Special Meeting PAST DISCUSSION ITEMS: Election Process. The staff has been working on getting a survey put together. They have sent It to the council to review and get their feedback before sending it out to the residents. CITY COUNCIL REPORTS: Council Member Cottrell: Recap of the year and the things he worked on: Community service. The city submitted 11 projects and 4 of them got done. He worked with wildfire prevention to meet all the requirements for the city. He worked on the staff for Founders’ Day. He has continued to meet with Farmington Fire and Davis County staff. He also helped with the Veterans Memorial Committee. They were able to get this wonderful memorial in our city. Council Member Moss. The Cemetery Committee is continuing to meet to look over pricing of the cemetery. The committee will be working with Curtis Tanner to investigate different landscaping options. Council Member Sadler: Christmas in our Community was a great event and thank you to the YCC for all their work. MAYOR REPORT: The mayor sent out the City Council assignments for the year. The Strategic Planning Meeting will be held in March. There is no date yet. It will be a scheduled 2-hour meeting to go over their assignments and how they can best fulfill their responsibilities for this year. On January 29, they are having the Special Meeting to fill the vacant city council seat. The mayor asked the Council to familiarize themselves with the process. CITY STAFF REPORTS: Planner Oyler: Moderate income housing report was extended by the state. There is nothing more we can do with our city being built out. Public Works Director Leonard: R&R is finishing up the first booster pump. This should be done on January 20. There is a snowplow down and the team is working on getting it back up. They are still waiting for their new truck. City Manager Frandsen: He is working on the budget. He told the council if there is any concern or if they have questions on the budget, please bring it to his attention now so they can work through the questions. CLOSED SESSION: Council Member Anderson made a motion to move into a closed session. Council Member Mark Cottrell seconded the motion. The motion was unanimously approved by the council (8:12). Council Member Gary Anderson made a motion to move out of a closed session. Council Member Eileen Moss seconded the motion. The motion was unanimously approved by the council (8:49).
