MINUTES FRUIT HEIGHTS CITY PLANNING COMMISSION MEETING 910 South Mountain Road September 24, 2013 REGULAR MEETING The regular meeting of the Fruit Heights City Planning Commission was called to order at 7:00 PM by Chairman Susan Hunt. The Pledge of Allegiance was recited and Kristi Bybee gave a prayer for the opening ceremony. PLANNING COMMISSIONERS PRESENT: Commissioners Sam Brady, Kristi Bybee and Paul Wood and Chairman Susan Hunt and City Council Member Craig Hill. Commissioner Curtis Tanner was excused. STAFF PRESENT: City Manager Brandon Green and City Planner Jeff Oyler. Recording Secretary Susan Cranford was excused. VISITORS: Barbara R. Spendlove, E. Edward Spendlove, Kristi Stringham, Ashley Flint, Wade Flint Agenda Item: 1. APPROVAL OF MINUTES OF MEETING: July 30, 2013 Commissioner Sam Brady made a motion to approve the minutes of July 30, 2013. The motion was seconded by Commissioner Kristi Bybee and it passed unanimously by those in attendance. 2. ITEMS FROM THE PUBLIC There were no items from the public presented. 3. NEW BUSINESS 02:37 Discussion – Gene Raymond Property and Development Proposals City Planner Jeff Oyler stated Gene Raymond would like to sell his home on Mountain Road with approximately two acres behind it for development. Three different proposals are being considered for the property. The property is zoned A-1 (agriculture) with a minimum one-acre lot size. The General Plan shows the property on the east side of Mountain Road being residential with 12,000 square foot lots. One proposal is to rezone the property to R-1-8 with an 89.5 foot frontage. This proposal would leave the existing home and put a road in making a flag lot to the back 1 Fruit Heights Planning Commission Meeting September 24, 2013 of the property with another house in the back. That would require rezoning the property to R-1-8. A second proposal is to tear down the existing home and build a 30-foot wide road to the back of the property, creating two lots. The third proposal would be to tear down the existing home, build a road and fit three lots on the property. This proposal would not have a flag lot unless it becomes a PRUD (Planned Residential Unit Development). The challenge to developing the property is the geo technical analysis. There is a major fault line along the base of the hillside and there may be a secondary fault. The city recommends setbacks to mitigate the fault line. There are also active landslides identified on the hillside. The city will require the topography on the site plan. The developer needs to identify the fault lines and the landslide area. The property owner can then identify how much buildable area there is on the two acres. City Planner Oyler stated that if the developer puts in a PRUD, the city requires 40% open space. A PRUD would be required to get more than two homes on a flag lot. Chairman Susan Hunt stated she hesitates on rezoning the property to R-1-8. She commented that if the Planning Commission decides to change the General Plan, she does not think it should be for a higher density in that neighborhood. Commissioner Paul Wood stated the Planning Commission should look at the long term conformity of the neighborhood. He asserted that pocket clusters of zoning take away from the long term goals the city has defined. Chairman Hunt summarized that the Planning Commission is open to ideas and wants to help people but has some concerns with the R-1-8 zoning on the property. She stated that the other options are consistent with the General Plan. 4. REPORTS 50:09 A. City Planner – Jeff Oyler City Planner Jeff Oyler reported that the city is working on annexation of the Hinckley property that was deeded to the city and two small pieces in the southern portion of Fruit Heights. There is also a small island in the northern part of the city on the west side of Highway 89 that should be annexed at some point but that piece may take some time to resolve and will be considered at a later time. 2 Fruit Heights Planning Commission Meeting September 24, 2013 B. City Council Representative – Craig Hill No report was made. 5. ADJOURNMENT Commissioner Sam Brady made a motion to adjourn, seconded by Commissioner Kristi Bybee. The meeting adjourned at 7:57 PM.
