PLANNING COMMISSION MEETING
FRUIT HEIGHTS CITY

November 29, 2022
WELCOME: Chairman Curtis Tanner called the meeting to order at 7:00 PM.
PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Commissioner
Carrie Carrol, and the meeting was opened with Chairman Curtis Tanner offering a word of
prayer.
PLANNING COMMISSION MEMBERS PRESENT: Planning Commissioners Carrie
Carroll and Curtis Tanner (Chairman), and Kevin Paulsen were present. Planning Commissioner
Brian Bare arrived late. Commissioner City Council Member Diane Anderson were excused.
CITY STAFF PRESENT: City Manager Brandon Green, City Planner Jeff Oyler, City
Engineer Brandon Jones, Hailee Ballingham, and City Recording Secretary Amy Gardiner were
present.

ORDINANCE REVIEW:
Review/Discuss/Approve/Deny amendments to the Baer Canyon Estates subdivision.
City Manager Brandon Green explained that the property owner of lot 18 has purchased property
of the lot north of them, lot 16. Purchased a 12-foot-wide strip to add to lot 17 on the plat. This
requires amendment to the subdivision of the plat. The purpose of the purchase is to add more
property for future use. City staff has reviewed this and has no reason to deny this change. All
properties still meet the subdivision requirements. It is recommended that this motion is
approved.
After discussion, Commissioner Carrie Carrol makes the motion to approve Baer Canyon
Estates Phase 3 the addition of 12 feet to lot 17 from lot 16. This motion was seconded by Kevin
Paulsen, and it was approved unanimously.
Review/Discuss/Approve/Deny Animal Care Control Ordinance
Davis county will take over the entire animal control services, so the cities don’t have to make
agreements with Davis County Animal Control. Until this happens, the proposal is to adopt the
changes that all cities are making so that they are using the same ordinances. For Fruit Heights,
this change will include allowing ownership of three dogs and/or cats in any combination
without requiring a special permit. This helps enforce the ordinance across the county making it
easier for Davis County Animal Control to enforce across the varying cities. It is recommended
that this is approved.
After discussion, the commissioners agree that this will be a good change to be made to the
community. The commissioners believe that they will approve this in the future.
OTHER BUSINESS:
Mountain Road is to be paved on November 30, 2022. The weather permitting. They need at
least a temporary patch so that the road does not remain a dirt road for the entire winter.
Approval or preliminary subdivision plat for the Barker property to be seen in the new year. As
well as phase two of Rock Loft Ridge Estates.
Public Open House for residents to come in and view the updates and changes to the general
plan. This will then be sent for approval sometime in January or February.

• Next planning Commission Meeting is scheduled for January 24, 2023
Commissioner Curtis Tanner made a motion to adjourn the Planning Commission meeting, and it
was seconded by Commissioner Carrie Carroll. The meeting was adjourned at 7:20 pm.

Section 6.12.060 Number Of Dogs And Cats Per Residence
No person or persons at any one (1) residence within the jurisdiction of this title shall at any one
(1) time own, harbor, license, or maintain more than three (3) cats and dogs in any combination.
A person may only own, harbor, license, or maintain three (3) dogs if one of the dogs has been
acquired from a legitimate animal shelter, as the term "animal shelter" is defined in the Utah
Animal Welfare Act. The Animal Control Division may issue a permit to owners of Dogs and
Cats to keep up to four Dogs or Cats (but not more than four Household Pets) in a residential
area.
Section X Exemptions for number of dogs and cats per residence:
The provisions of Section 6.12.060 shall not apply to the following: Formatted: Font: (Default) Arial, Font color: Black
a. Under the provisions of Section 10-8-65, Utah Code Annotated, a person may keep

a service animal, a retired service animal, or both in addition to that limit. See
