PLANNING COMMISSION MEETING
FRUIT HEIGHTS CITY

WELCOME: Chairman Kiven Paulsen called the meeting to order at 7:02 pm.
PLEDGE & OPENING CEREMONY: The Pledge of Allegiance was led by Chairman Kevin
Paulsen Justin Wright offering a word of prayer.
PLANNING COMMISSION MEMBERS PRESENT: Chairman Kevin Paulsen, Commission
Members, Brian Bare, Clark Moss, and Justin Wright. Commissioner Heidi Murdock and Council
Member Gary Anderson was Absent.
CITY STAFF PRESENT: City Manager Darren Frandsen, City Planner Jeff Oyler, Deputy
Recorder Hailee Ballingham.
VISITORS: Dale Kunkel, Susan Darger
PUBLIC COMMENTS:
Dale Kunkel from his point of view the swimming pool ordinance would be appropriate to have an
eight-foot form property line which is in line with other cities around Fruit Heights. Then he talked
about Municipal Code Title 10 R-1-6 He made comments to remind this body that this body
specifically requested a transitional zone, and based on the requests for that type of traditional
zone for a more affordable zone, not necessarily the needs to any certain criteria that would be
more affordable, I believe our city planner has helped come up with something that meets that.
He is in favor of the R-1-6. As far as the chicken ordinance goes, he would like to see language
in the ordinance that reflects the sale of eggs for non-producers, we simply could refer to the state
code. Then he thanked the Planning Commission for their service.
Susan Darger: She wanted to talk about the R-1-6 Zone. She would like to see more input from
the public by having more in-depth meetings. She wants to make sure that everything is covered.
REVIEW AND APPROVAL OF MINUTES FROM PREVIOUS MEETINGS: None.
PRESENTATION: None.
PLANNING COMMISSION BUSINESS:
There was a public hearing on the Conditional Use Permit, Municipal Code Title 10 Swimming
Pool Ordinance, Update Public Work Standards, and Municipal Code Title 10 New Zone R-1-6
on April 30, 2024, the Planning Commission could not vote due to not having a quorum. They had
to hold a special meeting to be able to vote on all 4 of these business items.
5.1 Conditional Use Permit
The Planning Commission had a discussion on the conditional use permit, they felt like it was a
good thing for the city to have a redundant water facility, it’s not going to cause issue, it’s only
beneficial. They liked the landscaping design. They noted that this facility will be locked and have
a gate unless someone is servicing it then no one will be on the premises.
Commission Brian Bare motion to approve the Conditional Use Permit Commissioner Justin
Wright seconded the motion. The motion was unanimously approved by the commission (0:10)
5.2 Update Municipal Code Title 10 Swimming Pool Ordinance
This Ordinance came to the Planning Commission in October of 2022, they proposed as 5-feet
then the city Council brought it up to ten. Now we have a request to bring it to 8-feet.
Commissioner Clark Moss motion to approve Municipal Code Title 10 Swimming Pool Ordinance
Commissioner Justin Wrights seconded the motion. The motion was unanimously approved by
the Commission (0:12)
5.3 Municipal Code Title 10 New Zone R-1-6
The Staff was instructed by the City Council to create the R-1-6 zone. This zone allows for single
family homes on 6000 square foot lots. It also permits the construction of multi-family dwellings
with a maximum of four units attached to each other or with common walls. There were a number
of comments at the public hearing about whether the city should identify areas in the city where
this zone could be used. Staff agree with the idea, but it will take a while to modify the general
plan and there will have to be a significant amount of discussion to get to a resolution. Chairman
Paulsen again pointed out this zone being a transitional zone would be best located near a
commercial or an R-3 zone.
Commission Brian Bare motion to approve the Title 10 Zone R-1-6 Permit Commissioner Justin
Wright seconded the motion. The motion was unanimously approved by the commission (0:33)
5.4 periodical update Public Work Standards (the last update was in 2018)
Jones and Associates made changes to the public works standards, considering state laws,
federal requirements, their experience with other cities. These updates include AWAs standards
for public works and asphalt mixes, including recycled asphalt. New standards for accessible
ramps and stormwater management were also added. Although there were many changes, some
aspects remained consistent, such as the thickness of asphalt and concrete.
Commissioner Justin Wright motion to approve the update to Public Work Standards
Commissioner Clark Moss seconded the motion. The motion was unanimously approved by the
commission (0:38)
5.5 Municipal Code Title 7A Chicken Ordinance
The Commission had a discussion on the Chicken Ordinance about the pros and cons. There
was some confusion about the comments made in the document for the city council. Chairman
Paulsen thought it would be a good idea to continue working on this ordinance and bring it back
to the Planning Commission.

seconded the motion. The motion was unanimously approved by the Planning Commission and

10-11-13: PRIVATE SWIMMING POOLS: No such pool shall be allowed in any zone
except as an accessory use and unless it complies with the following conditions and
requirements:
A. It is an accessory use to a main building and is located within the side or rear yard
thereof.
B. It may not be closer than ten 10 eight (8’) feet to any interior property line of the
property on which it is located.
C. It shall not be less than twenty feet (20') from any neighbor's dwelling.
D. It shall be no closer than seven (7’) feet from the top of a slope, unless designed to
support the water in the pool without soil support.
E. The swimming pool, or the entire property on which it is located, shall be walled, or
fenced to a minimum height of six feet (6'). Where a swimming pool is located less
than thirty feet (30') from any property line, the pool shall be enclosed with a wall or
fence not less than six feet (6') in height. All gates on said fences shall be fitted with
a self-closing and latching device located on the interior side of the gate.
F. If the pool is equipped with a Pool Safety Cover as specified in ASTM standard F
1346-91 and when installed and maintained properly and in accordance with the
installation instructions, a 6’ high fence may be eliminated on the side(s) and rear
yards
G. Landscaping in the yard where the pool is constructed shall be designed and
maintained in such a manner as to ensure that all drainage shall be collected and
conveyed to the public way without draining onto adjacent neighbors.
H. Where a swimming pool is completely enclosed in a building, the location
requirements for accessory and main buildings shall apply. Where a swimming pool
is to be located in the near vicinity of any septic tank or sewage disposal drain field,
the location must be approved beforehand in writing by the Davis County health
department.
I. Any pool lighting shall be installed and directed in such a manner as to not cause
disturbance to neighboring residents

10-8F-1: PURPOSE: The R-1-6 residential zone is intended to provide for small lot, higher
density, single family, and multi-family residential development. This zone aims to promote
more affordable housing options.
10-8F-2: PERMITTED USES:
Single-family dwellings.
Multi-family dwellings.
10-8F-3: CONDITIONAL USES:
Home occupations.
Public and quasi-public uses.
Residential facilities for the disabled.
10-8F-4: AREA AND FRONTAGE REGULATIONS:
A. Lot Size: Single family dwelling.
1. Minimum lot size for a detached single-family dwelling shall be six thousand (6,000) square
feet.
B. Multi-family dwellings.
1. Up to 4 units may be attached with common wall construction.
2. The total number of units in a project area shall not exceed an overall dwelling density of 6
units per gross acre. Public streets and rights-of-way shall not be included in gross acreage.
B. Lot Width: Minimum lot width, as measured at the front setback line, shall be sixty feet (60').
Corner lot width shall be a minimum of eighty feet (80').
10-8F-5: YARD REGULATIONS:
A. Front Yard: Minimum front yard setback for all buildings shall be twenty feet (20').
B. Side Yard: Minimum side yard for all main buildings shall be eight feet (8').
C. Side Yard, Corner Lots: Minimum side yard for all buildings on corner lots shall be twenty
feet (20') on the side adjacent to a street.
D. Rear Yard: Minimum rear yard setback for all main buildings shall be twenty feet (20').
E. Accessory Buildings: The foundation of all accessory buildings shall be located at least six
feet (6') to the rear of any main building. No part of the building, including the eaves, may be
located closer than five feet (5') to the side and rear property lines. On corner lots, the minimum
side yard setback adjacent to the street shall be twenty feet (20'). No accessory building shall be
placed on a public utility easement without first obtaining written permission by the City.
10-8F-6: HEIGHT REGULATIONS: No building shall be erected to a height greater than
thirty feet (30').

7A-03-040. Chickens in Single-Family Residential Zones
(a) Purpose. The keeping and maintaning of residential backyard chickens is allowed within
R-1-12, R-1-10 single-family residential zones as provided in this Section. Nothwithstanding the
foregoing, this code section shall not in any way limit the rights of residents living in an A-1 or R-S-12

ranged within a fenced run or a fully fenced backyard sufficient for containment but shall always
be kept within the coop/cage, enclosed area, and/or fenced backyard.
(3) Chickens shall always have access to feed and water in an area that is protected
from rodents and other predators.
(d) Coop and Cage Standards. Coops/cages shall be constructed such that:
(1) It is freestanding.
(2) It is easily accessible for cleaning and maintenance.
(e) Location.
(1) Any coop/cage shall be located in the rear yard of the main dwelling and be
located at least twenty (20) feet from any primary residential dwelling on an adjoining property
and at least three (3) feet from any property line.
(2) Any time a heating device is used in a coop/cage, such coop/cage must be
separated at least ten (10) feet from any residential dwelling structure.
(f) Cleanliness. Any coops/cages, roaming area and all animals on the lot must be kept and
maintained in such a manner so as not to degrade (below a reasonable standard) the health, safety,
noise, odor, or sanitation environment of the chickens or of persons dwelling on neighboring or adjacent Commented [GR2]: When looking up how much space a

(3) If any property owner is still not compliant with this ordinance, the property
