FULLERTON CITY COUNCIL SUCCESSOR AGENCY AGENDA - AUGUST 18, 2020 303 West Commonwealth Avenue, Fullerton, California MEETINGS: The Fullerton City Council / Successor Agency meets on the first and third Tuesday of the month, convening for Closed Session at 5:00 p.m. and Regular Session at 6:30 p.m. PUBLIC COMMENT: The public may comment on Closed Session items at the beginning of the Closed Session meeting. The public may comment on matters not appearing on the agenda and Consent Calendar items during Public Comments at the Regular Session meeting. Prior to public comments, the public may request the removal of consent items for further discussion. Those wishing to speak on a regular business or a public hearing item on this agenda may do so when the Mayor calls that specific item for consideration. Each speaker addressing non-agenda and consent calendar items shall have three minutes to make their remarks. City Council will allow no more than a total of 30 minutes at the beginning of the Regular Session for non-agenda comments. Those speaking on regular business items and public hearing items shall have no more than three minutes per item to address City Council. No person shall speak more than one time to the same item. The Mayor may request that a spokesperson represent a group wishing to address City Council. The Mayor or majority of the Council may grant an extension of time for a speaker. BREA DAM VERIZON CELL TOWER EXTENSION Recommendation: Authorize City Manager, or designee, to execute Third Amendment to Ground License Lease Agreement by and between the City of Fullerton and Los Angeles SMSA Limited Partnership, dba Verizon Wireless for cell tower in Brea Dam Recreational Area, in a form approved by the City Attorney. 24. SAFE PARKING PROGRAM EXTENSION Recommendation: 1. Authorize City Manager, or designee, to execute Professional Services Agreement with Pathways of Hope, in a form approved by the City Attorney, and take all necessary actions to continue Safe Parking Program funded through CARES Act. 2. Authorize Staff to work with Supervisor Chaffee’s Office for funding and future expansion of program county-wide. 25. CATCH BASIN CONNECTOR PIPE SCREEN INSTALLATION PROJECT - FISCAL YEAR 2019-20 Recommendation: Appropriate an $82,782 Orange County Transportation Authority (OCTA) Measure M2 Environmental Cleanup Tier 1 Grant to Project 52694 Catch Basin Connector Pipe Screen Installation Project - Fiscal Year 2019-20. 28. RUNWAY SHOULDER ENHANCEMENT PROJECT - DESIGN SERVICES AWARD Recommendation: 1. Approve $65,000 budget transfer from Airport Enterprise Fund Balance to Project 49013 Runway Shoulder Enhancement Project. 2. Authorize Public Works Director to execute $182,867 purchase order with C&S Companies for Professional Engineering Design Services for Runway Shoulder Enhancement Project. 29. VICTORIA DRIVE INFRASTRUCTURE IMPROVEMENTS - PHASE I Recommendation: 1. Approve plans and specifications for Victoria Drive Infrastructure Improvements Project - Phase I. 2. PUBLIC HEARINGS - None REGULAR BUSINESS (Items 30 - 37) 30. COMMUNITY CHOICE AGGREGATION OVERVIEW At the July 21, 2020 City Council Meeting, Council Member Zahra requested Staff bring an update on Community Choice Energy to City Council in light of City of Irvine requesting partnerships from other Orange County cities. Additionally, the Infrastructure and Natural Resources Advisory Committee (INRAC) recommended to City Council that the City explore and review Community Choice Energy as a potential cost saving measure. This Agenda Report is an overview of Community Choice Energy and provides an update on what is occurring in Orange County specifically with the City of Irvine as it relates to Community Choice Energy. Recommendation: 1. Receive and file Agenda Report on Community Choice Energy. 2. Provide direction to Staff on any further action to take in regards to any potential partnership with the City of Irvine. 31. BUY IN FULLERTON VEHICLE INCENTIVE PROGRAM Consideration and implementation of a Buy in Fullerton Vehicle Incentive Program. Recommendation: Authorize Staff to implement Buy in Fullerton Vehicle Incentive Program in collaboration with Fullerton Car Dealers, Harley Davidson Motorcycle Dealership and Orange County Auto Dealers Association. 32. MONTHLY LEGISLATIVE UPDATE (CONTINUED FROM JULY 21, 2020) This item was continued from the July 21, 2020, City Council Meeting. Some of the bills recommended by the Legislative Subcommittee at their July meeting are no longer being considered and have thus been removed from the Recommended Action in this Agenda Report, their status is outlined in the narrative of the report. VARIOUS GRANT AWARDS FROM THE CORONAVIRUS AID, RELIEF AND ECONOMIC SECURITY ACT (CARES ACT) AND OTHER GRANTS AND PROPOSED SPENDING PLANS TO ADDRESS PUBLIC HEALTH CRISIS AND NATIONAL PANDEMIC COVID-19 Accept and appropriate various grant awards from the CARES Act Relief Fund and FEMA‘s California Public Assistance Program and establish a CARES Act-Other Grants proposed program-based spending plan to support the City’s emergency relief efforts to address and combat the public health crisis COVID-19. AGREEMENT WITH TRIPEPI SMITH FOR MEDIA AND BROADCASTING SERVICES The City broadcasts City Council and Planning Commission meetings on Channel 3 and Channel 99. The City has been utilizing MC Video for a number of years and their contract had expired. Thus, a Request for Proposal (RFP) was issued and a successful respondent was recommended for contract award during the May 19, 2020 City Council meeting. The City Council, moved by Mayor Pro Tem Flory and seconded by Council Member Silva, requested Staff to reissue the RFP. The RFP was issued and a successful respondent, Tripepi Smith, is recommended for contract award. Recommendation: Approve and authorize City Manager to execute three-year contract with Tripepi Smith for cablecasting services in an amount not to exceed $110,517. 36. FIRST CONSIDERATION OF PROPOSED SIDE LETTER TO MEMORANDUM OF AGREEMENT BETWEEN CITY OF FULLERTON AND FULLERTON MUNICIPAL EMPLOYEES FEDERATION REGARDING PAY FOR CANINE CARE Proposed Side Letter to Memorandum of Agreement (MOA) between City of Fullerton (City) and Fullerton Municipal Employees Federation (FMEF) regarding pay for canine care, presented for first consideration by City Council. Recommendation: 1. Review and consider proposed side letter. 2. Direct Staff to return for final review on September 15, 2020. 37.
