FULLERTON CITY COUNCIL SUCCESSOR AGENCY AGENDA - APRIL 4, 2023 303 West Commonwealth Avenue, Fullerton, California MEETINGS: The Fullerton City Council / Successor Agency meets on the first and third Tuesday of the month, convening for Closed Session at 5:00 p.m. and Regular Session at 6:30 p.m. PUBLIC COMMENT: The public may comment on Closed Session items at the beginning of the Closed Session meeting. The public may comment on matters not appearing on the agenda and Consent Calendar items during Public Comments at the Regular Session meeting. Prior to public comments, the public may request the removal of consent items for further discussion. Those wishing to speak on a regular business or a public hearing item on this agenda may do so when the Mayor calls that specific item for consideration. Each speaker addressing non-agenda and consent calendar items shall have three minutes to make their remarks. City Council will allow no more than a total of 30 minutes at the beginning of the Regular Session for non-agenda comments. Those speaking on regular business items and public hearing items shall have no more than three minutes per item to address City Council. No person shall speak more than one time to the same item. The Mayor may request that a spokesperson represent a group wishing to address City Council. The Mayor or majority of the Council may grant an extension of time for a speaker. No speaker may yield their time to another speaker. PERSONS ADDRESSING CITY COUNCIL: Please complete a speaker form and submit the form to the Assistant City Clerk in the lobby prior to approaching the podium. State your name and city of residence for the record at the beginning of your remarks. All speakers shall observe civility, decorum and good behavior. Any item submitted to the City Council during the meeting shall become public record and subject to applicable disclosure laws. The City Clerk’s Office posts the agenda packet online no later than 72 hours prior to the meeting at www.cityoffullerton.com. The City Clerk’s Office and Library have copies of the packet available for public review. In accordance with CA Government Code Section 54957.5, the public may inspect any writings or documents relating to an open session agenda item distributed less than 72 hours prior to a regular meeting at the City Clerk’s Office located at 303 West Commonwealth Avenue, Fullerton, California and the Fullerton Main Branch Library Information Counter located at 353 West Commonwealth Avenue, Fullerton, California during normal business hours. The City will post such writings and documents received in sufficient time on the City’s website at www.cityoffullerton.com. DUMP TRUCK REPLACEMENT PURCHASE Recommendation: Authorize Public Works Director, or designee, to issue $287,851.88 purchase order to PB Loader Corporation for a new Velocity Dump Truck. TRAFFIC SIGNAL VEHICLE DETECTION EQUIPMENT PURCHASE Recommendation: Authorize Director of Administrative Services, or designee, to award purchase order (s) not to exceed $200,000 for vehicle detection equipment from Iteris, Inc. PUBLIC HEARINGS (Item 8) Pursuant to California Government Code Section 65009, if you challenge a City Council / Successor Agency decision in court, you may be limited to raising only those issues you or someone else raised at the public hearing described in this notice or in written correspondence delivered to the City of Fullerton at, or prior to, the public hearing. 8. POINTE COMMON AFFORDABLE HOUSING PROJECT AT 1600 WEST COMMONWEALTH AVENUE The Planning Commission held a public hearing On March 15, 2023 regarding the proposed project. The Commission unanimously recommended City Council approve the project. The applicant has revised the project based on Planning Commission feedback. Recommendation: 1. Adopt the following resolutions: RESOLUTION NO. 2023-XXX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, ADOPTING A MITIGATED NEGATIVE DECLARATION, INCLUDING ANALYSIS OF THE POTENTIAL ENVIRONMENTAL EFFECTS OF THE PROJECT, PROJECT DESIGN FEATURES, STANDARD CONDITIONS, MITIGATION MEASURES AND THE MITIGATION MONITORING AND REPORTING PROGRAM FOR THE POINTE COMMON AFFORDABLE HOUSING DEVELOPMENT PROPOSED AT 1600 WEST COMMONWEALTH AVENUE RESOLUTION NO. 2023-XXX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING A MAJOR SITE PLAN FOR A 65-UNIT AFFORDABLE HOUSING DEVELOPMENT ON A 2.50-ACRE PROPERTY LOCATED AT 1600 WEST COMMONWEALTH AVENUE RESOLUTION NO. 2023-XXX - A RESOLUTION OF THE CITY COUNCIL OF THE CITY OF FULLERTON, CALIFORNIA, APPROVING A GENERAL PLAN REVISION TO CHANGE THE COMMUNITY DEVELOPMENT TYPE FROM INDUSTRIAL TO MEDIUM DENSITY RESIDENTIAL ON A 2.50-ACRE PARCEL OF LAND LOCATED AT 1600 WEST COMMONWEALTH AVENUE 2. Staff seeks City Council direction to produce and fund a Fourth of July event and the location and date of the event. Recommendation: 1. Direct staff to proceed with planning and production of the Fourth of July celebration at desired event location. 2. Approve one of the following location options for the event: Option A: A limited fireworks show in the Downtown Plaza on July 3, 2023 Option B: A drone light show at Amerige Stadium on July 4, 2023 Option C: Postpone event until 2024 Option D: Continue to work with California State University Fullerton to hold event at CSUF Recreational Fields. 3. Authorize $142,000 to $145,000 transfer and appropriation from the General Fund (Fund 10) to the Parks and Recreation operating budget (Fund 15) to produce the event. 10. TRANSPORTATION AND CIRCULATION COMMISSION DECISION TO DENY AN EARLY MORNING PARKING EXEMPTION ON BOTH SIDES OF WEST WHITING AVENUE BETWEEN FORD AVENUE AND HIGHLAND AVENUE APPEAL Consideration of an appeal of a Transportation and Circulation Commission decision to deny an early morning parking exemption on both sides of West Whiting Avenue between Ford Avenue and Highland Avenue. Recommendation: 1. Deny appeal and sustain the Transportation and Circulation Commission recommendation. OR 2. Concur with initial City Traffic Engineer recommendation to approve the petition and sustain appeal of the Transportation and Circulation Commission decision to deny an early morning parking exemption on both sides of West Whiting Avenue, between Ford Avenue and Highland Avenue. 11. ELECTRICITY COSTS AND RATES AND OPTIONS TO OPT DOWN OR WITHDRAW FROM THE ORANGE COUNTY POWER AUTHORITY JOINT POWERS AGREEMENT City Council directed staff on March 21, 2023 to agendize a discussion of comprehensive information from the Orange County Power Authority (OCPA), a comparative analysis of the City’s electricity costs and details regarding rates and options for the City OCPA subscription. Consider hiring a consultant to analyze the cost and process to withdraw from the Joint Powers Agreement with OCPA. 3. Consider the following options: a. Direct staff to maintain participation in OCPA’s 69% Renewable Smart Choice Plan for residential and business accounts.
