BOARD OF COMMISSIONERS – REGULAR MEETING
1. Call to Order – Mayor John W. Byrne
2. Invocation & Pledge of Allegiance –Commissioner Adcock provided the invocation and
Andre Amyradakis and James Holdaway of Cub Scout Pact #531 led the Pledge of Allegiance.
3. Approval of the minutes for the July 2, 2018 Regular Town Board meeting. –
Approved (5-0)
4. Presentations:
A. There were no presentations for the August 6, 2018 Town Board meeting.

5. Public Comments – Ms. Amanda Armitge of 1029 Lukestone Drive spoke in regards to a
drainage issue on her property. Engineering Director Tracy Stephenson stated that he would
schedule some time to meet with her regarding the matter.

PUBLIC HEARINGS
Zoning Map Amendment - SXCW Properties II, LLC - 1528 and 1532 N Main St -
REZ-2018-11
The purpose of this agenda item is to consider a requested zoning map amendment for
a total of 2.38 acres, located at 1528 and 1532 North Main St, from the Residential
Agricultural (RA) and General Commercial (GC) Zoning Districts to the General
Commercial Conditional Zoning District (GC-CZD). – Approved 5-0
7B. Zoning Map Amendment - Curry Engineering - 801 Old Honeycutt Road - REZ-
2018-07
The purpose of this agenda item is to consider a requested zoning map amendment for
a total of 1.89 acres, located at 801 Old Honeycutt Road, from the Residential
Agricultural (RA) Zoning District to the Research Light Industrial Conditional Zoning
District (RLI-CZD). The petitioner has also requested a Land Use Plan amendment to
Employment Village for the subject property. – Approved 5-0
7C. Abandonment of Public Right-of-Way – Resolution Ordering the Abandonment of
a Portion of Feather Ridge Drive – SC-2018-01
The purpose of this agenda item is to consider approval of a resolution ordering the
abandonment of a portion of public street right-of-way along Feather Ridge Drive,
approximately 133 linear feet, following an application submitted by Smith, Anderson,
Blount, Dorsett, Mitchell & Jerrigan LLP, on behalf of Duke Energy. – Approved 5-0

Agenda Item No. 8D: Budget Amendment – FY 18 Rollovers – BA-2019-04
allocating unexpended funds for ongoing projects from the FY
2017-2018 Budget to include continued branding effort (primarily
signs), basketball court resurfacing, Fuquay Mineral Spring Park
holiday lights and laser field grading. The amendment appropriates
a total of $162,200.

Agenda Item No. 8H: Endorsement of Town Legislative and Regulatory Goals –
NCLM – Advocacy Goals A list of 6 goals were recommended for
submittal. This item was removed from the consent agenda and
later approved to submit all item (with exception of item #2)
Approved by a vote of 3-2.
Agenda Item No. 8I: Utility Allocation - Purfoy South – Phases 1-5 allocating
73,200 gpd sewer and 117,120 gpd water.
Agenda Item No. 8J: Memorandum of Agreement – Sediment and Erosion Control
Program between the Town and the North Carolina Sedimentation
Control Commission.
The Board motioned to approve all items A-J, (with exception to items C & H) on the
consent agenda. (Approved 5-0)

Items 8C and 8H were removed from the Consent Agenda and later approved.
10. Administrative Reports
10A. WECO Service Level Agreement – City of Raleigh and Town of Fuquay-Varina
The purpose of this agenda item was to approve the updated Service Level Agreement
between the City of Raleigh and the Town of Fuquay-Varina regarding the delivery of
Public Safety Communications Services. (Approved 5-0)
10B. Preliminary Subdivision Plat – Briar Gate – SUB-PR-2018-03
The purpose of this agenda item was to consider approval of a preliminary subdivision
plat submitted by McKim & Creed, Inc., called Briar Gate, located at 5311 and 5375 Old
Powell Road. (Approved 5-0)
10C. Preliminary Subdivision Plat – Purfoy South Phases 1-12 – SUB-PR-2018-10
The purpose of this agenda item was to consider a preliminary subdivision plat
submitted by Timmons Group called Purfoy South Phases 1-12, located at 9036 and
8701 Purfoy Road. (Approved 5-0)
10D. Exchange of Real Property – South Lakes Elementary School and Future Town
Park Site – Wake County Board of Education
The purpose of this agenda item was to consider exchange of real property with the
Wake County Board of Education, in conjunction with development of a Town park site
at South Lakes Elementary School (E-35). (Approved 5-0)
10E. Naming of Town Park Adjacent to South Lakes Elementary School
The purpose of this agenda item was to consider a name for a future Town Park
adjacent to South Lakes Elementary School. The Town Board agreed to name the park
“Willow Lakes Park”. (Approved 5-0)
10F. Resolution – Request to Expand Extraterritorial Jurisdiction
The purpose of this agenda item was to consider a resolution request Wake County to
expand the Town’s extraterritorial jurisdiction (ETJ) to three (3) miles from its contiguous
corporate limits. (Approved 5-0) Resolution No. 18-1552

A. Manager’s Report
B. Project Status Report highlights:
Town Manager Mitchell informed the Board that the Police Department participated in the lip
sync challenge which has been well received by the public and he thanked Police Chief
Fahnestock and her staff on the creative work that was put into the effort.
NE Judd Parkway conveyance to NCDOT – an assessment has been scheduled for August
17, 2018.
Bid openings for the Street Resurfacing Project is scheduled for August 15
SE Judd Sidewalk and Raleigh/Aiken Street sidewalk project – modifying bid specifications to
encourage economies of scale in a larger bid package.
Fleming Loop Recreational Park is under construction and initial grading has commenced.
Action Park score booth 1 & 2 replacements are complete
CAMPO Southwest Area Study update is underway
Town Business Park is progressing, hope to have State Certified Site within 4-5 months.
C. Quarterly Report – 2nd Quarter 2018
D. NE Judd Parkway and Main Street Intersection Update - Upcoming Street Closures
Town Manager Mitchell reported that the Town will be alerting the public as early as tomorrow
that the intersection across the railroad tract will be closed up to 30-days while Norfolk Southern
make improvements to the section of railroad tract in that vicinity.
E. NW Judd Parkway Project Milestone - Right of Way Certification
Town Manager Mitchell reported that the Town has received Right of Way Certification and has
applied to the Federal Highway Administration for Construction Authorization. He stated that the
Town expects to receive authorization in early September followed by immediate advertisement
for bids with the goal of opening bids and recommending award of a contract in October.

Town Manager Mitchell stated Larry Smith has retired again from the Town, this time with the
Planning Department, as a part-time Code Enforcement Officer, and has applied to serve as an
in-town member on the Planning Board. Mayor Byrne recommends that Mr. Smith fill the
unexpired term that ends December 31, 2019, that was left vacant by Cindy Sheldon.

SECOND: Commissioner Wunsch
MOTION RESULTS: Passed Unanimously (5-0)
Retired Police Chief Smith thanked the Mayor and Town Board for the opportunity to continue
serving the community.

Mayor Pro-Tem Massengill had no further comments.
Commissioner Adcock had no further comments.
Commissioner Harris had no further comments.
Commissioner Wunsch thanked everyone for their thoughts and prayers during his recovery from his
accident that happened on June 17, 2018.
Commissioner Gardner stated that she traveled to Germany for vacation and was so thankful for
Commissioner Wunsch and his family during their recovery from the car accident.
