Adcock, III, Town Attorney In attendance were Mayor Blake Massengill, Mayor Pro-Tem Marilyn Gardner, Commissioners William Harris, Bryan Haynes, Charlie Adcock, and Jason Wunsch. Also in attendance were Town Manager Adam Mitchell, Assistant Town Manager Jim Seymour, Town Attorney James Adcock, Town Clerk Teresa Wilder, IT Tech. Jason Miller, and various other department directors. Assistant Town Manager Mark Matthews was absent. CALL TO ORDER Mayor Massengill called the meeting to order at 7:00 pm. INVOCATION AND PLEDGE Pastor Rob Hardy with Summit Church provided the invocation, and Fire Chief Jim Jones led the Pledge of Allegiance. VIRTUAL MEETING PROTOCOL Town Manager Mitchell reviewed the meeting protocol noting that the meeting was both in- person and live streamed on the Town’s YouTube Channel and Facebook Page. APPROVAL OF MINUTES 3A The April 22, 2024 Budget Workshop and June 3, 2024 Town Board of Commissioners Regular Scheduled Meeting. MOTION: Commissioner Wunsch SECOND: Mayor Pro-Tem Massengill MOTION RESULTS: Passed Unanimously (5-0) PRESENTATIONS 4A Proclamation – Juneteenth Purpose – For Mayor Massengill to present a proclamation recognizing Juneteenth in Fuquay-Varina. Mayor Massengill read aloud his proclamation and recognized Juneteenth as a federal holiday. 4B Proclamation - July Parks and Recreation Month Purpose – For Mayor Massengill to present a proclamation recognizing National Parks and Recreation Month in Fuquay-Varina.  Mayor Massengill read aloud his proclamation and recognized all parks and recreation staff for their great work. Special Event and Amplified Sound Permit Request - Cultural Arts Society of Fuquay- Varina - M.A.NiFest Freedom Day of Remembrance Flag Raising Ceremony - 6-19- 2024 Purpose – To consider approval of a special event application and amplified sound permit for the M.A.NiFest Freedom Day of Remembrance Flag Raising Ceremony, scheduled for June 19, 2024. Recommendation – Approve the special event application and amplified sound permit request for the M.A.NiFest Freedom Day of Remembrance Flag Raising Ceremony scheduled for June 19, 2024, as presented and recommended. 8B. Voluntary Annexation Petition - Donald H. Buffaloe, 7453 Kennebec Road, Willow Spring - PIN 0676965255 - ANX-2023-14 Purpose – To consider the adoption of a resolution instructing the Town Clerk to investigate an annexation petition and adopt a resolution setting a public hearing for July 8, 2024, following the receipt of a petition for voluntary annexation of property owned by Donald H. Buffaloe, containing a total of approximately 47.309 acres. Recommendation – Adopt the resolution instructing the Town Clerk to investigate the voluntary annexation petition and adopt the resolution setting the public hearing for a voluntary annexation petition on July 8, 2024, for property owned by Donald H. Buffaloe - ANX-2023-14 as presented and recommended. Resolution No. 24-1866 Resolution No. 24-1867 8C. Voluntary Annexation Petition - Tingen Broadwell Family LLC & Cairo LLC, 6195, 6199, & 6209 Johnson Pond Road - PIN 0677285616, 0677295473, & 0677294137 - ANX- 2024-05 Purpose – To consider the adoption of a resolution instructing the Town Clerk to investigate an annexation petition and adopt a resolution setting a public hearing for July 8, 2024, following the receipt of a petition for voluntary annexation of property owned by Tingen Broadwell Family LLC & Cairo LLC, containing a total of approximately 9.449 acres. Recommendation – Adopt the resolution instructing the Town Clerk to investigate the voluntary annexation petition and adopt the resolution setting the public hearing for a  voluntary annexation petition on July 8, 2024, for property owned by Tingen Broadwell Family LLC & Cairo LLC - ANX-2024-05 as presented and recommended. Resolution No. 24-1868 Resolution No. 24-1869 8D. Resolution - Authorizing Upset Bid Process Purpose – To consider a resolution authorizing an upset bid process for the sale of property owned by the Town of Fuquay-Varina to Mr. Jason Galarneau. Recommendation – Adopt the proposed resolution as presented and authorize the Town Manager to execute the sale of Town owned property upon the completion of the upset bid period pursuant to N.C. Gen. Stat. 160A-269. The resolution has been reviewed by the Town Attorney as to form and is in the interest of the public. Resolution No. 24-1870 A motion was made to approve all Consent Agenda Items 8A- 8D. MOTION Mayor Pro-Tem Gardner SECOND: Commissioner Haynes MOTION RESULTS: Passed Unanimously (5-0) ITEMS REMOVED FROM CONSENT 9A There were no items removed from the Consent Agenda for separate consideration. ADMINISTRATIVE REPORTS 10A Contract Award – Whitted Road and Johnson Pond Road Roundabout Project Purpose – To consider approving project ordinance amendment POA-24-21 for $700,000 and awarding a contract in the amount of $1,377,698 to the Caton Construction Group, for the construction of a roundabout at the intersection of Whitted Road and Johnson Pond Road. Staff Comments – Engineering Director Matt Poling entered the agenda abstract and supporting documents for this agenda item into the official record of the Town. He then provided information about the agenda item by making the following remarks. The Town’s Engineering Department prepared bid packages for constructing a roundabout at the intersection of Whitted Road (SR-1407) and Johnson Pond Road (SR- 1404). This project will provide upgrades to the road infrastructure, including improvements to the pavement, drainage, and pedestrian facilities. The Engineering Department prepared formal bid packages for this project and received four (4) bids from licensed contractors on June 6, 2024. A public bid opening was held at the John W. Byrne Municipal Building, where each bid was publicly opened and read aloud. Caton Construction Group was the low bidder in the amount of $1,377,698.00. The project is expected to take 280 days and will be completed by Summer 2025. Town staff recommends awarding a contract for the project to Caton Construction Group for $1,377,698.00 and authorizing the Town Manager to execute the contract on behalf of the Town, subject to the Town Attorney’s review as to form. In 2021, Representative Erin Paré requested and secured $1,000,000 for the Whitted Road and Johnson Pond intersection safety improvements project proposed by the Town. On June 1, 2023, GO Bonds for $3,650,000 were sold at a premium for Street Improvements. Of that amount, $1,000,000 was appropriated for the Whitted Road and Johnson Pond Road Roundabout Project. Bids were received on June 6, 2024, in excess of the $1,000,000 budgeted for the project. The estimated total cost of the project (including design and construction) is expected to be $1,700,000. The Bonds were sold at a premium of $521,146. The attached Project Ordinance Amendment appropriates the bond premium, and a portion of interest earned for streets to add $700,000 to the existing $1,000,000 project budget previously appropriated. Discussion – Mayor Massengill asked when the project would begin and when it would be completed. Engineering Director Poling stated that it would start in mid-July and would be completed in 9 to 12 months. Mayor Massengill stated that Representative Erin Paré helped to secure this funding and that the Town would not have to match the funding. Engineering Director Poling stated that was correct and no funding from the Town would be required. Recommendation – Approve POA-24-21 for $700,000 and award a contract to Caton Construction Group in the amount of $1,377,698 and authorize the Town Manager to execute the contract on behalf of the Town for the Whitted Road and Johnson Pond Road Roundabout Project, subject to the Town Attorney’s review as to form. Ordinance No. N-24-18 MOTION: Commissioner Adcock SECOND: Commissioner Haynes MOTION RESULTS: Passed Unanimously (5-0) OTHER BUSINESS 11A Manager’s Report Town Manager Adam Mitchell gave the additional following updates: o Human Resources – The Human Resources Department is offering a wellness program “Know your Numbers” and vascular screening to employees provided by WakeMed. The staff attended a Career Fair at NC State and they had over 300 participants to stop by their table to talk about job opportunities with the Town of Fuquay-Varina. o Parks and Recreation. The Parks and Recreation Department has hired Christian Wood as an Athletic Program Specialist. o Public Works – The Debris Department staff attended training through the Institute for Transportation Research and Education at NC State. The course material included Managing Conflict with the Public, Basic Computer Skills, and Flagger training. Charles Baker recently attended a class to renew his NC Pro-Logger- Certification. o Fire Department – The Fire Department has completed their training on South Ennis Street house that will be demolished soon. Deputy Fire Mashal Laura Hill, Captain Daniel Falcon, and Firefighter Colin Marley all welcomed new babies to their families over the last three weeks. o Police Department. – The US Department of Justice recently published a case study on the Fuquay-Varina Police Department’s Crime Analyst Residence Program which was supported by the Bureau of Justice Assistance Grant. o Inspection Department – The Inspection Department has received building plans from Target, and they are currently in review. They have also had several commercial non-residential inspections that are being reviewed. o Planning Department – A draft of the updated CTP will be available for 30 days for public comment on Let’s Talk FV starting on Friday. The public is welcome to come to Town Hall during business hours with questions or comments regarding the  update. Staff will have a booth at the Grower Market this Saturday from 8:00 am - 12:00 pm and will host an open house in the Town Board room next Monday, June 24th from 6:00-7:30 pm regarding the CTP update. Rachel Mann has been hired as a Planner I. o Finance Department – The Finance Department is busy with end of the year closeouts procedures and gearing up for the annual financial audit process. o Engineering – The resurfacing of SW Judd Parkway will begin on June 24th. A dedicated left turn signal at S Judd and S Main Street intersection has been installed. o Public Utilities – The Public Utilities Department has numerous waterline projects going on including SW Judd Parkway and Ransdell Road (sidewalk) project. o Downtown – The Social District continues to see no significant issues and the Town is receiving positive feedback. o Communications – The Communications Department will be conducting this fall a citizen survey. o Arts Center – The Arts Center will hold Juneteenth events on June 19th and Manifest events this weekend. o A pollinator Garden has been installed at South Park – 5,000 sq. ft. 11.B Independence Day Celebration - South Park - Monday July 1, 2024 - Gates Open at 6:00 pm 11.C Coffee with a Cop - Meridian at Broad Apartments - 7000 Meridian Market Drive - Wednesday July 3, 2024 - 9:00 am - 10:30 am 11.D July Town Board Meeting - Monday July 8, 2024 - 7:00 pm - No meeting on July 1, 2024 or July 16, 2024 11.E Police Department - Friends with Wisdom - Universal Healthcare of Fuquay-Varina - 410 Judd Parkway - Wednesday July 10, 2024 - 2:00 - 3:00 pm 11.F Police Department - Cornhole Tournament - Fundraiser for Special Olympics - Saturday July 13, 2024 - Registration 8:30 am - Tournament 9:00 am - Southern Wake Sports Academy - 6109 NC-55 Hwy 11.G Ice Cream Social - Sunday July 21, 2024 - 4:00 - 6:00 pm - Fuquay Mineral Spring Park 11.H Zoning Map Amendment - Taylor Morrison of the Carolinas, Inc - A Portion of 7453 Kennebec Road - A Portion of PIN 0676965255 - REZ-2023-15 - (FIRST READING) - (Davison) BOARD MEMBER COMMENTS Commissioner Harris stated he had no comments. Commissioner Adcock stated that he is excited about the Whitted/Johnson Pond Road roundabout project and being able to receive federal funding for the project. Commissioner Wunsch congratulated Town Manager Mitchell’s daughter, Adelynn Mitchell for becoming a High School All-American in track and field at the New Balance Nationals last week. He reported that it was the highest honor you can get in high school athletics. Commissioner Haynes congratulated all the graduates from high school to preschool on their graduations. He stated that Manifest starts tomorrow with a raising the flag ceremony at Pine Acres Community Center starting at 12:00 pm and then other events this weekend. He attended the Bowling Road Elementary School groundbreaking ceremony and that was an exciting event. He thanked everyone that participated in Senior Day at the Growers Market this past Saturday and vouchers were given to seniors for fresh vegetables. He stated that this coming Saturday the Growers Market will start their summer meal program for children under 18 years old who can receive a free summer meal through August 3rd. He reported that the National League of Cities is celebrating Small Cities Month and Fuquay-Varina has a lot of great things going on for a small town. Mayor Pro-Tem Gardner stated that she attended the Bowling Road Elementary School groundbreaking, and it was an exciting event. She reported that the new middle school is close to being finished for this upcoming school year. She also stated that Wake County Commissioner Matt Calabria mentioned the expansion of the library will be on the upcoming bond and it needs to be advocated for here in Fuquay-Varina. Town Manager Mitchell stated that during the Bowling Road Elementary groundbreaking ceremony, he, Mayor Pro-Tem Gardner, Commissioner Harris and Commissioner Haynes had the opportunity to talk with Wake County Superintendent Taylor and Wake County School Board member Monica Johnson-Hostler regarding the Fuquay-Varina Middle School and what their plans are for the building once the new school opens. He reported that Superintendent Taylor stated that they did not have any concrete plans for the building but would keep the community and Town staff informed when plans are developed for the building. Mayor Massengill stated that he attended both Fuquay-Varina and Willow Springs High School graduations with around 800 students graduating between the two schools. He reported that both Rotary Clubs of Fuquay-Varina had the Flag Day closing ceremony on June 14th for the flags that were displayed at the Police Station. He stated that these flags were not only for the veterans but also for the first responders of Fuquay-Varina.
