CALL MEETING TO ORDER, PLEDGE OF ALLEGIANCE, ROLL CALL The Board of Zoning & Building Appeals met in Special Session on Thursday, August 29, 2018, in Council Chambers of City Hall, 200 South Hamilton Road, Gahanna, Ohio. Chair Jensen called the meeting to order at 6:00 p.m. The Agenda for this meeting was published on August 22, 2018. Present 4 - Hakim Ben Adjoua, Donald W. Jensen, Debra Mecozzi, and Lorne Eisen Absent 1 - Timothy W. Pack B. PURPOSE - REQUEST FOR RECONSIDERATION AND CLARIFICATION OF THE DECISION MADE BY THE BOARD ON JULY 26, 2018 REGARDING BZA-0001-2018: C. DELIBERATION AND DISCUSSION Chair Jensen stated the following: PURPOSE - REQUEST FOR RECONSIDERATION AND CLARIFICATION OF THE DECISION MADE BY THE BOARD ON JULY 26, 2018 REGARDING BZA-0001-2018: This is the only matter we will be discussing tonight; this is not a Public Hearing for comments, however, if the members have a specific question for legal counsel that may be acceptable. He read the title of the Appeal, as follows: City of Gahanna Page 1 Board of Zoning and Building Meeting Minutes August 29, 2018 Appeals To consider an appeal of Planning Commission’s approval of the following applications: V-0005-2018 - To consider a Variance Application to vary Overlay Standards outlined in ORD-0111-1990, for building design standards; for property located at 1041 N. Hamilton Road; PID# 025-009953; The Shops at Oberer’s Crossing; current zoning PCC; Glen Dugger, applicant. DR-0007-2018 - To consider a Design Review Application for site plan, landscaping, building design; for property located at 1041 N. Hamilton Road; PID# 025-009953; The Shops at Oberer’s Crossing; current zoning PCC; Glen Dugger, applicant. FDP-0005-2018 - To consider a Final Development Plan Application for three buildings for neighborhood service, retail, office and restaurant use; for property located at 1041 N. Hamilton Road; PID# 025-009953; The Shops at Oberer’s Crossing; current zoning PCC; Glen Dugger, applicant. FINDINGS - On July 26 in a single motion that was compromised of all the applications. The Board determined to affirm the appeal. On August 16 legal counsel for the interested party requested a clarification of the decision made by the board, specifically, how each application was addressed and voted on. Should the board take the position that the items should be voted separately in order to clarify how the board voted on each application, specifically, the Variance, Design Review and Final Development Plan; a date would then need to be scheduled to reopen a hearing for such purpose. D. DECISION Chair Jensen opened the floor for members to discuss; noted a City of Gahanna Page 2 Board of Zoning and Building Meeting Minutes August 29, 2018 Appeals brief conversation; no member had comment except for Eisen, who indicated that he did not have further comment at this time, any different than what he stated at the last meeting. A motion was made by Jensen, seconded by Mecozzi, to reopen the July 26 hearing for the purpose of addressing and clarifying and vote on each application separately, specifically, the Variance, Design Review and Final Development Plan. The Motion carried by the following vote: Yes: 4- Adjoua, Jensen, Mecozzi and Eisen Absent: 1- Pack E. ADJOURNMENT Kristin Rosan, legal counsel for the City, noted that a date would need to be set; the members requested the Clerk to coordinate a meeting date.
