President of Council, Brian D. Larick, called the meeting to order at 7:02 p.m. Vice President of Council, Jamie Leeseberg, delivered an Invocation followed by the Pledge of Allegiance. HEARING OF VISITORS. - Lead By Example Award from Mayor Kneeland Mayor Kneeland presented Meijer, Store 114, with a Lead By Example award in recognition of exemplary community service for the Shop with a Cop event. Chief Spence thanked Meijer for participating in Shop With A Cop; commended staff. Cid Canter, 750 Fleet Run Ave.; current chair of GRIN; informed Council that in the past 5 years, Meijer has provided $150,000 dollars' worth of coupons to GRIN for the purpose of purchasing food for the organization. Walnut St., Westerville; Ohio House Representative, Elect for District 19; is a 30 year resident of Plain Twp; was a classroom teacher, now teaches at OSU Newark; will have listening tour across district and will host office hours in Gahanna. Lisa Brosnahan, 494 Howland Dr.; is a member of the family who's dogs were killed; thanked Council for their quick response and support; appreciates support of all those here; heard news today that neighbors dropped appeal for designation of dangerous dog; huge step in right direction; still work to be done. Rex Littrell, 7112 Northmont Ct., Blacklick; a friend of Brosnahan; looked through ordinances and agrees with changes; reasonable ordinances protect residences and rights of dog owners; this is about individual animals, not a specific breed; if someone's dog injures a person, best thing to do is remove the dog from a residential setting; when continuing to look at this ordinance: consider having own city officers to issue own designation, maybe that will allow them to act faster than county and state; build into requirements a specification about fencing; dangerous dogs may require a different type of fence. Joe Gregory, 609 Jonsol Ct.; son is married to Lisa's daughter; Jim poured a full basketball court in their backyard to ensure the safety of the children; but the dogs have entered their property more than once; was the 3rd person to arrive at the scene; it was a murder scene; vet said multiple bites on dogs; spine was snapped; the dogs are dangerous but still allowed to be there; think about having children play in their yard and what that could mean for their safety; thinks the dogs need to go. PUBLIC HEARINGS: ORD-0106-2018 TO REZONE 4.5 +/- ACRES OF PROPERTY, TO TWO FAMILY RESIDENTIAL (MR-1); SAID PROPERTY LOCATED AT 488 EAST JOHNSTOWN ROAD; PARCEL ID NO. 025-001930-00; CURRENT ZONING SINGLE FAMILY (SF-2); PAULINA PLACE; LORETO CANINI, APPLICANT. Larick explained the process and procedures of the Public Hearing. Larick called on Anthony Jones, Director of Planning & Development. Jones provided a summary of the presentation from the Committee of the Whole meeting from the previous week. Presentation attached in legislative file ORD-0106-2018 and ORD-0107-2018. Jones stated the Zoning and Variance were both recommended for approval by Planning Commission on 10/24/18. Jones stated that for the next steps, a Final Plat would go before Planning Commission and that would come back to Council. Larick asked Jones to confirm if the Final Plat would come back for a decision or for informational purposes. Jones reiterated that it would be for a decision. Larick asked about the zoning designation of MR-1, asked if the Conditional Use only allows for single family homes. Jones confirmed that the Planning Commission approved a single-family use, so the Conditional Use runs with the request for Zoning. Larick opened the Public Hearing at 7:25 p.m. and called for proponents. Larry Canini, applicant for the Zoning and Variance, thanked the staff for their assistance; stated that the project is one that is needed in the community; here to answer questions. McGregor asked about the road coming out to Johnstown Rd.; feels bad for their neighbors to have a road run through and between two existing houses; asked if there's a way to change that. Canini said the house to the west just recently sold, and there was no adverse effect on that sale; shared plans with the seller; the home to the east will be retained, fixed up and re-sold; showed a new streetscape in Planning Commission; working with neighbors to the east to enhance the road from Larry Ln. going west, up to the new street; will use the same curb cut that is already shared; will be making quite an improvement to the area. Leeseberg asked if the original house is on a septic system. Canini confirmed that City of Gahanna Page 5 City Council Meeting Minutes December 17, 2018 the home is on septic but tied to City water; will be removing the septic and installing into the newer system; the leeching effect of the septic system will be gone. Leeseberg asked if the stormwater guidelines will be followed. Canini said he has met with Rob Priestas (City Engineer) and confirmed; there will be an enhancement; talked about permeable pavers. Leeseberg asked if the road will be public or private. Canini said private, and managed by HOA; will not burden City services. Larick called on other proponents. There were none. Larick called for opponents. John Miller, 1484 Braeton Parkway; attorney for a few of the contiguous property owners; stated that an appeal was filed for the Conditional Use application; the contiguous owners are on Colony Court; showed photos of their residences (attached in legislative files ORD-0106-2018 and ORD-0107-2018); explained that there is a slope in the backyard and the short distance makes it uncomfortable and obtrusive for the residents; stated that development cannot be pursued without restraint; there is only one reason to change the zoning and that is for profitability; the side yard is only 5 feet; for granting the rezoning, certain elements must be considered and profitability is not listed; surrounding areas are not so condense; before the owners will withdraw their opposition only after this has been considered and recorded to run with the land; regarding the Variance, that is an extreme measure and an usurpation of the Gahanna City Code; variances are meant for one lot, in cases of special need, this variance is for the entire development; still must meet burden of showing hardship; more profitable use will not justify a hardship; the code needs to change, not grant a variance. Metzbower asked if opposition is for the variances or the overall project. Miller said the he has been working with the developer and trying to meet the needs of the residents, but yes, they are unsatisfied with the variances; but they all go together, the variances, zoning and conditional use. Callie McInturf, 252 Colony Court; one of the homeowners; have met with the developer and wants to support him due to the quality of this project; but has concerns; the difference in topography is important to consider; there's a 10 ft. difference; depending on height of those homes, could be a concern because neighbors would be looking down on them; also concerned with screening due to privacy issues; would like year round screening. Mike Helbig, 260 Colony Court; similar to what Callie mentioned, concerned with privacy and distance of new homes from property lines; City of Gahanna Page 6 City Council Meeting Minutes December 17, 2018 would like consistent privacy throughout the year; the density is a little misleading; there's a house on the front of 1 acre, and 14 homes crammed into the back of the development; should be considered. Larick called for questions from Council, there were none. Larick called for other opponents, there were none. Allowed Canini time for rebuttal. Canini said he held private meetings with the home owners; Mr. Helbig hosted generously; wants to say that in the minutes from Planning Commission you can read where he agreed to add screening with evergreens; the area is highly wooded and wanted to save those trees; our buyers will want privacy as well; for the two homes sitting on the southern boundary, if you look at the revised plan, you will see the changes for the cul-de-sac; had communication with Mr. Miller and received today, an agreed entry document that outlines the plan and concerns for the future; cannot be responsible for the grade because that was there from the time the homes were purchased; asks for consideration of Council; has spent time reaching out to home owners to work together on this. Angelou asked about the screening, what will be put in; Canini said evergreens will be planted strategically. Larick closed the Public Hearing at 7:50 p.m. ORD-0107-2018 TO GRANT A VARIANCE APPLICATION TO VARY SECTIONS 1108.01, REQUIRING FINAL DEVELOPMENT PLAN REVIEW FOR PROPERTIES ZONED TWO FAMILY RESIDENTIAL (MR-1), 1109.02(A), REQUIRING PUBLIC STREETS, AND 1145.05(A), REQUIRING LOTS TO FRONT ON A DEDICATED PUBLIC STREET, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA; FOR PROPERTY LOCATED AT 488 EAST JOHNSTOWN ROAD; PARCEL ID NO. 025-001930-00; CURRENT ZONING SINGLE FAMILY (SF-2); PAULINA PLACE; LORETO CANINI, APPLICANT. Larick opened the Public Hearing at 7:50 p.m. and called for proponents. Canini said he believes it is clear as to why the variances are needed. Larick called for opponents. Miller said he wanted to say that the agreed entry which was sent to Canini was not approved by all parties but hopes to come to an agreement. City of Gahanna Page 7 City Council Meeting Minutes December 17, 2018 Jason Stephens, 488 E. Johnstown Rd.; owner of the property; would like to speak as a proponent; have met with the neighbors and heard concerns; heard the residents on screening, cul-de-sac, slope, lighting, and made changes accordingly; developer has done a strong job addressing concerns; the ask of Council is to allow the opportunity to go to the next step, to go through Planning Commission again, and back to Council; the two motions are a way to move forward; would like to ask for the vote to do so. Leeseberg said that the area has experienced some flooding this year; stated that none of those existing sub divisions had detention ponds. Franey confirmed that the rules were different back then. Leeseberg said this development will have detention and meet stormwater requirements. Angelou asked if this will help the properties that have had flooding. Franey said typically development now has tendency to help in those areas due to the strict requirements. Leeseberg said this would help everyone downstream. Canini explained that the design will allow for a capture under the roadway; did hear concerns of Sycamore Run flooding; we will now be a control for that. Larick asked where the exit will be; Canini showed on the drawing; said we have reduced the amount of density by keeping the original home. McGregor asked about extra parking. Canini said these homes will have 2 car garages and driveways, similar to surrounding homes. Larick closed the Public Hearing at 8:00 p.m. Ewald said that there should be a notation under ORD-0107-2018 to reference back to the Conditional Use. Larick confirmed. Ewald said we will need to confirm that the variance requirements are met now that there have been changes to the site. ORD-0099-2018 TO MAKE TEMPORARY APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE GENERAL FUND TO JANUARY 31, 2019 AND TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND EXPENDITURES FOR ALL OTHER FUNDS DURING THE FISCAL YEAR ENDING DECEMBER 31, 2019 FOR THE CITY OF GAHANNA, STATE OF OHIO. Larick noted that the Ordinance for consideration will be amended by substitution for a temporary budget to go through January 31, 2019 due to requirements of auditor, and need to request bids in early February. City of Gahanna Page 8 City Council Meeting Minutes December 17, 2018 Larick opened the Public Hearing at 8:04 p.m. Rick Duff, 312 Dunbarton Rd.; would like to say that he does not envy Council’s position and has full faith and trust in Council; the challenge is not the spending, or expenditures, but with a lack of revenue; as far as cutting expenses, would recommend taking Detroit street rebuilds off 2019 calendar due to expense; wants to remind Council that there is an ability to generate additional revenue by modifying ORD-0161; also putting a new levy on the May ballot and seek a 2% income tax; appreciates all the work of Council. Angelou thought that was interesting to point out that something needs to go on the ballot again; if Issue 29 had passed, we would not have these issues; we need other people to ask that we put something back on the ballot; won’t do it unless more people come forward. Stated that regarding a 2% income tax, we went through all the iterations and 2% was not enough money. Robert Poe, 499 Daventry Ln.; agrees with Issue 29 going back on the ballot in order to compete with and be on the same level as other neighboring cities; we need this; most people think about what they want as opposed to what they can live without; did a lot of thinking and one thing came to mind to build natural play areas since playgrounds are so expensive; instead of replacing old playgrounds with new ones, we could create the natural play areas like Woodside Green; kids need to play in the dirt, and get active outside in the environment; volunteer efforts could also be utilized. Larick said due to financial restraints, no playgrounds could be constructed unless it was funded by donations and volunteers. Diana Redman, 598 Codrington Circle; admires the fiscal responsibility of Council; reads about the City of Columbus and is glad to not be there; when thinking about reductions, tried to come up with suggestions that would not affect me, and that was difficult to do; one thing that came to mind is to limit the snow and ice removal from side streets, to not be as prompt; in some counties some facilities were closed two weeks per month, which would decrease expenses; could consolidate services. Angelou said it was determined to change the policy of not sending out plows until there’s 3” of snow, which used to be 2”. Larick closed the Public Hearing at 8:12 p.m. City of Gahanna Page 9 City Council Meeting Minutes December 17, 2018 G. COMMITTEE UPDATES None. H. CORRESPONDENCE AND ACTIONS: Clerk None. Council Larick said there have been a large number of emails regarding dangerous animal legislation; we will continue to look at ordinances in place, get legal perspective and continue a path forward. Leeseberg said as you may recall we received an email from Brenda Hoffman on 12/9 reminding Council that she asked for Fence Code and wondering what we as Council had done. I want to make the record clear as to what this Council did regarding Fence Code. As Chairman of the Code Review Committee I will tell you that Mr. Renner, Mrs. Angelou and I met several times, reviewed our Code and those of surrounding communities. We listened to testimony from citizens, asked for input from the City Attorney, Mr. Ewald, and reviewed the ORC as it pertains to fences and their maintenance. We then made a recommendation that our code be revise to allow 5’ on adjacent properties for the maintenance and/or repairs. For the record, ORC allows for 10’. Per 1171.03 (l) of our Code, fences are required to be maintained in good condition. Additionally, repairs are to be made w/in 30 days of notice. The administration asked to discuss these proposed changes and voiced their concern that it would be hard to make adjacent land owners allow their neighbors on to their property. We were also told that they didn’t want to have code enforcement personnel and Police officers involved in disputes between neighbors. I asked the administration what we would do if, and when, a neighbor refused access to the adjacent property owner and was told we just wouldn’t enforce our code. The proposed changes were sent to Planning Commission to review since they handle Section 11 of our Code. The Planning Commission City of Gahanna Page 10 City Council Meeting Minutes December 17, 2018 was informed by the Administration that they did not agree with the changes and that they would oppose the changes. That is where the changes to our fence code died. We just heard less than a week ago that if there was a concern about a resident meeting the requirements associated with Dangerous Animals, ie. fences, signage, pens, etc. that we would send Code enforcement and Police officers to investigate. I. SECOND READING OF ORDINANCES: ORD-0099-2018 TO MAKE TEMPORARY APPROPRIATIONS FOR CURRENT EXPENSES AND OTHER EXPENDITURES OF THE GENERAL FUND TO JANUARY 31, 2019 AND TO MAKE APPROPRIATIONS FOR CURRENT EXPENSES AND EXPENDITURES FOR ALL OTHER FUNDS DURING THE FISCAL YEAR ENDING DECEMBER 31, 2019 FOR THE CITY OF GAHANNA, STATE OF OHIO. A motion was made by Renner, seconded by Leeseberg, that the Ordinance be Amended by Substitution and Adopted. Discussion on the motion: Larick provided a brief summary of the legislation; on the table is a substitution of the original which was for a temporary budget through the month of March; the intent was to be an operational budget and allow for some capital bids, specifically a portion of the street bids and a bridge; as it has been amended, there will be a temporary one month budget, through January 31, to allow additional time to discuss additional revenue and options; without any capital included in the first month; want to meet audit requirements and expectations; in order to meet deadlines, there must be a decision no later than January 30, but will target January 28; at that point a final budget and path forward must be decided. Angelou asked about the 31 days, on the 220 Street Fund, it refers to capital; asked is that permissible. Bury said as the budget stands before you, it was a temporary for the general fund and permanent appropriations for all other funds. Schnetzer asked that Council come prepared after the holidays and schedule extra meetings to get this completed; we have 3 weeks to make this work. Mid-Ohio Regional Planning Commission (MORPC) - Angelou Angelou provided a summary of the MORPC meeting from December 13, 2018; provided documents from the meeting and submitted additional documents of interest (attached in the file below); stated that she will be going to Washington D.C in February. 2018-0228 MORPC Update from Karen Angelou for the December 17, 2018 Council Meeting. COUNCIL COMMENT City of Gahanna Page 12 City Council Meeting Minutes December 17, 2018 Renner said this is the last meeting of the year and traditionally we say thank you and we are looking forward to next year; we have a lot to talk about; thanked colleagues and administration; these are some of the hardest times since he's been on Council since 2012; painful to make cuts and wants to address revenue increases again; this year has been very eventful; it began with finding out that he has a sister; it has been a fantastic and emotional ride; is grateful for the community he lives in and family for support. Angelou thanked everyone who has come out to the meetings in the past few weeks; thanks administration for all their work; said she appreciates those who spoke tonight regarding putting Issue 29 back on the ballot because it gives her encouragement to know there are people who understand what council was trying to do with those funds; looked at various options and that was the one that would work for the next 20 years; thanked those who voted; thanked colleagues for all the time they have put in; we are lucky to be working together; have been here 29 years; this meeting is emotional because in 2013, had to leave this building in an ambulance due to a heart attack; visited the doctor and was told she is currently in good health; wished everyone a happy new year. McGregor said when she thinks about our forefathers, and how we were under rule of the monarchy without representation; told a story about a teacher in Gahanna who conducted an experiment with her elementary students in order to show them what it’s like to be under rule of a queen; the teacher was overthrown by the second day; it was a great object lesson and demonstrates why we are blessed to have a democracy and should be thankful; wished everyone a Merry Christmas and Happy New Year. Schnetzer received a text message from a resident, of a photo of the bridge over Walnut Creek near the golf course; sometimes we get kicked on social media and it’s easy to highlight the negative. The message read: “love the new section of the Creekside walking path. It is beautiful. Council should be very proud. Why would anyone want to live anywhere other than Gahanna.” He said messages like that keep him going; support from residents is encouraging; thanked Poe, Redman, and Duff for being a part of the representative democracy. Larick said he’s looking forward to the holidays; this is the most exhausted he’s been since working here; loves the community and will continue to do all he can; thanked everyone for coming out; thanked City of Gahanna Page 13 City Council Meeting Minutes December 17, 2018 Council for their dedication to the job and community; this has been a lot of work. EXECUTIVE SESSION A motion was made by Schnetzer, seconded by Angelou, to go into Executive Session under authority of Section 5.40(a) of the Council Rules of Procedure to consider the appointment, employment, dismissal, discipline, promotion, demotion, or compensation of a public employee or official, or the investigation of charges or complaints against a public employee, official, licensee, or regulated individual, unless the public employee, official, licensee, or regulated individual requests a public hearing AND under authority of Section 5.40(c) of the Council Rules of Procedure to confer with the City Attorney for the public body concerning disputes involving the public body that are the subject of pending or imminent court action. Larick requested that the City Attorney and Mayor attend; to be held in the Council Conference Room.
