Larick CONTINUED ITEMS ORD-0053-2018 TO ENACT CODE CHAPTER 780?, RENTAL PROPERTY REGISTRATION AND MAINTENANCE, OF PART SEVEN, BUSINESS REGULATION CODE, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. Ewald said this was put out to staff; they've provided feedback that he is working through; has the latest draft; Priestas said inspections, talked about frequency but did not see that addressed; talked out in-state agent and owner, must be 2 people; not adjusted; Ewald said owner should have been removed; Ewald said frequency could be addressed by staff; Priestas said would be nice to put time frame in; as a landlord; preference would be annually 1x year; Schnetzer said draft was leaving to administrative discretion; could it be on the application or notice for the landlord; Priestas said we can handle it that way; Franey said 7.13, starts to feel like we are talking about interior inspections again; Priestas agreed, had the same takeaway; worth discussion; Larick asked if access to land space would be required; Ewald explained the process; may be portion of the property that is not accessible; need legal process and that would be court system; Schnetzer said AEP inspects meter; what is different about this; Franey said if the landlord will not give permission to walk on their grass, it makes sense; it reads that you are talking about interior; if cross references line up, all makes sense; Ewald City of Gahanna Page 1 Committee of the Whole Meeting Minutes June 11, 2018 said can add the word exterior to that section to make it more clear; Larick said comments made last week for and against; talked about impact; currently owns a rental property; see both sides; see value in making sure there is a level of maintenance; have to consider overall impact to city; Schnetzer said public comment referenced code enforcement in place; residents were promised pro-active code enforcement; read statistics from the Census Bureau regarding renter occupied homes; increased 41% in 16 years; owner-occupied increased 2%; total housing increased 10.5%; reactive way of enforcing code does not work and is not satisfying residents; McGregor asked if that includes apartments; Schnetzer said yes; Angelou said Creekside apartments with say 100 apartments, what would they pay; Ewald explained fee structure; McGregor asked about utilities going to a home; Franey said we can check to see if there is water going but not other utilities; Renner said you can verify service; Ewald said yes, active or not active. RECOMMENDATION: Regular Agenda. ORD-0054-2018 TO ENACT CODE CHAPTER 785?, MOBILE FOOD VENDING (MFV), OF PART SEVEN, BUSINESS REGULATION CODE, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. Ewald said reached out to a number of impacted potential vendors; no issue with this; feel code is solid at this point; focused on safety aspect of this, not to make money; Metzbower confirmed these have went through a 3rd party; Ewald confirmed; Larick asked if we have identified a chapter number; Ewald said not yet, just want to make sure we do that.
