Renner Michael Schnetzer Kimberly Banning, Clerk of Council Monday, July 9, 2018 7:00 PM Council Committee Room Chair Leeseberg called the meeting to order at 7:00 p.m. * Karen Angelou is absent due to representing Council at the MORPC Gubernatorial reception this evening. Present 4 - Brian Metzbower, Nancy R. McGregor, Jamie Leeseberg, and Brian D. Larick Absent 3 - Karen J. Angelou, Stephen A. Renner, and Michael Schnetzer PENDING LEGISLATION - ORD-0054-2018 TO ENACT CODE CHAPTER 732, MOBILE FOOD VENDING (MFV), AND TO REPEAL CODE CHAPTER 733, STREET FOOD VENDORS, OF PART SEVEN, BUSINESS REGULATION CODE, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. Ewald said Mobile Food Vending code language was sent for review; permit is specifically to operate in the public right of way or designated mobile food vending spots which is different than operating on private property; Metzbower requested to know the difference between 732.01 (d) and (j); Chief said that they get the license from Columbus and the permit from us for the purpose of sitting in a public space; Larick asked if we are calling it a Mobile Food Vending License why can’t it be called a Mobile Food Vending Permit; Council members agreed they are comfortable calling it a Mobile Food Vending Permit; Ewald said the name can be changed to Mobile Food Vending Permit; Larick is concerned with the wording of Mobile Food Vending Fee; request it be changed; Leeseberg said this is effective January 1, 2019; which will give people time to get their license from the City of Columbus, Ewald agreed stating there was inconsistency in the feedback received and some of the wording was changed; and has been corrected; 732.02 an City of Gahanna Page 1 Committee of the Whole Meeting Minutes July 9, 2018 adjustment was made; there was not an exception for private property; the information has been added; McGregor asked how long is the permit good for; Ewald shared that the City of Columbus has an annual license that begins in September; Administration is working on the licensing year; Larick wanted to know the intent of the mobile food vending fee/permit; Ewald stated the public permit issued by the City if Gahanna does not cover private property it only applies to public property ROW and parks; he stated there was some discussion on the fee; Chief Spence said the Police Department does not have a fee schedule; stating the fee would be for one year; Franey said if the fee is being set by the Police Department then it needs to be in legislation; after some discussion Larick requested to leave the fee in for now and within 90 days bring a recommendation back for a standardized approach for a fee schedule; Mayor Kneeland asked how this affects people who rent a park for a festival and want to have food trucks; Barr stated we will have to educate our users; Chief said that this would also fall under Public/Special Event. RECOMMENDATION: Regular Agenda, Amend by Substitution. ITEM FROM THE DIRECTOR OF PARKS & RECREATION ORD-0062-2018 TO AMEND CHAPTER 563, PARK CONDUCT, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA. Barr requested to amend Chapter 563; there have been grammar and punctuation changes throughout the document and the dog park rules have been added in 563.31 for enforcement purposes at the park; the language has changed in 563.25 adding drones, hover boards and Segway’s as not permitted in the parks; Larick asked in regards to 563.25 if there are any designated places that those items listed are permitted to do those activities; Barr shared there are not any designated locations; 563.25 has been in existence for some time; Larick stated there are a lot of activities that would bring joy that are not destructive that if we have a designated location would be reasonable somewhere; Larick stated it makes since that we reinstate areas designated by the director and also include for city sanctioned use; that would temporarily solve the issue; if there is a better accommodation more appropriate or manageable idea it can be brought back forward; Leeseberg said leaving areas designated by the director or city sanctioned use still gives you control over it for now; Barr restated the language to keep; or on trails except in areas designated by the Director and for city sanctioned use; staff will work on a more permanent language; McGregor asked if engine powered is the same thing as battery powered; Barr said engine designates combustion powered; City of Gahanna Page 2 Committee of the Whole Meeting Minutes July 9, 2018 Mayor Kneeland asked if McGregor was concerned about the motorized scooters; Kneeland stated in 563.26 there is language that says Self-Propelled, Animal Drawn or Human-Propelled Vehicles. No person shall operate or cause to be operated any type of self-propelled vehicle or any vehicle which is moved by animal or human power over or upon any nature trail within the parks; Mayor Kneeland would like to have staff review 563; Larick asked about 537.07 (b) No event or activity sponsored or promoted by an individual or organization shall be permitted in, in the opinion of the Director or the Board; so the Parks & Rec Board could identify and event and disallow it; is that the intent of the purview board or the intent of how we wish to manage the appropriateness of activities or events; since this is coming back this doesn’t need answered now; Barr shared that the practice has been the Directors decision. Barr requested input from Council regarding banning smoking in city parks; Larick struggles with mandating stopping something that is legal, he is ok with signage requesting no smoking around children; McGregor agrees with Larick. RECOMMENDATION: Held in Committee. ITEMS FROM THE DIRECTOR OF PUBLIC SERVICE & ENGINEERING ORD-0063-2018 DETERMINATION TO PROCEED WITH THE ASSESSMENT PROCESS FOR CERTAIN REAL ESTATE FOR SANITARY SERVICES FOR PROPERTIES LOCATED ON PRICE ROAD Priestas requested an Ordinance for the Price Rd Phase II Assessment; Council previously passed SR0001-2018 to determine the necessity and intent of the sanitary sewer project; we are here to request an Ordinance to proceed with the assessment services. RECOMMENDATION: Consent Agenda. ORD-0064-2018 TO AUTHORIZE THE MAYOR TO ENTER INTO CONTRACT WITH CARGILL FOR ROAD SALT FOR THE 2018-2019 WINTER SEASON. Priestas requested to award a contract for the 2018-2019 road salt bid; the lowest bidder is Cargill, with a bid price of $82.72/ton plus $8.00/ton piling charge. RECOMMENDATION: Consent Agenda. ITEM FROM COUNCIL City of Gahanna Page 3 Committee of the Whole Meeting Minutes July 9, 2018 MR-0027-2018 To establish the schedule for legislative steps required for the amendment OF SECTION 161.081, CREDIT FOR TAX PAID TO ANOTHER MUNICIPALITY, OF CHAPTER 161, INCOME TAX, OF THE CODIFIED ORDINANCES OF THE CITY OF GAHANNA, RELATED TO THE SUBMISSION TO THE ELECTORS OF THE CITY OF GAHANNA AT THE GENERAL ELECTION TO BE HELD NOVEMBER 6, 2018, AN ORDINANCE TO AMEND ORDINANCE 75-76, PASSED AUGUST, 1976, SO AS TO INCREASE THE GAHANNA INCOME TAX FROM A RATE OF ONE AND ONE-HALF (1.5%) PERCENT TO A RATE OF TWO AND ONE-HALF (2.5%) PERCENT, as follows: JULY 23, 2018 - COMMITTEE OF THE WHOLE DISCUSSION at 7:00 pm AUGUST 6, 2018 - INTRODUCE; FIRST PUBLIC HEARING at 7:00 pm AUGUST 13, 2018 - SPECIAL MEETING; SECOND PUBLIC HEARING at 6:00 pm AUGUST 20, 2018 - REGULAR MEETING; THIRD PUBLIC HEARING at 7:00 pm OCTOBER 22 - SPECIAL MEETING; SECOND READING TO CONSIDER ADOPTION at 6:00 pm Establishing for public use the schedule regarding legislation changing the credit granted to those residents working outside of the City of Gahanna. This resolution Whereas, Council would like to notify the public of section ____ Larick shared that there has been some discussion regarding the credit; looking at the timeline/schedule for the legislative process; Council recommends a Motion Resolution articulating the dates and times of each meeting, so that citizens are aware of the process and resulting legislation; this will give as much notice as possible; Larick stated the timeline is as follows: discuss in Committee of the Whole 7/23, introduce and first Public Hearing 8/6, second Public Hearing at Special Meeting 8/13, third Public Hearing on 8/20 and any potential vote on 10/22; Clerk will work with City Attorney to formalize the Motion Resolution of the timeline and schedule; Larick wants the dates confirmed and to provide advance notice of the meetings.
