CALL TO ORDER Chair Nancy McGregor called the Committee of the Whole to order at 7:00 p.m. All members were in attendance. B. DISCUSSIONS 1. ITEMS REFERRED FROM PLANNING COMMISSION ORD-120-2020 ORDINANCE TO AMEND THE CODE OF ORDINANCES OF GAHANNA, OHIO: Amending Section 1133.02 - POSTING OF PROPERTY; PUBLICATION OF NOTICE of Chapter 1133 - Zoning or Rezoning. Mr. Blackford reminded Committee members about the legislation. Over the last 5 years there have been an average of 3 re-zonings a year. There was an instance of a re-zoning where the sign was improperly placed which cost staff about 15-20 hours worth of work. He outlined the procedure Mr. Renner said that the sign would be up through the public hearing process, before it was until Council makes a decision, that language isn't included in the new wording. Is the intent still public hearing with Council, or does that need added back in. Mr. Blackford clarified that it is until the business is concluded. Planning Commission and Council. Mr. Larick wanted to make sure the cost is covered by the applicant and the signs are visible and has the language gone through the City Attorney. Mr. Blackford said it has been vetted by legal and administration. Ms. Bowers said she is concerned about some ambiguity in that it is the City of Gahanna Page 1 Committee of the Whole Meeting Minutes January 11, 2021 public hearing process mentioned is a specific term and the vote may not occur at the same night of the public hearing. She asks that legal take another look at the language to ensure it is clear that it is at the conclusion of the business. Mrs. McGregor requested a change in language to eliminate some confusing language. Mayor Jadwin offered "before considering the pending application" as a phrase. Mrs. McGregor agreed with that line and asked if Ray had any concern with Ms. Bower's issue. It seems that the sign would be up only until the hearing is held. But she didn't feel it was clear. Mr. Mularski said that the public hearing process is not defined. He asked Mr. Blackford when the sign gets taken down. Mayor Jadwin replied within 7 days after Council conclusion. New language would be at the conclusion of the public hearing process. Ms. Bowers said that it says the public hearing process. Since we have a legal thing that is a public hearing, that is a thing but she wanted to make sure we understood the intent of administration if there is a turn over in staff. Mayor Jadwin asked if there was a specific intent in removing the 7 day language. Mr. Blackford replied that it was to make things a little more concise. Mr. Mularski said he liked the language that Ms. Bowers suggested. Mr. Blackford said it would be no challenge to add within 7 days of final council approval. Mr. Mularski said it doesn't have to say 7 days Mayor Jadwin replied that it should read "Shall be removed after final Council action" Mrs. McGregor asked for a revised version before the public hearing next week. Discussion: Charter Review Commission Mr. Larick instructed Committee members to prepare one question to be assembled into a questionnaire for Charter review candidates. He stated that there will be advertisements placed in the Rocky Fork Enterprise on the 14th and 21st of January. Notices are also posted at City Hall and on the city website. Questions are due by the end of this week. A time line will be established. Ms. Bowers asked about what about those that expressed interest in the commission by the end of last year. Mr. Larick said that they will need to fill out the questionnaire and the Clerk will send it to them once it is prepared. Meeting adjourned at 7:25 p.m. City of Gahanna Page 3
