CALL MEETING TO ORDER/PLEDGE OF ALLEGIANCE/ROLL CALL. Gahanna Planning Commission met in Regular Session in the Council Chambers of City Hall, 200 South Hamilton Road, Gahanna, Ohio on Wednesday, September 24, 2014. The agenda for this meeting was published on September 19, 2014. Chair Tom Wester called the meeting to order at 7:03 p.m. with the Pledge of Allegiance led by Commission Member Shepherd. APPROVAL OF MINUTES: 2014-0138 Regular Meeting Minutes - September 10, 2014 Attachments: Sept. 10 Regular Meeting Minutes A motion was made by Shepherd, seconded by Rosan, to approve the minutes of the September 10 Regular Meeting. HEARING OF VISITORS - ITEMS NOT ON AGENDA. E. APPLICATIONS/PUBLIC HEARINGS: Chair stated Public Hearing Rules that would govern all public hearings this evening. Assistant City Attorney Thomas L. Weber administered an oath to those persons wishing to present testimony this evening. V-0016-2014 To consider a variance application to vary Section 1137.08(c) of the Codified Ordinances of the City of Gahanna; to allow a side yard width to be less than 20'; current zoning is Estate Residential (ER-2); for property located at 620 Havens Corners Road; Todd M. Parker, applicant. Attachments: V-16-2014 620 Havens Corners Rd - Agenda Packet V-0016-2014 Legal Ad V-0016-2014 CPO letter Development Dept. Presentation 9-24-2014 Michael Blackford, Deputy Director of Development said this is a request to vary section 1137.08(c) in Estate Residential zoning that provides a minimum side yard setback of 20'; the home was built in the 1950s with an encroachment; applicant is requesting a variance to build an addition further into the setback; aerial map displayed; street view displayed; home sits about 730' away from right of way; site plan of proposed addition displayed; total of 74 square feet encroaching 5 feet into 20' setback; variance criteria reviewed; staff believes special circumstances criteria is met; lot slopes approximately 30' to Rocky Fork Creek; contour map displayed; this is the only location an addition could be constructed; applicant provides variance is necessary because of age of home; this house is significantly separated from other development; neighboring dwellings and distances displayed. Chair opened the public hearing at 7:09 p.m. and asked for proponents. Todd Parker, P.O. Box 86, New Albany; architect for owners of property; nothing to add to presentation; pretty simple; house was built before that zoning code was put in place; feel this is the best way to preserve some significant trees on property and give owners what they want from property. Chair asked for opponents. The motion carried by the following vote: Yes: 6- Keehner, Price, Burba, Shepherd, Wester and Rosan Absent: 1- Andrews CU-0007-2014 To consider a Conditional Use application for an additional 2-year extension of a Conditional Use previously approved in 2012 and 2010; for the temporary stockpiling of construction materials for roads and lots; for property located at 1000 Bricklawn Avenue; Reklamation, LLC, applicant. Attachments: CU-7-2014 Reklamation, LLC - 1000 Bricklawn Ave - Agenda Packet Reklamation Supplemental Docs - Distributed Sept. 10, 2014 Haul Road Procedures - Submitted Sept. 18, 2014 Development Dept. Presentation 9-24-2014 Blackford said a workshop was held on September 17; discussed how site operates; talked about "no truck" sign on Enterprise Drive; there was a request for applicant to provide dust control policy; that was provided; discussed code violation history and possible extension of Bricklawn Avenue; "no truck" sign displayed; City Engineers did research on Bricklawn Avenue extension and it is not owned by City; would have to work out agreement for access with property owner; request is for 2 years; was granted previously; staff would like to add one condition that is if they are going to be approved, that next request provides update on progress made on filling site and readying for development. Chair opened the public hearing at 7:14 p.m. and asked for proponents. Michael Schaeffer, 88 W. Mound Street, attorney for applicant, said did have meeting last week; exchanged information; one of the things that was positive was putting together written policy regarding road maintenance; this will hold an individual responsible for procedures; spread more millings (shavings from asphalt) in last 2 weeks; millings compact and that makes Bricklawn entrance more appealing than Enterprise; regarding progress reports, that would be fine; we can update where we stand at any time; at this point, we are compacting and spreading dirt; one of the biggest problems is over $200,000 spent in testing wells; there are steps that have to take place that take time to be able to build on property. Chair asked for opponents. There were none. City of Gahanna Page 3 Planning Commission Meeting Minutes September 24, 2014 Shepherd asked to the best of your knowledge, what's your timeframe for completion. Steve Geiger, 1780 Reynoldsburg-New Albany Road, Blacklick, said 2 to 4 years; the landfill is a 23-acre parcel; the Environmental Protection Agency (EPA) will not split parcels; past closure phase; after closure, the site has to be usable; authorized to work under a #13 authorization from EPA; then we go into No Further Action stage. Shepherd asked what the chances are of this not being finished in 4 years. Geiger answered with current economy and dirt flow, it is extremely feasible that 4 years would finish the project. Shepherd asked about economy affecting the project. Geiger said most dirt comes from new builds; that is an every day occurrence; have 22,000 yards coming from a cemetery but consistency of daily stuff is what counts. Keehner asked if most of the builders are from the region. Geiger said they are primarily from Franklin County. Keehner said most building seems to be happening in southern Delaware County. Burba asked about existing loan; is that tied to a time period; do you have that term tied to what we do. Windy Geiger-Steiner, 173 James Road, said the OWD loan is not tied to time frame; there are certain steps they want to see done; want testing done; currently working on that; that just got approved in February; phase 2 is an audit of the land; is a 5-year note. Burba confirmed there is no way they could accelerate the note. Geiger said no; only thing tied to a time frame is the #13 authorization work; expired in July and was just renewed for another 3 years. Chair closed the public hearing at 7:25 p.m. Keehner said approve of this; this is a local business owner interested in reclaiming a landfill; catch-22 to City is dust and road maintenance issues bothering existing businesses. Burba agreed; think we should renew. Chair thanked Geiger for approach to doing this; is innovative; we as a Commission have to keep in mind the neighbors; updates as proposed in extension to December 31 are helpful to City; in support of this. A motion was made to approve the Conditional Use with the following stipulations: 1. The Conditional Use will expire Dec. 31, 2015 and 2. the applicant will provide additional evidence of progress between now and the expiration of this Conditional Use as to the ultimate goal of readying the City of Gahanna Page 4 Planning Commission Meeting Minutes September 24, 2014 property for No Further Action by the Environmental Protection Agency. The motion carried by the following vote. Yes: 6- Keehner, Price, Burba, Shepherd, Wester and Rosan Absent: 1- Andrews F. UNFINISHED BUSINESS: None. G. NEW BUSINESS: None. H. OFFICIAL REPORTS: City Attorney. No report. City Engineer. Wetherholt said this is his last night meeting; has been a pleasure working with all of you; will send word of how great retirement is. Chair and Burba highly recommended it. Department of Development. No report. Chair. Chair welcomed the Boy Scouts. Brian Davis, Troop 799, said here for citizenship and community badge; seeing how issues are debated, taking notes and listening; you guys are efficient. I. CORRESPONDENCE AND ACTIONS. FPU-0003-2014 A Flood Plain Use application for a culvert replacement as part of the Hamilton Road Right of Way; Karl Wetherholt, City of Gahanna, applicant. J. POLL MEMBERS FOR COMMENT. Price offered support of the Boy Scouts. Chair wished Wetherholt the best of luck and reminded the Commission of his celebration this Friday at 5:30 at Hannah Park. K.
