Gallatin Newspaper, Reporter Councilwoman Lynda Love called the meeting to order at 6:00 P.M. Approval of Minutes Councilwoman Love presented the March 13, 2018 Committee Minutes for approval. Councilman Fennell made motion to approve; Councilman Hayes seconded. Motion carried with 7 ayes and 0 nays. 05/18/18 Council Work Session Agenda-Page 2 Council Committee Minutes April 24, 2018 Public Recognition Councilwoman Love opened public recognition.  Joe Debord of 1007 Hart Street spoke about the following: o He was in favor of Councilman Mayberry’s suggestion to look at the projects that have not been started. o He spoke about building houses close to power lines. o He said Center Street needs the culverts and drainage ditches cleaned out. He asked the police department to install a camera to find out who the people are leaving the furniture and garbage along the street. With no one else wishing to speak Councilwoman Love closed public recognition. Mayor’s Comments Councilwoman Love called for Mayor’s Comments.  Mayor said last Saturday the Gallatin Beautiful Committee had 70 volunteers that picked up over 650 pounds of trash behind the Kroger Shopping Center along Green Wave Drive.  Mayor Brown said Jim Hentschel and Tim Thompson were awarded the State Award for Media and Public Relations for their “City of Silence Series” at the State DAR Convention this past Friday night.  Mayor asked Council to remember the family of DeEbony Groves, a victim of the Waffle House shooting. Ms. Groves was from Gallatin and an outstanding student at Gallatin High School and was soon to graduate from Belmont University. Ms. Groves worked for the city at the Parks and Recreation Department.  Mayor also announced the passing of David Coode with Kimley Horn. Mr. Coode had worked with Gallatin for many years and has done great things for Gallatin. 2 05/18/18 Council Work Session Agenda-Page 3 Council Committee Minutes April 24, 2018 Agenda 1. Resolution Reappointing Allen Ramsey to the Gallatin Health, Educational, and Housing Facilities Board Special Projects Director Rosemary Bates presented the reappointment of Allen Ramsey to the Gallatin Health, Educational and Housing Facilities Board. Vice Mayor Overton made motion to approve; Councilman Hayes seconded. Motion carried with 7 ayes and 0 nays. 2. Proposed Development of a Five Acre Parcel for Pinnacle Development Co. and Right-of-Way Establishment for an Extension of Clear Lake Meadows Boulevard Assistant City Planner Rob Kalisz explained the developer is requesting a five (5) acre parcel for 30 town homes/condos on the south side of Nichols Lane. Mr. Kalisz stated that staff requested the applicant to establish a right-of-way for the extension of Clear Lake Meadows Boulevard. Mr. Kalisz stated that the applicant wished to weigh the Council’s intent on acquiring the right-of-way in the next couple of years. He added that the applicant does not have to build a public right-of-way for the development but he may be required to set aside some right-of-way. Vice Mayor Overton stated former Councilman Tommy Garrott had this idea. Vice Mayor Overton said there’s a lot of acreage on Lock Four Road that is going to develop and we need another road to get in and out. We need this right-of-way for this. City Engineer Nick Tuttle said the reason they are here tonight is to understand if Council is intent on acquiring the right-of-way two or three years later as they try to develop the property. Mr. Tuttle said before they continued on to the Planning Commission they want to know how they should proceed; to plan for the right-of-way or not plan for the right-of-way. Council discussed needing the right-of-way to build another road in the future. Mr. Tuttle stated the city needs it and his recommendation is to reserve that land. He added that it is on our major thoroughfare plan and it’s an important roadway for the city to access that area between Lock Four Road and 109. 3 05/18/18 Council Work Session Agenda-Page 4 Council Committee Minutes April 24, 2018 Mr. Tuttle explained that when they come forward with a plan the city must make a decision within 30 days of whether or not we want to acquire the property. We only have to say “yes we want it” and it must be shown on the plat and when they record the plat the city has two (2) years to acquire the property from that owner. He said it would be an expense to the city. Andy Leath of GreenLid Design, stated he represents the current owner, Pinnacle Development Company Randy Durham. Mr. Leath said Mr. Durham is not trying to fight this but he’s just trying to make his plans. He said this will be back before Council because what they want to do will require a rezoning. There was also discussion on the 60 foot right-of-way and acquiring some land from the Nursery next door to get the rest of the right-of-way. Discussion continued. Mr. Leath stated that if council is going to acquire this property and hold up the development for two (2) years, then Mr. Durham will work with you to trade something out. Council continued to discuss. 3. Continued Discussion of FY 2018/2019 Budget Councilman Mayberry asked City Engineer Nick Tuttle about a list of projects presented earlier this year and the progress on these projects. Mr. Tuttle explained the status of the 2014 Bond projects and the 2016 Bond projects. Mr. Tuttle said he has not moved forward with the $1.5 million South Water Improvements project because of all the other projects and this one is not an urgent need. He said he would be okay with allowing this money to go toward something else. Much discussion continued. Councilman Mayberry made motion to amend to take $900,000 from the 2016 Bond and fund SR 174 & Belvedere, Airport Road & Coles Ferry intersection, South Westland Sidewalk and Commerce Way improvements; Councilman Hayes seconded. Finance Director Rachel Nichols stated this is legal and within the bond perimeters. Councilwoman Love called for the vote. Motion carried with 7 ayes and 0 nays. 4 05/18/18 Council Work Session Agenda-Page 5 Council Committee Minutes April 24, 2018 Mayor Brown requested Council add $40,000 for mowing at the City Cemetery and a $5,000 contribution for city participation in Forward Sumner. Councilman Mayberry made motion to approve adding $45,000 for mowing at City Cemetery and contributing to Forward Sumner; Vice Mayor Overton seconded. Motion carried with 7 ayes and 0 nays. There was discussion on the City of Hendersonville also applying for the SAFER Grant. Fire Chief Victor Williams said he has also applied for the SAFER Grant but he has a Plan B and Plan C if we do not receive the SAFER Grant. Councilman Mayberry requested information on group homes in Gallatin. Other Business Councilwoman Love opened other business.  Vice Mayor Overton asked Assistant Planner Rob Kalisz for an update on the bathrooms at the swimming pool. Vice Mayor Overton said he understood this was in Planning for approval. Mr. Kalisz said Planning requested Mr. Brown submit an application with a site plan and elevations. Mr. Kalisz said he spoke with Mr. Brown today and he was going to submit these. Discussion continued.  Councilman Fennell spoke about apartments that were approved many years ago. Councilman Fennell said there were apartments approved back in the Cages Bend/Nashville Pike area back in 1998 that do not have to come back to council unless there’s a major amendment. There was much discussion. City Attorney Susan High-McAuley recommended hiring experts to help with infrastructure and different things. Much discussion continued. Assistant Planner Rob Kalisz said the property was rezoned in 1985 and back then a Master Development Plan was not required. He added that in 1998 the property was rezoned to MRO and a Master Development Plan was required. 5 05/18/18 Council Work Session Agenda-Page 6 Council Committee Minutes April 24, 2018 Discussion continued. Ms. High-McAuley stated this property is probably vested because it happened so long ago. She added that the property keeps the rights that it had at the time it was made and there may not be much the city can do. Council continued to discuss. Councilman Mayberry said many of these properties that we’re talking about tonight were voted on and rezoned many years. Discussion continued.  Mayor asked Council if they wanted to change the Council meeting on July 3rd. Councilman Fennell made motion to cancel July 3rd Council meeting; Councilman Alexander seconded. Motion carried with 7 ayes and 0 nays. Councilman Mayberry suggested that if there was a need for a Special Called Council Meeting that it could be before a Committee Meeting.  City Attorney Susan High-McAuley informed Council that the Governor signed the Term Limits bill today and the Hotel Tax bill is on his desk waiting to be signed. Councilman Hayes left the meeting at this time. Department Head Reports  City Engineer Nick Tuttle reported on the storm water utility ordinance. Mr. Tuttle said the advertisement will run in the newspaper next Thursday and it should be on the work session agenda at the end of May and the first reading of the ordinance will be in June.  Finance Director Rachel Nichols presented the annual professional services audit contract. Councilman Alexander made motion to approve; Vice Mayor Overton seconded.
