Ms. Borders said a website and brochure has been created and they have applied for their 501(3)@ designation. Ms. Borders requested more time and provided handouts for council. a Johnny Griffin of 657 North Water also spoke about Randy's Record Shop. Mr. Griffin said Randy's Record Shop is known worldwide and is an asset to the city. a Jeff Hollins of 9048 Lower Station Camp Road stated he was not against the development next to his property but he did have some concerns about drainage, head walls, and trees along the property lines. Mr. Hollins asked to be more involved in the developments surrounding his properties. With no one wishing to speak Mayor closed public recognition. Resolution #R1905-25 Councilman Fann presented this resolution creating a new personnel rule relating to personal relationships. Councilman Fann made motion to approve; Councilman Hayes seconded. Resolution #R1905-28 Councilwoman Love presented this resolution of the City of Gallatin, Tennessee supporting a Notice of Intent to file an application for a Multimodal Access Grant from the Tennessee Department of Transportation for the development of multimodal improvements in the City. Councilwoman Love made motion to approve; Councilman Alexander seconded There was much discussion Councihnan Overton made motion to select the Nashville Pike project; Councilman Fennell seconded. Dangerous Bqilding - 321, West Main S'tfeet - Randy's Record Shop Building Codes Official Chuck Stuart stated there is nothing new to add; this is still a dangerous building with more deterioration of the building. Mr. Stuart also stated he has received the asbestos report on the building. City Attorney Susan High-McAuley said council has granted several extensions and needs to determine the next step. Council discussed Council was in agreement to allow Tisha Borders to speak Ms. Borders said she has filed for their 50L@ (3) status and the nonprofit corporation was established last November. She explained their challenges for raising money and the need for more time. Councilman Overton made motion to extend two (2) weeks and provide a viable plan to raise the money; Councilman Fennell seconded. Motion carried with Councilman Hayes, Councilman Overton, Councilman Fennell, Councilwoman Love and Vice Mayor Camp voting aye, Councilman Alexander voting nay and Councilman Fann abstaining. Other Business Mayor Brown opened other business a Building Codes Official Chuck Stuart said he has two (2) additional dangerous buildings that did not get on tonight's agenda. Mr. Stuart presented another dangerous building at361St. Luke. Mr. Stuart said this property may go on the tax sale in August. City Attorney Susan High-McAuley said all owners have been notified and one of the owners is in bankruptcy represented by an attorney. Ms. High-McAuley said they have turned this property over to Sumner County to be sold at the tax sale. Councilman Overton rnade motion to move this dangerous building to after the August 7t11tax sale; Councilman Hayes seconded. Motion carried with 7 ayes and 0 nays. 5 07/16/19 Council Meeting Agenda-Page 6 City Council Minutes June 18,2019 a Mr. Stuart stated the other dangerous building is at 410 Pace Street and the owner Vincent Malone is here tonight. Mr. Stuart asked council to give Mr. Malone two (2) weeks to submit his plan, get his permit and give him a projected start date of 30 days to start the reconstruction of the structure. Councilman Alexander made motion to allow Vincent Malone two (2) wccks to submit his plan and 30 days to work on the project; Councilman Overton seconded. Motion carried with7 ayes and 0 nays. Public Recoenition on Non- Asenda Related Items Mayor Brown opened public recognition on non-agenda related items. o Patrick Reeners spoke in favor of Randy's Record Shop and the movement of vinyl records that's coming back. Mr. Reeners thanked council for giving Randy's Records another chance. He also spoke about other homes in Gallatin with asbestos. o Frank Marchese of 589 Harris Lane spoke about his concerns of the traffic island. Mr. Marchese said the right onto Long Hollow is extremely narrow and it's very hard for trucks to navigate. He provided pictures of tire tracks going over the island. Mr. Marchese said he spoke with City Engineer Nick Tuttle and he is going to speak with someone about the island. Mr. Marchese also asked about blasting in the area. FIe asked who grants the blasting permits and who is responsible for possible damages to your home or street? Fire Chief Victor Williams said the blasting perrnits are granted by the state and thc City Firc Dcpartmcnt. Mayor directed Mr. Marchese to speak with Fire Chief Williams about any blasting questions. a Kesha Brinkley of 363 Paradise Street said some Gallatin Police Officers came to her home last Friday and they messed up her shoulder. RECOMMENDATION: ATTACHMENT: olution Correspondence Bid Tabulation Ordinance Contract Other Approved Rejected Deferred Notes: 07/16/19 Council Meeting Agenda-Page 17  ORDINANCE NO. 01997.36 ORDINANCE AMENDING GALLATIN MUNICIPAL CODE CHAPTER 1I, ARTICLE V, PEDDLERS, SOLICITORSO TRANSIENT VENDORS WHEREAS, it is deemed in the public interest to amend the Gallatin Municipal Code from time to time; and WHEREAS, The Mayor and City Council have recommended that the City of Gallatin Municipal Code be amended regarding peddlers, solicitors and vendors. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, that the Gallatin Municipal Code, Chapter 11, Article V be amended as follows: ARTICLE V - ihe title of Article V shall be amended by deleting the words "itinerant vendor" and replacing those words with the words "transient vendors" such that the title of the article reads "Peddlers, Solicitors, Transient Vendors. Sec. I 1-134 Definitions. Section II-134 shall be amended by deleting section (5) "street barkers" from the definitions. Section 11-136 - Permit required. Section Il-136 shall be amended by deleting the words "street barker" from the section such that the section reads: "No person, firm or corporation shall operate a business as a peddler, transient vendor or solicitor, and no solicitor for subscriptions shall solicit within the city unless the same has obtained a permit from the city in accordance with the provisions of this chapter." Section ll-137 - Permit procedure. Section ll-137 shall be amended by adding a new subsection (14) as follows: .,(14) Statement that the applicant is not a registered sex offender." Section 11-138 - Restrictions on peddlerso street barkers and solicitors Section 1 1 - 1 3 8 shall be amended by deleting the words "street barkers," and all references thereto, by deleting section (5) in its entirety and replacing it, and by deleting section (8) in its entirety, as set forth below: Section 11-138. - Restrictions on peddlers and solicitors No peddler, solicitor, or solicitor for subscriptions shall 07/16/19 Council Meeting Agenda-Page 18  (5) It shall be unlawful for any peddler or solicitor to call upon any premises or other place between the hours of dusk and 9:00am; to enter in or upon any premises or to attempt to enter in or upon or to call upon any place where the owner, occupant or person legally in charge of the premises has posted at the entry the words "No Solicitation" or words or symbols of similar meaning; to call upon any entrance to a residence other than the front door; or to remain on any premises after being asked to leave by the owner, occupant or other person having authority over such premises. (8) Deleted. Section l1-140. - Display of permit. Section 11-140 shall be amended by deleting the words "street barker." As follows: Section I 1-140 Each peddler, solicitor or solicitor for subscriptions is required to have in his possession a valid permit while making sales or solicitations, and shall be required to display the same to any police officer upon demand. Section ll-142. - Expiration and renewal of permit. Section Il-142 shall be amended by deleting the third sentence, related to expiration of permits for street barkers, in its entirety, such that Section 11-142 shall read as follows: The permit of peddlers, solicitors and transient vendors shall expire on the same date that the permit holder's privilege license expires. The registration of any peddler, solicitor, or transient vendor who for any reason is not subject to the privilege tax shall be issued for six (6) months. The permit of solicitors for subscriptions shall expire on the date provided in the permit, not to exceed thirty (30) days. RI9A73O RESOLUTION AUTHORIZING GALLATIN MORNING ROTARY CLUB TO INSTALL TWO PAVILIONS AND ONE BBQ GRILL IN ROTARY PARK (LIBERTY BRANCH) WHEREAS the City has worked for several years with the Gallatin Morning Rotary Club to reopen what was previously called Liberty Branch Park; and WHEREAS, Gallatin Morning Rotary has installed landscaping, picnic tables, an asphalt entrance road and has maintained the park since re-opening; and WHEREAS, the City and U.S. Army Corps of Engineers (USACE) previously approved a preliminary plan for the park that includes pavilions; NOW THEREFORE BE IT RESOLVED, that the Gallatin City Council authorizes the Gallatin Morning Rotary Club to install two pavilions and one BBQ grill in the park with the conditions that the USACE approves the final plans for the pavilion and BBQ grill, and that the Gallatin Morning Rotary Club performs all repairs, maintenance and clean-up of the areas with no expectation of assistance from the City; and BE IT FURTHER RESOLVED thatthis Resolution shall take effect from and after its final passage the public welfare requiring such. Details are in the attached letter from current Morning Rotary President Larry Wise. Also attached is the preliminary plan for the park approved by the City Council and by the U.S. Army Corps of Engineer. Additionally, Mr. Wise provided photos of the pavilion at Nat Caldwell park as an example. If the Council agrees to this request, the plans will be submitted to, and approved by, the U.S. Army Corps of Engineers. Mr. Wise said Morning Rotary would be responsible for all costs and all continued maintenance.
