Ms. Borders requested more time and provided handouts for council. o Nicki Nobles stated her father was Gene Nobles. Ms. Nobles said her father helped start Randy's mail order business and asked council to help save this building. a Johnny Griffin of 657 North Water also spoke about Randy's Record Shop. Mr. Griffin said there is a similar project in Muscle Shoals that was successful in their restoration efforts. He asked the city to work with them on this project. Ordinance #0-|.907-32 - First Readine Vice Mayor Camp presented this ordinance appropriating 9438,764 from Engineering to Street Lighting and Traffic Signals. Resolution #R1907-29 Councilman Fann presented this resolution appointing Haley Meredieth to the Gallatin Electric Power Board. Councilman Fann made motion to approve; Councilman Alexander seconded, Motion carried with 6 ayes and 0 nays. J City Council Minutes July 2,2019 4. Danserous Buildine - 32'1, West Main Street - Randv's Record Shop City Attorney Susan High-McAuley stated there is nothing new to add concerning Randy's Record Shop; it's up to council to make a decision. Building Codes Official Chuck Stuart also stated he has no new information concerning Randy's Record Shop. Councilman Overton made motion to suspend the rules to allow Tisha Borders to speak; Councilwoman Love seconded. Motion carried with 6 ayes and 0 nays. Tisha Borders said they are working on getting contributions. Ms. Borders said Vinyl Press has expressed an interest especially since they want to sell records again like back in the 1950's and 60's. Mayor said the 50103 has been formed but the designation from the IRS has not been received. Ms. Borders asked council if their main concern is getting the building stabilized. Councilman Hayes stated no because there has not been any money raised for this project. Much discussion continued. Johnny Griffin said he thought the main hang up orl raising money is that people do not see any work happening on the building. He added that once people see something happening to the building they will donate. Mr. Griffin said the new owners have agreed to work with thern on lestoring this building. He said his goal is to save this building for the benefit of Gallatin. Discussion continued. Councilman Alexander said he applauded the efforts of Mr. Griffin and the others but at this stage it's too late to save the building. Ms. Borders said she felt the hang up for people to clonate to this project is they are waiting for the tax exempt designation. Mr. Stuart said the building will have to be elevated because it's in the flood plain and he also had questions about the other attached building. 4 City Council Minutes July 2,2019 Discussion continued on fundraising and flood proofing the current building. Councilman Alexander made motion to demolish the building; Councilman Hayes seconded. Discussion continued Mayor asked for a roll call vote City Recorder Connie Kittrell called for the roll call vote: Vice Mayor Camp No Councilman Alexander Yes Councilman Fann Abstained Councilman Hayes Yes Councilwoman Love No Councilman Overton Yes Mayor stated the motion passes with 3 ayes, 2nays and 1 abstention. Mayor said council needs to set a time frame for the dernolition. Ms. High-McAuley stated the vote rnust pass by a majority. She said the abstention counts as a yes vote so the motion passes. Mr. Stuart said the city normally goes with 30 days to start the demolition process. Councilman Overton made motion to allow 90 days before the demolition process begins; Councilman Hayes seconded. Discussion continuecl Mayor called for the vote. Motion carried with 6 ayes and 0 nays. Other Business Mayor Brown opened other business. a City Attorney Susan High-McAuley provided a letter forwarded to her regarding our solicitation ordinances. Ms. High-McAuley said the city will need to amend these ordinances. She said there is an issue with the curfew and the "Do not solicit" list. 5 City Council Minutes Jvly 2,2019 Council discussed a Finance Director Rachel Nichols provided an ordinances allocating the funds to purchase the three (3) properties. Councilman Overton made motion to approvc; Councilwoman Lovc seconded. Mayor called for a roll call vote. Mr. Brown said there is one at the dog park and one at the disc golf course. He said the problem is that there are no water lines in some areas to install the fountains. He said they are working on getting some water lines run. a Councilman Overton said the "Fishing Derby" has been tnoved to July 20th and Liberty Baptist Church is having their Fish Fry on luly 13tt.' from 2:00 to 6:00 P.M. With no one wishing to speak Mayor closed other business Public Recosnition on Non-Aqenda Related Items Mayor Brown opened public recognition on non-agenda related items 6 City Council Minutes Jttly 2,2079 a Patrick Reeners of 317 Malone Drive said if council stopped adding toxic fluoride waste to the drinking water for'1,6 years at $25,000 a year the city could pay their $1 million. Mr. Reeners said one of his problerns with the city is that the city police are violating more laws than thc citizcns. Hc said thc body and dash cams are not being recorded according to city policy. He said there are audio recordings that are supposed to be made to protect the police department and our citizens that are not being recorded. He said the police department is actually harassing the people they are supposed to be protecting. Mr. Reeners said the city needs to help Randy's Record Company. He said to take the fluoride out of the water and put the money spent on it and pay for the Record Company. Mr. Reeners said everyday he wants every dash cam, every body cam, every recording from every officer. He said if he didn't get those requests justice was being obstructed and he was going to the Federal Court House and pressing charges on the police. a Joe Debord of 1,007 Hart Street said Mayor Brown is a #1 promoter for the City of Gallatin. Mr. Debord presented a check to Ms. Kittrell for his wastewater fee for the entire year. He asked if the city pays themselves back from the stormwater fees that are collected. He also asked for a sidewalk in front of his house. Other Business Mayor Brown opened other business. a Councilman Alexander spoke about the need to increase membership for the Senior Citizens Center. Mayor Brown informed council that a Senior Citizens Roundtable was started about five (5) or six (6) months ago and they have established some objectives and goals. Mayor said they are starting to form committees to address some issues; connecting seniors in our cornmunity, transportation for seniors and places for seniors to gather. Mayor spoke about putting information about the Senior Center in the utility bill newsletter. a Public Works Director Zach Wilkinson said his departrnent has been behind in brush pick-up due to the increase brush frorn the recent storrns. Mr. Wilkinson presentecl a solution to help with this issue. He said he has been working witl'r the Resource Authority to utilize the city property on Steam Plant Road to stage the brush to speecl up the pick-up and not have to wait at the scales. He said this will be on a temporary basis at this time. Mr. Schmit said he has been a longtime advocate for reducing the volume, the speeding, the noise, the pollution and blatant disregard for traffic signs on Belvedere and Peninsula Drive. He said the GPS routes individual drivers off the main highway down these streets to cut through the neighborhood. Mr. Schmit and other neighbors went door to door along Peninsula Drive to get signatures on a petition. He said there are 65 out of 66 residents that signed the petition. Mr. Schmit said he presented the petition to City Engineer Nick Tuttle on July Btr.. He asked for a solution to all these issues on Belvedere and Peninsula Drive. ODA735 ORDINANCE APPROPRIATING FUNDS IN THE AMOUNT OF $206'836.00 FOR INSTALLATION OF A TRAFFIC SIGNAL AT BLUE JAY WAY AND NASHVILLE PIKE WHEREAS, the City approved the Lowe's development with the agreement that a traffic signal would be installed at Blue Jay Way and Nashville Pike once traffic warrants were met; and WHEREAS, the agreement with Lowe's required that Lowe's pay for the signal; and WHEREAS, traffic count has achieved the level warranting atraffrc signal; and WHEREAS, despite the City's repeated requests, Lowe's has failed to forward payment to the City for the traffic signal; and WHEREAS, the City has determined to appropriate money for the traffic signal to ensure the bid does not exPire; and WHEREAS, the City will continue to take steps to seek reimbursement from Lowe's for the traffic signal to ensure Lowe's performance obligations are met. As mentioned in a previous Council Work Session, we would like to discuss moving ahead with construction of the signal while the City Attorney's office communicates with Lowe's about their obligation to pay for the signal and associated costs' RECOMMENDATION: ATTACHMENT: Correspondence Bid Tabulation Ordinance Contract Other Approved Rejected Deferred Notes:  ORDINANCE NO. 01997.36 ORDINANCE AMENDING GALLATIN MUNICIPAL CODE CHAPTER 11, ARTICLE V, PEDDLERS, SOLICITORS, TRANSIENT VENDORS WHEREAS, it is deemed in the public interest to amend the Gallatin Municipal Code from time to time; and WHEREAS, The Mayor and City Council have recommended that the City of Gallatin Municipal Code be amended regarding peddlers, solicitors and vendors. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, that the Gallatin Municipal Code, Chapter 11, Article V be amended as follows: ARTICLE V - The title of Article V shall be amended by deleting the words "itinerant vendor" and replacing those words with the words "transient vendors" such that the title of the article reads "Peddlers, Solicitors, Transient Vendors. Sec. 11-134 Definitions. Section ll-134 shall be amended by deleting section (5) "street barkers" from the definitions. Section 11-136 - Permit required. Section II-136 shall be amended by deleting the words "street barker" from the section such that the section reads: "No person, firm or corporation shall operate a business as a peddler, transient vendor or solicitor, and no solicitor for subscriptions shall solicit within the city unless the same has obtained a permit from the city in accordance with the provisions of this chapter." Section ll-137 - Permit procedure. Section lI-137 shall be amended by adding a new subsection (14) as follows ,.(14) Statement that the applicant is not a registered sex offender." Section 11'138 - Restrictions on peddlersn street barkers and solicitors Section 11-138 shall be amended by deleting the words "street barkers," and all references thereto, by deleting section (5) in its entirety and replacing it, and by deleting section (8) in its entirety, as set forth below: Section 1l-138. - Restrictions on peddlers and solicitors No peddler, solicitor, or solicitor for subscriptions shall:  (5) It shall be unlawful for any peddler or solicitor to call upon any premises or other place between the hours of dusk and 9:00am; to enter in or upon any premises or to attempt to enter in or upon or to call upon any place where the owner, occupant or person legally in charge of the premises has posted at the entry the words "No Solicitation" or words or symbols of similar meaning; to call upon any entrance to a residence other than the front door; or to remain on any premises after being asked to leave by thc owner, occupant or other person having authority over such premises. (8) Deleted Section 11-140. - Display of permit. Section I l-140 shall be amended by deleting the words "street barker." As follows Section 1 1-140 Each peddler, solicitor or solicitor for subscriptions is required to have in his possession a valid permit while making sales or solicitations, and shall be required to display the same to any police offtcer upon demand. Section ll-142. - Expiration and renewal of permit. Section ll-142 shall be amended by deleting the third sentence, related to expiration of permits for street barkers, in its entirety, such that Section Il-142 shall read as follows: The permit of peddlers, solicitors and transient vendors shall expire on the same date that the permit holder's privilege license expires. The registration of any peddler, solicitor, or transient u"rio1. who for uny reuron is not subject to the privilege tax shall be issued for six (6) months' The permit of solicitors for subscriptions shall expire on the date provided in the permit, not to exceed thirty (30) days.
