No one appeared on behalf of the estate of Nancy Banks to testifo before City Council. Based upon the record of notices, correspondence, photographs, staff report, statements before the Council, and the record as a whole, the City of Gallatin, Tennessee, did find that said structure is a dangerous building and unfit for human occupation or use pursuant to Gallatin Municipal Cocle, Section 5-242 and Tenn. Code Ann. Sec. 13-21-101, et. seq. The City Council of the City of Callatin specifically finds the structure in a dangerous building and unfit for hurnan occupation or use for the following reasons: structure is unsanitary, unsecured and unsafe; garbage joists; and rubbish accumulation; burned and water damaged floor joists; water damaged ceiling broken wall framing; broken windows, sills and screens; and broken and water damaged door and frames. The fire started at a generator the homeowner was using for temporary power. The house has no power and cannot be lived in without power. The water meter has been pulled and the power has been cut at the pole' ls there anything we can do to get this guy out of the house. I have told him repeatedly that he can not be panel in the house without running water and electricity. HE hard wired a plug into the box from the generator. I am afraid he is going to kill himself' This house is in probate court as the Banks passed away several years ago leaving the house to their daughter. She has since died and has 2 children that now have ownership of some variety. The probate case is still open and the house has not been deeded to the children at this point.
