The Gallatin City Council met in regular session on Tuesday, November 2,202'1, in the
Dr.J. Deotha Malone Council Chambers Gallatin City Hall. Mayor Paige Brown called
the meeting to order at 6:00 P.M. Councilman John D. Alexander led the opening prayer
and Councilman Jimmy Overton led the pledge of allegiance.

REZONING 10.72 +/- ACRES FROM THE PBP-PLANNED BUSINESS PARK DISTRICT
TO THE MRO-MULTIPLE RESIDENTIAL AND OFFICE DISTRICT AND APPROVAL
OF A PRELIMINARY MASTER DEVELOPMENT PLAN FOR OXFORD STATION,
PHASE 4, CONTAINING 51 MULTI-FAMILY RESIDENTIAL UNITS AND TWO (2) OPEN
spACE TRACTS, LOCATED SOUTH OF VTETNAM VETERANS BOULEVARD (SR 386)
AND WEST OF OFFIT DRIVE; AUTHORIZING THE REVISION TO BE INDICATED ON
THE OFFICIAL ZONING ATLAS; REPEALING CONFLICTING ORDINANCES;
PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owner of the property submitted a complete application to rezone 10.72 +l-
acres with a Preliminary Master Development Plan for Oxford Station, Phase 4, located in the City
of Gallatin, Tennessee; and
BE IT FURTHER ORDAINED, the zoning map amendment conforms to the general plan
of the area including the established Greenlea Business Center Community Character Area and that
the public necessity, convenience, and general welfare, will be served by approving the proposed
amendment; and
WHEREAS, the property proposed for rezoning has adequate public utilities, infrastructure
and private or municipal services necessary to serve the existing and proposed development and
population permitted by the requested zoning or such necessary services and facilities will be
provided upon development of the property; and
WHEREAS, the rezoning will be compatible with the surrounding environment and will
protect the public health, safety and welfare and will not be injurious to other property or
improvements in the area in which the property is located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and did not recommend
approval of the proposed rezoning with Preliminary Master Development Plan; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
ZoningOrdinance and Tenn. Code Ann. $ 13-7-203; and
WHEREAS, the City Council approved by majority vote ofthe members present the rezoning
request ofthe described property; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GALLATIN, SUMNER COUNTY, TENNESSEE as follows:
Section 1. The City Council of the City of Gallatin does hereby rezone 10.72 +l- acres from
the PBP-Planned Business Park District to the MRO-Multiple Residential and Office District as
described in Exhibit "A" and approves a Preliminary Master Development Plan for Oxford Station,
Phase 4, as described in Exhibit 'B'.

Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City's Official ZoningAtlas to show the classification for the area as hereby
rezoned.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provisions or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon passage, the public
welfare requiring such.

WHEREAS, the zoning map amendment conforms to the general plan of the area including
the Greenlea Business Center Community Character Area and that the public necessity,
convenience, and general welfare, will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning has adequate public utilities, infrastructure
and private or municipal services necessary to serve the existing and proposed development and
population permitted by the requested zoning or such necessary services and facilities will be
provided upon development of the property; and
WHEREAS, the rezoning will be compatible with the surrounding environment and will
protect the public health, safety and welfare and will not be injurious to other property or
improvements in the area in which the property is located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and recommended
approval of the proposed rezoning with Preliminary Master Development Plan in GMPC Resolution
No. 2021-l 12; and
WHEREAS' a public hearing was held following public notice as prescribed by the Gallatin
ZoningOrdinance and Tenn. Code Ann. $ l3-7-203; and

with job number 20.105G, dated February 8, 2021, with a revision date of October 27,2021, and
three (3) sheets of site rendering, prepared by Kimley Horn of Nashville, TN, dated September 8,
2021, and with the following conditions:
1. Revise the PMDP and update site data notes for PGC zoning on the commercial
portion of the development to prohibit the following uses in PGC:
r Automotive Parking;
o Limited Warehousing;
r Vehicular,Craft, and Related Equipment Sales;

In collaboration with the Economic Development Agency, the applicant requested at the Planning

of the site to PGC-Planned General Commercial. The residential portion of the master plan would be
rezoned to MU-Mixed Use, which is consistent with the initial request.
RECOMMENDATION:
On October 25,2021, the Gallatin Municipal Planning Commission recommended approvalto
rezone a portion of the master plan development site to PGC-Planned General Commercial zoning
and a portion of the master plan development site to MU-Mixed Use zoning with the Preliminary

fine or both.

the Gallatin City Council to determine whether the City shall proceed with necessary repair or

It has come to our attention that you have purchased the above referenced property. It was unlawful for
the previous owner to sell this property without disclosing that it has been designated as a Dangerous
Building and making arrangements to correct the noted problems.
On March 2,2020, a site inspection was performed by the Building Codes and/or Fire Prevention
departments of the City of Gallatin. The building or buildings at the above referenced location were found
to be dangerous and unfit for human habitation, based on the standards set forth in the Gallatin Municipal
Code, Chapter 5, Article IX.
l. Roof rafters decking and shingles are broken and water damaged

3. Debris and rubbish accumulation
4. Porches broken
5. Ceiling water damaged and falling in
The owner and/or occupants must vacate the building(s) immediately and the structure(s) must be secured
and remain vacant until all repairs are made or the structure(s) are demolished. Tennessee Code
Annotated, Title 68, Chapter 102-ll7 specifies that failure to comply with this order is considered a Class
B misdemeanor punishable by up to six months in jail or up to a $500 fine or both.
It has also been noted that you have begun work on this property without the proper building permit. You
should contact the City of Gallatin Building Official immediately to obtain the proper permit and to
provide an explanation of how you plan to conect the noted problems. If not, a Show Cause hearing shall
be scheduled before the Gallatin City Council to determine whether the City shall proceed with necessary
repair or demolition with costs assessed against the property as a lien.

SUMMARY:
This is an unsafe and unsecured building. The doors and frames are broken, the building was
boarded up but has since become unsecured with the material used to board up the property
removed. There is Debris and rubbish accumilation. The porches are broken. The roof rafters,
decking and shingles were broken and had water damage. The roof was in danger of collaping and
the ceiling was falling in, both with water damage. However since there has been a new roof
installed and second story work done, which a Stop Work Order was posted for work being
performed without a permit.

RESOLUTION NO. R2TI2-84
RESOLUTION TO AUTHORIZETHE GALLATIN X'IRE DEPARTMENT TO APPLY
FOR THE ASSISTANCE TO FIREFIGHTERS (AFG) GRANT
WHEREAS, the Gallatin Fire Department requests authority to apply for the Assistance to
Firefighters (AFG) grant; and
WHEREAS, the cost of the grant shall not exceed $1,000,000.00, the AFG grant would provide
$900,000.00 which is 90o/o of the total costs, and the City of Gallatin must match 10% of the costs, not to
exceed $100,000.00; and
WHEREAS, any fire service related grant expenditure shall be contingent upon approval of the
Gallatin Fire Department's AFG Grant Application;
NOW THEREFORE BE IT RESOLVED BY THE CITY OF GALLATIN, TENNESSEE, thAtthc
City Council hereby authorizes the Gallatin Fire Department to apply for the AFG grant; and
BE IT FURTHER RESOLVED that if awarded the AFG grant, the City of Gallatin is committed
to matching the requested funds of up to $100,000.00, which represents l0% of the total project costs; and
BE IT FURTHER RESOLVED, that the City will make necessary allocations in the budget to
fund these expenditures; and
BE IT FURTHER RESOLVED, that this resolution shall take effect from and after its final
passage, the public welfare requiring such'
