SUMMARY: The Ordinance requests the Tennessee General Assembly amend the Charter to allow the City to levy impact fees for new development. O23Ø7-43 ORDINANCE AMENDING ARTICLE II, SECTION 1 OF THE CITY OF GALLATIN, TENNESSEE CHARTER AS ESTABLISHED IN CHAPTER 67 OF THE PRIVATE ACTS OF 1953 AND AS AMENDED THEREAFTER TO ADD THE POWER TO LEVY IMPACT FEES ON NEW DEVELOPMENTS WHEREAS, the Charter of the City of Gallatin does not currently contain a provision allowing the levying of impact fees on persons or entities developing land within the corporate limits of the City; and WHEREAS, without the explicit authorization of the Tennessee General Assembly, the City of Gallatin does not have the authority to levy impact fees; and WHEREAS, the Tennessee General Assembly has provided other municipalities in the State the authority to levy impact fees; and WHEREAS, the City Council of Gallatin has determined it is in the best interests of the City and its taxpayers to impose impact fees on persons and entities developing land within the corporate limits, and WHEREAS, the governing body of the City of Gallatin requests the Tennessee General Assembly to amend the City of Gallatin’s charter to allow the City Council to levy impact fees, just as it has done for other municipalities within the State. NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, as follows: 1. Chapter 67 of the Private Acts of 1953, as subsequently amended, Article II, Section 1 is amended by adding the following language: 08/04/23 Council Work Session Agenda-Page 70 (41) Impact fees. The City Council shall have full power and authority to impose such fees on persons or entities developing land within the corporate limits as the city deems appropriate to pay the costs of capital improvements and other expenses related to such developments, including but not limited to improvements and expenses for street repair and construction, traffic signals, water services and/or facilities, stormwater and drainage facilities, storm drainage ditches, storm drainage sewer pipes, emergency services, parks and recreational facilities, garbage collection and/or disposal, and the providing of administrative services for the foregoing. 2. This Ordinance shall have no effect unless it shall receive final approval within the time required by law by a two-thirds (2/3) vote of the Gallatin City Council after passage by the Tennessee General Assembly.
