The Gallatin City Council met in a special-called session on Tuesday, January 23, 2024,
in the Dr. J. Deotha Malone Council Chambers at Gallatin City Hall. Mayor Paige
Brown called the meeting to order at 5:31 P.M.

AN ORDINANCE OF THE CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE,
ZONING A 5.18 +/- ACRE PARCEL (TAX MAP 112, PARCEL 43.01). TO THE R6 PRD
HIGH DENSITY RESIDENTIAL–PLANNED RESIDENTIAL DEVELOPMENT DISTRICT
WITH A PRELIMINARY MASTER DEVELOPMENT PLAN FOR MI HOMES BLEDSOE
SPRINGS, LOCATED NORTH OF HARTSVILLE PIKE AND EAST OF AIRPORT ROAD;
AUTHORIZING THE REVISION TO BE INDICATED ON THE OFFICIAL ZONING
ATLAS; REPEALING CONFLICTING ORDINANCES; PROVIDING FOR
SEVERABILITY, AND PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the owners of the subject property submitted a complete application to zone a
5.18 +/- acre parcel, located in the City of Gallatin, Tennessee; and
WHEREAS, the proposed zoning map amendment matches the recommendations of the
General Urban Character Area of PlanGallatin, and the public necessity, convenience, and the
general welfare, will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning will have adequate public utilities,
infrastructure and private or municipal services necessary to serve the existing and proposed
development and population permitted by the requested zoning or such necessary services and
facilities will be provided upon development of the property; and
WHEREAS, the proposed rezoning will be compatible with surrounding area and will
protect the public health, safety and welfare and will not be injurious to other property or
improvements in the area in which the property is located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and made a
recommendation for approval of the proposed zoning as described in GMPC Resolution No. 2023-
134; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
Zoning Ordinance and §13-7-203, T.C.A.; and
WHEREAS, the City Council approved by majority vote of the members present the rezoning
request of the described properties; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GALLATIN, SUMNER COUNTY, TENNESSEE AS FOLLOWS:
Section 1. The City Council of the City of Gallatin does hereby approve zoning a 5.18 +/-
acre parcel to the R6-PRD – High Density Residential Planned Residential Development District, as
described in Exhibit ‘A’ with a Preliminary Master Development Plan, as described in Exhibit ‘B’.

Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City’s Official Zoning Atlas to show the classification for the area as hereby
rezoned.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provision or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon adoption.

The rezoning shall be substantially consistent with the zoning of a 5.18 +/- acre parcel to the R-6
PRD High Density Residential Planned Residential Development district with a Preliminary Master
Development Plan for MI Homes Bledsoe Springs, consisting of a six (6) sheet plan, prepared by
GreenLID Design of Gallatin, TN, with project number 23.076G, dated September 12, 2023, with a
revision date of October 6, 2023, and a sixteen (16) page architectural patternbook prepared for
Bledsoe Springs Townhomes, with the following conditions:
1. Provide 35% open space to qualify this project as a PRD. Revise plan to show all
open space in common open space tract(s)/PUDE’s. Label acreage/square footage of
the common area. Common opens space tracts for recreation area shall exclude
private streets, driveways, and parking spaces.
2. Correct the zoning map and character map in the Pattern Book to the current city
maps.
3. Provide a legal description of property in Word .doc form for zoning prior to
Council Committee meeting.
4. Update the purpose and maintenance notes to identify this project as an HPR
development.
5. Correct the parking table on cover sheet to match parking shown on Sheet C2.0.
6. Correct the zoning of surrounding properties, including the zoning for Bledsoe
Springs.
7. Provide an alternate Type 35 bufferyard (40’ wide) on the northwest property
boundary adjacent to the IR zoning district. No portion of any unit or lot shall
encroach into this bufferyard.
8. Identify the greenway easement as 20’ wide. The greenway easement may extend
across the alternate Type 35 bufferyard.
9. Indicate an alternate Type 30 bufferyard (20’ wide) along southern property
boundary adjacent to County RR zoning and provide an opaque barrier along
property boundary.
10. Correct the Bulk Regulation and Yards Chart to indicate the requested front, side and
rear yards for HPR development.
11. Replace the fee-simple lot layout on Sheet C1.0 for a typical HPR lot layout. Include
HVAC placement within the proposed Private Elements on FMDP.
12. Label ADA ramps on Sheet C2.0.
13. Include HOA documentation with Final Master Development Plan submittal.
14. The proposed project will require off-
site water and sanitary sewer improvements. The
developer’s engineer shall prepare and submit an evaluation report on the capacities
and
downstream impacts on the sanitary sewer collection system for the proposed
development.

Updated Procedural History:
On November 14, 2023, the City Council passed the request by a vote of 5-2 at Council Committee.
On December 5, 2023, the City Council rejected the First Reading by a vote of 4-3.
On January 2, 2024, the City Council voted to discuss the request at the January 9th Council
Committee meeting.
RECOMMENDATION:
On October 23, 2023, the Gallatin Municipal Planning Commission recommended approval of
GMPC Resolution No. 2023-134 by a vote of 7-0 for the rezoning and the preliminary master
development plan (ZONE-2023-0084).

WHEREAS, the owner of the subject property submitted a complete application to rezone a
1.63 +/- acre portion of a parcel, located in the City of Gallatin, Tennessee; and
WHEREAS, the proposed zoning map amendment matches the recommendations of the
Suburban Character Area of PlanGallatin!, and the public necessity, convenience, and the general
welfare, will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning will have adequate public utilities,
infrastructure and private or municipal services necessary to serve the existing and proposed
development and population permitted by the requested zoning or such necessary services and
facilities will be provided upon development of the property; and
WHEREAS, the proposed rezoning will be compatible with surrounding area and will protect
the public health, safety and welfare and will not be injurious to other property or improvements in
the area in which the property is located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and made a
recommendation for approval of the proposed zoning as described in GMPC Resolution No. 2023-
171; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
Zoning Ordinance and §13-7-203, T.C.A.; and
WHEREAS, the City Council approved by majority vote of the members present the rezoning
request of the described properties; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GALLATIN, SUMNER COUNTY, TENNESSEE AS FOLLOWS:
Section 1. The City Council of the City of Gallatin does hereby approve rezoning a 1.63
+/- acre portion of a parcel to the R20-Low Density Residential District, as described in Exhibit ‘A’.

Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City’s Official Zoning Atlas to show the classification for the area as hereby
rezoned.

Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provision or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon adoption.

Extension to a design standard acceptable to the City of Gallatin Engineering

3. Alley access to the ‘Springdale Lane extension’ is located too close to the ‘Bison
Trail extension’ intersection. Suggest aligning alley driveways as shown on the

SUMMARY:
This ordinance will appropriate $7,635.53 from Insurance Recoveries, account #110-36350 to
account #110-42220-260, Fire Vehicle Repairs. This funding will reimburse the Fire Department for
the cost of repairs to a 2021 Ford Explorer that suffered storm related damage from the tornado on
December 9, 2023.

AN ORDINANCE OF THE CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE,
REZONING 16.6 +/- ACRES (TAX MAP 135, PARCEL 025.03) FROM THE R-40 LOW
DENSITY RESIDENTIAL DISTRICT, R-20 LOW DENSITY RESIDENTIAL DISTRICT
AND CS – COMMERCIAL SERVICES DISTRICT TO MRO – MULTIPLE RESIDENTIAL
AND OFFICE DISTRICT WITH A PRELIMINARY MASTER DEVELOPMENT PLAN
FOR THE WOODS FERRY RESIDENTIAL DEVELOPMENT, LOCATED EAST OF
WOODS FERRY ROAD AND WEST OF HIGHWAY 109; AUTHORIZING THE REVISION
TO BE INDICATED ON THE OFFICIAL ZONING ATLAS; REPEALING CONFLICTING
ORDINANCES; PROVIDING FOR SEVERABILITY, AND PROVIDING FOR AN
EFFECTIVE DATE.
WHEREAS, the owners of the subject property submitted a complete application to rezone
a 16.6 +/- acre parcel, located in the City of Gallatin, Tennessee; and
WHEREAS, the proposed zoning map amendment matches the recommendations of the
Suburban and General Urban Character Areas of PlanGallatin, and the public necessity, convenience,
and the general welfare, will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning will have adequate public utilities,
infrastructure and private or municipal services necessary to serve the existing and proposed
development and population permitted by the requested zoning or such necessary services and
facilities will be provided upon development of the property; and
WHEREAS, the proposed rezoning will be compatible with surrounding area and will protect
the public health, safety and welfare and will not be injurious to other property or improvements in
the area in which the property is located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and made a
recommendation for approval of the proposed rezoning with PMDP as described in GMPC
Resolution No. 2024-005; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
Zoning Ordinance and §13-7-203, T.C.A.; and
WHEREAS, the City Council approved by majority vote of the members present the rezoning
request of the described properties; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GALLATIN, SUMNER COUNTY, TENNESSEE AS FOLLOWS:
Section 1. The City Council of the City of Gallatin does hereby approve rezoning a 16.6
+/- acre parcel from the R-40 Low Density Residential District, R-20 Low Density Residential

District, and the CS-Commercial Services District to the MRO - Multiple Residential and Office
District, as described in Exhibit ‘A’ with a Preliminary Master Development Plan for the Woods
Ferry Residential Development, as described in Exhibit ‘B’.
Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City’s Official Zoning Atlas to show the classification for the area as hereby
rezoned.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provision or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon adoption.

EXHIBIT ‘B’
The rezoning shall be substantially consistent with the Preliminary Master Development Plan for
Woods Ferry Residential Development, consisting of a twenty-four (24) sheet plan, prepared by
615 Design Group of Smyrna, TN, with project number 1021002, dated January 11, 2024, and a
nineteen (19) page architectural booklet, compiled by Parkside Builders, with the following
conditions:
1. Provide the acreages of each area to be rezoned in the site data table.
2. Revise the site data table to include the correct MRO setbacks as provided in the
charts in the staff report.
3. Revise the Proposed Density Provided to 5.86 units per acre on the site data table
(84 units / 14.325 acres). Remove the Maximum Density Allowed on the site
data table.
4. List all exception requests in the MRO Bulk Exception Request table (lot width,
rear yard, etc).
5. Label bufferyards on site plan. Call out bufferyard types and landscaping
provided on landscape plans consistent with the Zoning Ordinance.
6. Revise Site Data Table to show front setback exception to be consistent with the
Typical Lot Layout.
7. Provide Type 35 Bufferyard adjacent to the R-40 zoning district along the
southern property boundary. Show existing vegetation within floodplain to be
maintained in the stream buffer along southern boundary.
8. Show existing vegetation along stream buffer on all landscape plan sheets.
9. Label the zoning for all adjacent properties including properties across rights-of-
way.
10. Submit updated architecture indicating brick water tables for each unit type.
11. Clarify siding labels to ensure all units will provide either hardieboard or other
fiber cement material (board and batten) siding.
12. Provide specific architecture for units facing Woods Ferry Road and Highway
109 that meet the 70% brick/stone requirement on all façades.
13. Show and label ADA ramps for all sidewalks and around the mail kiosk.
14. Add the following note: “Improvements to Woods Ferry will require separate
ROW Excavation Permit with Engineering Division. All street cuts need to be as
per the City of Gallatin Engineering Division. A right-of-way excavation permit
and surety is required prior to digging in public right-of-way. All backfill work
must be inspected and performed as per detail COG-MS-002.”
15. Label the Flood zone Type.
16. Submit revised digital files consisting of the PDF and AutoCAD (dwg.) drawings
of the Preliminary Master Development Plan to the Planning Department
addressing all conditions of approval.

SUMMARY:
An Ordinance of the City of Gallatin, Sumner County, Tennessee, rezoning a 16.6 +/- acre parcel
(Tax Map 135, Parcel 025.03) from the R-40 Low Density Residential District, R-20 Low Density
Residential District and CS - Commercial Services District to the MRO - Multiple Residential and
Office District with a Preliminary Master Development Plan for Woods Ferry Residential
Development, located East of Woods Ferry Road and West of Highway 109; Authorizing the
revision to be indicated on the official zoning atlas; repealing conflicting ordinances; providing for
severability, and providing for an effective date.
RECOMMENDATION:
On January 22, 2024, the Gallatin Municipal Planning Commission recommended approval of
GMPC Resolution No. 2024-005 by a vote of 6-0 for the rezoning and the preliminary master
development plan (ZONE-2023-0089).

RESOLUTION TO AUTHORIZE THE GALLATIN FIRE DEPARTMENT TO
APPLY FOR THE ASSISTANCE TO FIREFIGHTERS (AFG) GRANT
WHEREAS, the Gallatin Fire Department requests authority to apply for the FY 2023
Assistance to Firefighters (AFG) grant; and
WHEREAS, the cost of the grant shall not exceed $100,000.00, the AFG grant would
provide $90,000.00 which is 90% of the total costs, and the City of Gallatin must match 10% of
the costs, not to exceed $10,000.00; and
WHEREAS, any fire service related grant expenditure shall be contingent upon approval
of the Gallatin Fire Department’s AFG Grant Application.
NOW, THEREFORE, BE IT RESOLVED BY THE CITY OF GALLATIN,
TENNESSEE, that the City Council hereby authorizes the Gallatin Fire Department to apply for
the FY 2023 AFG grant; and
BE IT FURTHER RESOLVED that if awarded the AFG grant, the City of Gallatin is
committed to matching the requested funds of up to $10,000.00, which represents 10% of the total
project costs; and
BE IT FURTHER RESOLVED, that the City of Gallatin will make necessary allocations
in the budget to fund these expenditures; and
BE IT FURTHER RESOLVED, that this resolution shall take effect from and after its
final passage, the public welfare requiring such.

Resolution R2402-9. Resolution to authorize the Gallatin Fire Department to apply for the
Assistance to Fire Fighters (AFG) Grant.
SUMMARY:
This resolution will provide authorization for the Fire Department to apply for the competitive
FEMA FY 2023 Assistance to Fire Fighter (AFG) Grant. The Fire Department has evaluated the
Notice for Funding Opportunity document and has determined there are several approved items
which could increase operational capabillities and service to the community. If awarded a grant, the
city would be respondible for 10% of the costs. The Fire Department will not submit a grant request
to exceed $100,000.00 which will cap the City's contribution at a maximum of $10,000.00. The
grant application and and supporting documentation is due by March 8, 2024 with grant award
notifications expected to occurr before December 2024.
