Deotha Malone Council Chambers at Gallatin City Hall. Mayor Paige Brown called the meeting to order at 6:00 p.m. Councilman Todd Alexander led the opening prayer and Councilman Paul Jones led the pledge of allegiance. Ordinance #O2504-20 – Public Hearing Vice Mayor Hayes presented this ordinance of the City of Gallatin, Sumner County, Tennessee, rezoning 0.33 +/- acres from the A-Agricultural Residential District to the PGC-Planned General Commercial District with a Preliminary Master Development Plan for The Freedom Church outparcel on 0.88 +/- acres (and part of the Kensington Downs Master Plan), located west of Greenlea Boulevard and south of Grandstand Boulevard; authorizing the revision to be indicated on the official zoning atlas; repealing conflicting ordinances; providing for severability, and providing for an effective date. Vice Mayor Hayes called for the public hearing. With no one wishing to speak, Mayor Brown closed the public hearing. 2. Councilman Alexander made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. 4. Ordinance #O2504-26 – Second Reading Councilman Fennell presented this ordinance appropriating $500,000 for the Hale Avenue Extension Project. Councilman Fennell made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. 5. Ordinance #O2504-27 – Second Reading Councilman Fann presented this ordinance appropriating $135,000 to repave West Eastland Street. Councilman Fann made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. 6. Ordinance #O2505-29 – Second Reading Vice Mayor Hayes presented this ordinance adopting the annual budget for the fiscal year beginning July 1, 2025 through June 30, 2026. Mayor Brown stated the street lighting and signal changes are the amendments to the previous budget presented. Councilman Carter made motion to amend; Vice Mayor Hayes seconded. Ordinance #O2505-28 – First Reading Vice Mayor Hayes presented this ordinance appropriating $25,000 for completion of the Vol State Gap Trail Phase 1B Multi-Use Path. Vice Mayor Hayes made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. 8. Ordinance #O2505-30 – First Reading Councilman Alexander presented this ordinance of the City of Gallatin, Sumner County, Tennessee, zoning 17.18 +/- acres “not zoned” to the R-8 PRD-Medium Density Residential Planned Residential District and rezone 4.08 +/- acres from the R-40 Low Density Residential District to R-8 PRD-Medium Density Residential Planned Residential Development District with a Preliminary Master Development Plan for Kirkpatrick Gallatin on 154.83 +/- acres, located south of Nichols Lane and west of Woods Ferry Road; authorizing the revision to be indicated on the official zoning atlas; repealing conflicting ordinances; providing for severability, and providing for an effective date (Zone-2025-0114). Councilman Alexander made motion to discuss; Councilman Jouvence seconded. Motion carried with 7 ayes and 0 nays. Councilman Jouvence made motion that there would be no access including the pedestrian access; Councilman Alexander seconded. Council discussed. Mayor called for the vote. Motion failed with 2 ayes and 5 nays. Councilman Alexander and Councilman Jouvence voting aye; Vice Mayor Hayes, Councilman Carter, Councilman Fann, Councilman Fennell and Councilman Jones voting no. Mayor stated there was no motion on the ordinance so there cannot be a motion to amend. Vice Mayor Hayes made motion to approve; Councilman Carter seconded. Councilman Jouvence made motion to remove the pedestrian access; Councilman Alexander seconded. Motion failed with 2 ayes, 4 nays and 1 abstention. Councilman Jouvence and Councilman Alexander voted aye; Vice 5 Page 7 of 42 City Council Minutes May 20, 2025 Mayor Hayes, Councilman Carter, Councilman Fennell and Councilman Jones voted no and Councilman Fann abstained. Mayor called for the vote on the motion to approve. Motion carried with 4 ayes, 2 nays, and 1 abstention. Vice Mayor Hayes, Councilman Carter, Councilman Fennell and Councilman Jones voted aye, Councilman Jouvence and Councilman Alexander voted no and Councilman Fann abstained. 9. Resolution #R2505-21 Councilman Fennell presented this resolution declaring the intent of the City of Gallatin, Tennessee to reimburse itself for expenditures relating to the construction of a Fire Hall with the proceeds of tax-exempt bonds or notes to be issued in the approximate amount of $17,500,000. Councilman Fennell made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. Mayor Brown left the meeting at this time. In the absence of Mayor Brown, Vice Mayor Hayes assumed the chair and continued the meeting. 10. Resolution #R2505-22 Councilman Jones presented this resolution to approve issuance of tax-exempt revenue bonds by the Health and Educational Facilities Board of Metropolitan Government of Nashville and Davidson County for the benefit of Vanderbilt University Medical Center. Councilman Jones made motion to approve; Councilman Fennell seconded. Motion carried with 7 ayes and 0 nays. 11. Resolution #R2505-23 Councilman Carter presented this resolution renaming East Prince Street to Prince Street. Councilman Carter made motion to approve; Councilman Jouvence seconded. Resolution #R2505-24 Councilman Carter presented this resolution clarifying and renaming Magnolia Street to North/South Magnolia Street. Resolution #R2505-25 Councilman Fann presented this resolution to authorize the City of Gallatin to apply for a Safer Streets For All (SS4A) Grant. Councilman Fann made motion to approve; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. Mayor Brown re-entered the meeting at this time. Vice Mayor Hayes continued to chair the meeting. 14. Resolution #R2505-26 Councilman Jouvence presented this resolution authorizing and approving a grant to the Industrial Development Board of the City of Gallatin, Tennessee for public infrastructure upgrades and improvements for the construction of Westside Markets of Greensboro Village and authorizing the Mayor to execute the grant agreement. Councilman Jouvence made motion to discuss; Councilman Carter seconded. Motion carried with 7 ayes and 0 nays. Council discussed. City Attorney Susan High-McAuley highlighted the additions. Councilman Carter made motion to approve; Councilman Fennell seconded. Councilman Carter made motion to include the additions to the agreement; Councilman Fennell seconded. Resolution #R2505-27 Resolution by the Gallatin City Council to accept the donation of property located on or near South Westland Avenue and East Park Avenue currently owned by Eaton Corporation. Vice Mayor Hayes stated this resolution was deferred earlier in the meeting. Councilman Jouvence and Councilman Alexander abstained. • Police Chief Don Bandy stated the Police Department is updating the LPR Program. Chief said the PD is moving to a new company called FLOCK and TDOT requires council’s approval and a copy of the minutes. Councilman Jouvence made motion to approve; Councilman Fennell seconded. Council discussed. • Councilman Carter stated Gallatin Rehabilitation and Healing has invited council to attend the 104th Brithday celebration for Ms. Lucille Sneed, Thursday, June 12th in the Dining Room. • Councilman Alexander shared about his first church being in Mountain City East Tennessee. He said Mountain City is still recovering from the tornadoes and would appreciate any help. He added that if anyone is interested in helping to see him. With no other business, Vice Mayor Hayes closed other business. WHEREAS, the owner of the property submitted a complete application to rezone 0.33 +/- acres with a Preliminary Master Development Plan for the Freedom Church Outparcel on 0.88 +/- acres, located in the City of Gallatin, Tennessee; and WHEREAS, the zoning map amendment conforms to the general plan of the area including the established General Urban Character Area and that the public necessity, convenience, and general welfare, will be served by approving the proposed amendment; and WHEREAS, the property proposed for rezoning has adequate public utilities, infrastructure and private or municipal services necessary to serve the existing and proposed development and population permitted by the requested zoning or such necessary services and facilities will be provided upon development of the property; and WHEREAS, the rezoning will be compatible with the surrounding environment and will protect the public health, safety and welfare and will not be injurious to other property or improvements in the area in which the property is located; and WHEREAS, the Gallatin Municipal Planning Commission reviewed and recommended approval of the proposed rezoning with Preliminary Master Development Plan in GMPC Resolution No. 2025-031; and WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin Zoning Ordinance and Tenn. Code Ann. § 13-7-203; and WHEREAS, the City Council approved by majority vote of the members present the rezoning request of the described property; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE as follows: Section 1. The City Council of the City of Gallatin does hereby rezone 0.33 +/- acres from the A-Agricultural Residential District to the PGC-Planned General Commercial District and Page 12 of 42 approves a Preliminary Master Development Plan for the Freedom Church Outparcel, as described in Exhibit ‘B’. Section 2. The City Council of the City of Gallatin does hereby approve, authorize and direct the revision of the City’s Official Zoning Atlas to show the classification for the area as hereby rezoned. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Section 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provisions or applications of this ordinance which can be given without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. Section 5. This ordinance shall become effective immediately upon passage, the public welfare requiring such. WHEREAS, the applicant submitted a complete application for a Preliminary Master Development Plan on a 3.53 +/- acre portion of a parcel, located south of Long Hollow Pike and west of GreenLea Boulevard in Gallatin, Tennessee; and WHEREAS, the property is currently zoned MU-Mixed Use; and WHEREAS, the Gallatin Municipal Planning Commission reviewed and recommended approval of the Preliminary Master Development Plan in GMPC Resolution No. 2025-027; and WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin Zoning Ordinance and Tennessee Code Annotated, Section 13-7-203; and NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE as follows: Section 1. The City Council of the City of Gallatin does hereby approve a Preliminary Master Development Plan for Wawa - Long Hollow Pike, on a 3.53 +/- acre portion of a parcel (P/O Parcel 125/019.10), zoned MU-Mixed Use, as described in Exhibit ‘A’. Section 2. The City Council of the City of Gallatin does hereby approve, authorize and direct the revision of the City’s Official Zoning Atlas to show the classification of a preliminary master development plan for the property. Section 3. All ordinances or parts of ordinances in conflict with the provisions of this ordinance are hereby repealed to the extent of such conflict. Section 4. If any provision of this ordinance or the application thereof to any person or circumstance is held invalid, the invalidity shall not affect other provision or applications of this ordinance which can be given without the invalid provision or application, and to this end the provisions of this ordinance are declared severable. All other interior landscaping requirements shall be met with the FMDP. 3. Update the Proposed Use to Convenience Sales and Service/Food Service Drive Thru. CASE BACKGROUND: Previous Approvals On September 13, 2013, the Municipal-Regional Planning Commission approved the Final Plat for Ray Estates Section II (PC0180-13). The plat was recorded on June 17, 2024 (P.B. 28, Pg. 166-168). On February 23, 2015, the Municipal-Regional Planning Commission approved a replat of a portion of Ray Estates, named Ray Estates Section 2B (1-265-15C). The plat was recorded on March 25, 2015 (P.B. 28, Pg. 351-353). Request All public improvements, including public streets and alleys and associated drainage facilities are complete and ready for acceptance by the City. Odie Ray Street includes 1345.97 +/- LF, Public Alley A includes 151.50 LF, Public Alley B includes 151.84 +/- LF, Public Alley C includes 152.00 +/- LF, Public Alley D includes 152.00 +/- LF, and Public Alley E includes 131.25 +/- LF. Section 3-102 of the Gallatin Subdivision Regulations requires that the applicant post a maintenance surety to remain in effect for a period of one year in the amount of 10 percent of the completed roadway and drainage improvement construction costs. The maintenance surety calculation is $49,400 for Ray Estates. RECOMMENDATION The Planning Department recommends approval of Resolution No. 2025-061.
