The Gallatin City Council met in regular session on Tuesday, September 2, 2025, in the
Dr. J. Deotha Malone Council Chambers in Gallatin City Hall. Mayor Paige Brown
called the meeting to order at 6:00 p.m. Councilman Todd Alexander led the opening
prayer and Councilman Steve Fann led the pledge of allegiance.

1. Ordinance #O2507-41 – Second Reading
Councilman Carter presented this ordinance of the City of Gallatin, Sumner
County, Tennessee, rezoning two lots totaling 10.18 +/- acres from the R-15
Medium Density Residential District to the MU-Mixed Use District with a
Preliminary Master Development Plan for the Wedgewood Townhomes, located
south of Red River Road and east of Highway 109; authorizing the revision to be
indicated on the official zoning atlas; repealing conflicting ordinances; providing
for severability, and providing for an effective date (Zone-2025-0116).
Councilman Carter made motion to approve; Councilman Fennell seconded.
Councilman Jouvence left the meeting at this time.
Council discussed.
Mayor Brown called for the vote. Motion carried with 5 ayes and 1 nay.
Councilman Alexander voted no.
2. Ordinance #O2507-42 – Second Reading
Councilman Fennell presented this ordinance of the City of Gallatin, Sumner
County, Tennessee, zoning 11.965 +/- acres to the PGC-Planned General
Commercial District, 33.167 +/- acres to the MU-Mixed Use District, and 38.683
+/- acres to the R-10 PRD Medium Density Residential Planned Residential
District and approval of Preliminary Master Development Plan for the Station
Camp Master Plan on five parcels, totaling 83.82 +/- acres, located north of
Highway 386 and west of Big Station Camp Boulevard, authorizing the revision
to be indicated on the official zoning atlas; repealing conflicting ordinances,
providing for severability, and providing for an effective date (Zone-2025-0117).

3. Ordinance #O2507-45 – Second Reading
Councilman Fennell presented this ordinance appropriating $30,000.00 from the
occupancy tax reserve to tourism special events.
Councilman Fennell made motion to approve; Councilman Fann seconded.
Vice Mayor Hayes made motion to amend appropriation to $15,000.00;
Councilman Carter seconded. Motion carried with 6 ayes and 0 nays.
Mayor called for the vote on the original motion as amended. Motion carried
with 6 ayes and 0 nays.
4. Ordinance #O2509-46 – First Reading
Councilman Alexander presented this ordinance amending Section 3-55 of the
Gallatin Municipal Code to delete the distance requirement between existing and
approved retail liquor stores.
Councilman Alexander made motion to discuss; Councilman Carter seconded.
Mayor provided a history of previous processes required to obtain a city liquor
license.
Council discussed.
Councilman Carter made motion to approve; Councilman Jones seconded.
Councilman Fennell stated he would recuse himself.

5. Resolution #R2507-46
Councilman Jones presented this resolution to authorize the City of Gallatin to
apply for a BlueCross BlueShield Healthy Places Grant.
Councilman Jones made motion to approve; Councilman Carter seconded.
Motion carried with 6 ayes and 0 nays.
6. Resolution #R2508-50
Councilman Fann presented this resolution to authorize an actuarial study to
determine the costs associated with authorizing members of the Tennessee
Consolidated Retirement System to establish retirement credit for expended
armed conflict military service credit pursuant to Tennessee Code Annotated,
Section 8-24-605 (D).
Councilman Fann made motion to discuss. Motion died for lack of second.
Councilman Alexander made motion to approve; Councilman Carter seconded.

7. Resolution #R2508-52
Councilman Fennell presented this resolution reappointing Beth Bennett to the
Gallatin Electric Power Board.

Vice Mayor Hayes presented this resolution authorizing City of Gallatin to join
the State of Tennessee and other local governments in amending the Tennessee

AN ORDINANCE OF THE CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE,
APPROVING THE AMENDED PRELIMINARY MASTER DEVELOPMENT PLAN FOR
FOXLAND HARBOR MARINA, ON 7.38 +/- ACRES, LOCATED SOUTH OF
NASHVILLE PIKE AND EAST OF DOUGLAS BEND ROAD; AUTHORIZING THE
REVISION TO BE INDICATED ON THE OFFICIAL ZONING ATLAS; REPEALING
CONFLICTING ORDINANCES; PROVIDING FOR SEVERABILITY, AND
PROVIDING FOR AN EFFECTIVE DATE.
WHEREAS, the applicant submitted a complete application for an Amended Preliminary
Master Development Plan on 7.38 +/- acres, located south of Nashville Pike and east of Douglas
Bend Road in Gallatin, Tennessee; and
WHEREAS, the property is currently zoned MU-Mixed Use and MRO – Multiple
Residential and Office Zone Districts; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and recommended
approval of the Preliminary Master Development Plan in GMPC Resolution No. 2025-069; and
WHEREAS, a public hearing was held following public notice as prescribed by the
Gallatin Zoning Ordinance and Tennessee Code Annotated, Section 13-7-203; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE
CITY OF GALLATIN, SUMNER COUNTY, TENNESSEE as follows:
Section 1. The City Council of the City of Gallatin does hereby approve an Amended
Preliminary Master Development Plan for Foxland Harbor Marina, on 7.38 +/- acres, zoned
MU-Mixed Use and MRO -Multiple Residential and Office Zone Districts, as described in
Exhibit ‘A’.
Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City’s Official Zoning Atlas to show the classification of a
preliminary master development plan for the property.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person
or circumstance is held invalid, the invalidity shall not affect other provision or applications
of this ordinance which can be given without the invalid provision or application, and to
this end the provisions of this ordinance are declared severable.
Section 5. This Ordinance shall take effect upon final passage, the public welfare
requiring such.

EXHIBIT ‘A’
The Amended Preliminary Master Development Plan for Foxland Harbor Marina consists of a ten
(10) sheet plan, prepared by RaganSmith of Nashville, TN, Gamble Design Collaborative, LLC,
of Franklin, TN and 906 Studio Architects of Franklin, TN, dated June 9, 2025, with the following
conditions:
1. Show and label any loading areas with the FMDP.
2. On Sheet C1.0, revise the “Retail use” to state: “Retail/Limited Retail
Sales – Accessory”.
3. Add note: No outdoor storage of materials will be allowed in parking
spaces adjacent to Foxland Boulevard and Douglas Bend Road.
4. Provide evergreen plantings in the Type 15 bufferyards along Douglas
Bend and Foxland Boulevard with FMDP submittal.
5. Final parking counts shall be evaluated with the FMDP. If it is found that
the plan does not comply with the Gallatin Zoning Ordinance, a parking
study shall be provided demonstrating how the provided parking is
adequate for the site at that time and considered by the Planning
Commission.
6. Review and approval for construction plans and stormwater calculations
will be handled under the separate Engineering Construction Plan (ECP)
process. All technical review (including all Grading details) from
Engineering and Stormwater will be completed under this ECP submittal.
PMDP/FMDP approval does not imply ECP approval. Alterations made
during the ECP review may require a re-submittal of the PMDP/FMDP as
directed by the Planning Department. These revisions may include, but are
not limited to, changes in lot layout, roadway configuration, stormwater
management areas, utility locations, and revision to open spaces.
7. Stormwater report and/or hydrologic determinations were not submitted
with this PMDP submittal (nor are they required at this stage). However,
this PMDP is subject to revisions required when the stormwater report and
hydrologic determination is submitted with FMDP or Construction Plans.
These revisions may include, but are not limited to changes in lot layout,
roadway configuration, and revision to open spaces which may affect
traffic circulation and number of building lots.
8. Prior to PMDP approval, provide a stormwater memorandum that
describes the proposed methodology of meeting the water quality and
quantity requirements for this development.
9. Provide a vehicular and pedestrian connection from proposed parking area
to the Foxland Clubhouse.
10. Offsite improvements to mitigate additional traffic created by this
development will be required based on the findings of the approved
Traffic Impact Study (TIS). Offsite improvements may include, but are not
limited to, installation of traffic signal(s), alteration of existing traffic
signal(s), roadway widening, adding of turn lane(s), proportional
contribution towards corridor improvements. Review and approval for the

TIS will be handled under the separate Engineering Traffic Study (ETS)
process through the CSS portal. All technical review from Engineering
will be completed under this ETS submittal. TIS must be approved by
Engineering. PMDP/FMDP approval does not imply ETS approval.
Alterations made during the ETS review may require a re-submittal of the
PMDP/FMDP as directed by the Planning Department. These revisions
may include, but are not limited to, installation of traffic signal(s), offsite
improvements, changes in lot layout, roadway configuration,
number/location of driveway connections, stormwater management areas,
utility locations, and revision to open spaces.
11. Submit a PDF and DWG of the Amended PMDP to the Planning
Department for final review.
12. Maximum height of all buildings shall be 78’ (measured from the point of
the average height of the roof having a pitch including a gabled or hipped
roof.)
13. Install a roundabout at the intersection of Douglas Bend Road and Foxland
Boulevard. Roundabout must be functional prior to development reaching
25% completion.
14. Modify the existing boat ramp driveway to prohibit left turns from Douglas
Bend Road as described in the approved Traffic Impact Study.

SUMMARY:

RECOMMENDATION:
On June 23, 2025, the Gallatin Municipal Planning Commission recommended approval of GMPC
Resolution No. 2025-069 by a vote of 4-1 for the Amended Preliminary Master Development Plan
(MDP-2025-0444).

ORDINANCE AMENDING SECTION 3-55 OF THE GALLATIN MUNICIPAL CODE TO
DELETE THE DISTANCE REQUIREMENT BETWEEN EXISTING AND APPROVED
RETAIL LIQUOR STORES
WHEREAS, it is deemed in the public interest to amend the Gallatin Municipal Code from time
to time; and
WHEREAS, The Mayor and City Council have recommended that the City of Gallatin
Municipal Code, Section 3-55 be amended to delete the distance requirement between existing and
approved retail liquor stores.
NOW, THEREFORE, BE IT ORDAINED BY THE CITY OF GALLATIN, TENNESSEE,
that the Gallatin Municipal Code, Chapter 3, Section 3-55, which requires a one-mile radius between
existing and approved liquor stores, is hereby deleted in its entirety.
BE IT FURTHER ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, that the
Gallatin Municipal Code, Chapter 3, Section 3-55(B) shall not be replaced and shall be marked Reserved
in the Municipal Code.
BE IT FURTHER ORDAINED BY THE CITY OF GALLATIN, TENNESSEE, that this
Ordinance shall take effect on final passage, the public welfare requiring such.

WHEREAS, the owners of the subject property submitted a complete application to rezone

WHEREAS, the proposed zoning map amendment matches the recommendations of the
PlanGallatin General Development Plan, and the public necessity, convenience, and the general
welfare, will be served by approving the proposed amendment; and
WHEREAS, the property proposed for rezoning will have adequate public utilities,
infrastructure and private or municipal services necessary to serve the existing and proposed
development and population permitted by the requested zoning or such necessary services and
facilities will be provided upon development of the property; and
WHEREAS, the proposed rezoning will be compatible with surrounding environment and
will protect the public health, safety and welfare and will not be injurious to other property or
improvements in the area in which the properties are located; and
WHEREAS, the Gallatin Municipal Planning Commission reviewed and made
recommendation of the proposed rezoning in GMPC Resolution No. 2025-097; and
WHEREAS, a public hearing was held following public notice as prescribed by the Gallatin
Zoning Ordinance and §13-7-203, T.C.A.; and
WHEREAS, the City Council approved by majority vote of the members present the rezoning
request of the described properties; and
NOW, THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF THE CITY
OF GALLATIN, SUMNER COUNTY, TENNESSEE AS FOLLOWS:
Section 1. The City Council of the City of Gallatin does hereby approve the rezoning of a
0.66 +/- acre parcel from the CS – Commercial Services District to the MRO-Multiple Residential
Office District, as described in Exhibits ‘A’ and ‘B.’

Section 2. The City Council of the City of Gallatin does hereby approve, authorize and
direct the revision of the City’s Official Zoning Atlas to show the classification for the area as hereby
rezoned.
Section 3. All ordinances or parts of ordinances in conflict with the provisions of this
ordinance are hereby repealed to the extent of such conflict.
Section 4. If any provision of this ordinance or the application thereof to any person or
circumstance is held invalid, the invalidity shall not affect other provision or applications of this
ordinance which can be given without the invalid provision or application, and to this end the
provisions of this ordinance are declared severable.
Section 5. This ordinance shall become effective immediately upon adoption.

The Preliminary Master Development Plan for Habitat for Humanity Examiner Court Residential
Community consists of a ten (10) sheet plan, prepared by GreenLID Design of Gallatin, TN, with
project number #25.049G, dated June 19, 2025, with a revision date of August 11, 2025, and a twenty-
six (26) page Pattern Book, prepared by GreenLID and Ross Chaplain Architects for Habitat for
Humanity of Sumner County, with the following conditions:
1. Add zoning to surrounding lots on Sheet C3.0.
2. Label bufferyards on site plan and landscaping sheets (C2.0 and L1.0)
3. Provide a 10’ wide PUDE on the north, east and south property boundaries
with the FMDP.
4. Provide additional detail at the FMDP/Site Plan stage regarding how water will
drain into and discharge from the proposed stormwater area.
5. A Traffic Impact Study (TIS) is not required at the PMDP submittal, but a trip
generation table must accompany this submittal per Zoning Ordinance
13.06.010. If the trip generation is 1,000 or more daily trips, a TIS will be
required prior to FMDP approval.
6. A separate Driveway Permit with the Engineering Division is required prior to
the issuance of building permits.
7. All required parking for this project must be on-site per Zoning Ordinance
11.04.010. City right-of-way cannot be used to meet required number of
parking spaces.

GALLATIN, TENNESSEE IN KENNESAW FARMS PHASE 6, SECTION 3
WHEREAS, THE CITY OF GALLATIN MUNICIPAL PLANNING COMMISSION has
recommended acceptance by the City of Gallatin of the public improvements in the development
hereinafter named Kennesaw Farms, Phase 6, Section 3; and
WHEREAS, THE CITY OF GALLATIN ENGINEERING DIVISION hereby certifies
that the public drainage infrastructure, rights-of-way, and public easements in Kennesaw Farms,
Phase 6, Section 3 have been satisfactorily completed and have been installed in accordance with
the approved plans and specifications and that there has been full compliance with the City of
Gallatin Subdivision Regulations; and
WHEREAS, THE CITY OF GALLATIN PUBLIC UTILITIES DEPARTMENT hereby

PROPERTY OVERVIEW: The owner and applicant request the City of Gallatin to accept the

lots, 2 open space lots, and 1.47 +/- acres of right-of-way on 12.370 +/- acres.
CASE BACKGROUND:
Previous Approvals
On June 28, 2021, the Planning Commission approved the Final Plat for Kennesaw Farms, Phase 6,
Section 2 (SUBD-2021-0174). The plat was recorded on November 2, 2021 (Plat Book 33, Pages
343-345). The improvements include Payton Lane and Caspian Way.
Request
All public improvements, including public streets and associated drainage facilities, are complete
and ready for acceptance by the City. Kennesaw Farms, Phase 6, Section 3 includes the streets
Payton Lane at +/- 843 LF and Caspian Way at +/- 240 LF.
Section 3-102 of the Gallatin Subdivision Regulations requires that the applicant post a maintenance
surety to remain in effect for a period of one year in the amount of 10 percent of the completed
roadway and drainage improvement construction costs. The maintenance surety calculation is
$69,000.00 for Phase 6, Section 3.
RECOMMENDATION:
The Planning Department recommends approval of Resolution No. 2025-086.

provisions in the Agreement violate the City’s Contract Administration Policy and accepts the risks associated
