The Gallatin Municipal Board of Zoning Appeals met in a regular meeting on Thursday, October 26,2017
at 5:30 p.m., in the Dr. J. Deotha Malone Council Chambers of Gallatin City Hall. Mr. Jimmy Moore,
Chair, called the meeting to order. A copy of the meeting agenda is attached to these minutes as Exhibit A.
Chair Moore led the opening prayer and Mr. Vaughn led the pledge of allegiance. Ms. Mudrak called roll.
Approve Prior Minutes
Chair Moore motioned to approve the September 28,2017 Municipal Board of Zoning Appeals meeting
minutes. Mr. Puryear seconded the motion and the motion passed by unanimous vote.

Ronald E.. Sr. - Public Hearing - The owner and applicant request approval of a Conditional Use Permit
for a three 13) unit- multi-familv dwellins use at 7 Hawkins Avenue. oer section 06.05.020.C of the
+l acre lot zoned Rl5 -
Ms. Sharon Burton, Planner I, explained that the Municipal Board of Zoning Appeals heard this case on
September 28,2017 and asked that the City Attorney's office give a legal opinion if a Conditional Use
Permit may be granted to a person and not for an address (or property). The legal opinion said the previous
motion must be rescinded but that time limits could be placed on the Conditional Use Permit.
Ms. Leticia Alexander, Staff Attorney, said the legal opinion did not include the time limit for this
Conditional Use Permit. Mr. William McCord, Director of Planning, said the time limit is part of the
Gallatin Zoning Ordinance and he read from the section of the ordinance. He added that in years past two
(2) year limits were regularly placed on Conditional Use Permits.
Vice Chair Puryear asked if the Board could set a time limit for a period of time or when the property is
transferred to another owner. Ms. Alexander said she does not know the intent of the ordinance.

Mr. McCord said this home has been operating as a three-unit complex for l0 years
Ms. Burton said the owner considered selling the home and a real estate agent advised him to find out if the
home was zoned multi-residential. He has now decided not to sell the property.
Mr. Ronald Carmack, applicant, said he is not considering selling the home at this time
Mr. McCord said Staff s recommendation has not changed.
Vice Chair Puryear said he would like to set a time limit on the Conditional Use Permit. If the home is
sold, the Conditional Use Permit expires.
Mr. Carmack said that both apartments can be accessed from the main house
Mr. McCord said it would be easy to convert to two (2) units because the units are on one utility meter
Chair Moore opened the public hearing. No one came forward to speak; therefore, Chair Moore closed the
public hearing.
Ms. Alexander said if the Board is considering approving three (3) units, a time limit should be put on the
Conditional Use Permit.
Mr. McCord added that at the expiration date the owners could come back to the Municipal Board of Zoning
Appeals and the Conditional Use Permit may be renewed.
Vice Chair Puryear motioned to approve Resolution 2017-09 for a Conditional Use Permit, with a five year
expiration date. Ms. Gregory seconded the motion and the motion passed by unanimous vote.

Density Residential District. located at 940 Lakeshore Drive.
Ms. Burton said the Board previously approved a variance to permit 2I.7 percent lot coverage. The
applicant reconfigured the plan and is requesting 25 percent lot coverage. The out buildings, patios, etc.,
were not considered in the original request. Staff recommends approval of Resolution20lT-10.
Mr. McCord said he received a phone call from the next door neighbor stating they do not oppose the
addition.

Mr. Rick Murphy, applicant, said older homes are being purchased by young couples and these new owners
will want to renovate and possibly enlarge the existing homes. He suggested that the City look at
streamlining the process. He asked if approval will allow the applicant's contractor to pull building permits.
Mr. McCord said, if approved, and no other increase is requested, building permits may be issued.
Chair Moore opened the public hearing. No one came forward to speak; therefore, Chair Moore closed the
public hearing.
Mr. Puryear said he is not concerned with this request because this is the smallest lot in the development.
Mr. Puryear motioned to approve Resolution 2017-10. Mr. Vaughn seconded the motion and the motion
passed by unanimous vote.
3. Other Business
Mr. McCord said the date for the Sumner County Planning Commissioners and Board of ZoningAppeals
Commissioners training is Novemb er 27 , 2017 at 5:00 in the Gallatin City Hall Dining Room.

WHEREASO THE CITY OF GALLATIN, TENNESSEE MUNICIPAL
BOARD OF ZONING APPEALS reviewed the application materials and supporting
documentation submitted by the applicant, the analysis, findings and recommendations presented
by City Staff and in the Municipal Board of Zoning Appeals Staff Report, and evidence and
testimony presented during the meeting; and
WHEREAS, THE CITY OF GALLATIN, TENNESSEE MUNICIPAL
BOARD OF ZONING APPEALS is required in its deliberations, pursuant to the Gallatin
Zoning Ordinance to indicate the specific requirement under which the variance is being
considered and state specific findings and specifically identify the hardships warranting such
action by the Board; and
NO\il, THEREFORE, BE IT RESOLVED BY THE CITY OF GALLATIN,
TENNESSEE MUNICIPAL BOARD OF ZONING APPEALS makes the following findings
pursuant to T.C.A. Section 13-7-206 and Section 13-7-207(3); and Section 15.05.030 of the
Gallatin Zoning Ordinance :
Section l. The request for a variance of 9.3 feet for the east side yard setback (side
corner) from the required 20 foot side yard setback to permit a house to
built on the lot, per the City of Gallatin Zoning Ordinance, Section
07.02.020.8.3, and Section 02.02, Definition of Yard, Side, (Tax Map
Parcel 126F1A1030.00) at 203 West Bledsoe Street, meets eight (S) of the
nine (9) Standards for a Variance as described in the body of the Staff
Report and as set forth in Gallatin Zoning Ordinance, Section 15.05.030:
A. The particular physical surroundings, shape, topographic conditions of the specific
property involved would result in a particular hardship upon the owner as
distinguished from a mere inconvenience, if the strict application of this Ordinance
were carried out;
B. The conditions upon which the petition for a variance is based would not be
applicable, generally, to other property within the same district;
C. The variance will not authorize activities in a zone district other than those permitted
by this Ordinance;
D. Financial returns only shall not be considered as a basis for granting the variance;
E. The alleged difficulty or hardship was not created by any person having an interest in
the property after the effective date of this Ordinance;
F. That granting the variance requested will not confer on the applicant any special
privilege that is denied by this Ordinance to other lands, structures, or buildings in the
same district;
G. The variance is not the minimum variance that will make possible the reasonable use
of the land, building, or structure; however, the minimum variance could be achieved
if the home is placed 10 feet from the west property boundary which would require a
side yard (side/corner) variance of only 8.2 feet
H. The granting of the variance will not be detrimental to the public welfare or injurious
to other property or improvements in the area in which the property is located; and
I. The proposed variance will not impair an adequate supply of light and air to adjacent
property, substantially increase the congestion in the public streets, increase the
danger of fire, endanger the public safety, or substantially diminish or impair property
values within the area.
Section 2. Action - The Gallatin Municipal Board of Zoning Appeals hereby
approves a variance of 8.2 feet for the east side yard (side corner yard)
from the required 20 foot side yard to permit the construction of a house,
per the City of Gallatin Zoning Ordinance, Section 07.02.020.8.3 and
Section 02.02, Definition of Yard, Side, for property located on Tax Map
Parcel 126F1N030.00, at 203West Bledsoe Street.
BE IT FURTHER RESOLVED BY THE CITY OF GALLATIN, TENNESSEE
MUNICIPAL BOARD OF ZONING APPEALS that this resolution shall take effect from and

in the MRO zone district.
CASE BACKGROUND:
Property Hßtory and Previous Approvals

The applicant recently purchased this property to construct a house. The property (S.B.E. Tax Map
126F1N030.00) is zoned MRO-Multiple Residential and Office since at least 1979. Dwelling, One-
Family Detached is a permitted use in the MRO zone district. Most of the properties in the area
surrounding this lot consist of Single-Family Residential structures.
Requested Varíønce
The owner and applicant request a variance of 9.3 feet, to permit the house to be built 10.7 feet from
the side corner lot line. MRO zoning does not contain residential bulk regulations for Maximum Lot
Coverage Permitted or Maximum Floor Area Ratio as included for other residential districts.
The applicant's house plan consists of a 1,064 (+l-) square foot building which includes a 28-foot by
38-foot structure of hardie board construction with stone on the lower half of the porch pillars.
(Attachment l-2). The 50' x 83' or 4,150 sq. ft. lot does not conform with the minimum lot
requirements. The MRO zone district requires a 6,000 sq. ft. minimum lot area. Since the size and
dimensions of the lots are pre-existing conditions, no variance is required for lot size. Photos of the
surrounding properties are attached (Attachment 1-3 A,B,C,D,E).
This area consists of many lots that do not meet the required lot area for the MRO zone district
(Attachment I-4). Many of these structures were built in the 1950s prior to the City property zoning
regulations.
The Gallatin Zoning Ordinance, the MRO zone district, established residential site development
regulations as follows:
Residential Site Development Regulations
Permitted residential activities and developments in the MRO District shall be designed and
developed according to the following regulations:
A. Bulk Regulations
1. Site Area Per Unit 3,000 sq.ft.
2. Maximum Building Height 35 feet
B. Area and Yard Regulations
1. Minimum Required Lot Area 6,000 sq. feet
2. Minimum Required Lot Width 60 feet

to comply with the side yard requirement because this is a corner lot. Corner lots require the side
yard adjacent to the street to be twice the width of a side yard setback per GallatinZoning Ordinance
Section 02.02, Definitions - Yard, Side:
Yard, Side - A yard extending along a side lot line from the required front yard to the
required rear yard. In the case of a corner lot, any yard which abuts a street line and which is
not designated a front yard shall be considered a side yard. In the case of a through lot, side
yards shall extend between the required front yards, except when such corner lots are
required by these regulations specifically to have more than one front yard. A side yard
abutting a street shall be twice the required minimum side yard.
To accommodate a house greater than2} feet wide on this lot, a side yard setback variance is needed
to build the house, which will be a 28 foot wide home. The home will comply with the required 20
foot front building setback.
The Variance provisions of the Gallatin Zoning Ordinance that apply to this case are listed below
I 5.05 Zonins.Variances
The Board of Zoning Appeals may grant variances where it makes findings of fact based upon the
standards prescribed in this section.
15.05.030 Standards for Variances
Section 15.05.030 of the Gallatin Zoning Ordinance states the Board of Zoning Appeals shall not
grant a variance unless it makes findings based upon evidence presented to it as described in nine (9)
specific criteria that are listed below. The applicant responded to these standards in writing
(Attachment l-2 A,B,C,D). The Board shall determine if this variance request meets all nine (9) of
the following standards for a variance as required by the Gallatin Zoning Ordinance as described
below.
A. The particular physical surroundings, shape, topographic conditions of the specific property
involved that would result in a particular hardship upon the owner as distinguished from a mere
inconvenience, if the strict application of this Ordinance were carried out must be stated.
a Applicant response: The lot is undersized for the zone.
a Staffresponse: The size ofthe parcel and the setbacks required by the adopted zoning are
limiting features of this property and contribute to the difficulties of constructing a residence
on the parcel. The lot is undersized for the zone district, and the owner has chosen a small
houseplan to place the structure with minimal encroachment into the required yards.
B. The conditions upon which the petition for a variance is based would not be applicable,
generally, to other property within the same district.
a Applicant response: The main problem with this lot is only the side setback that needs to be
double because of it being a corner lot.

a Staff response: This variance request is subject to this property only. Other property owners
in this area may also require a variance if they want to enlarge or replace their current
structures since many of the lots are undersized according to Zoning Ordinance standards.
Corner lots would be the most likely to need variances. Many of the structures in this area
appear to not conform with zoning regulations. No other property owners would be entitled
to a variance if the Board agreed to grant this variance.
C. The variance will not authorize activities in a zone district other than those permitted by this
Ordinance.
. Applicant response: No unauthorized activity for this zone is being requested.
a Staff response: This variance will not authorize arry use or activity that is currently not
permitted in the MRO zoning district.
D. Financial returns only shall not be considered as a basis for granting a variance.
. Applicant response: There is no financial beneht to the owner of this property by receiving
the variance.
a Staff response: If granted, the variance would only permit the property owner to construct a
a dwelling unit on a vacant lot. The proposed structure would be proportionate to the lot size
and dimensions.
E. The alleged difficulty or hardship has not been created by any person having an interest in the
property after the effective date of this Ordinance.
. Applicant response: The hardship was not created by anyone with an interest in this
property.
o Staff response: The alleged difficulty or hardship has not been created by a person having
an interest in the property after the effective date of the Ordinance. The hardship was created
when the zoning was established which created a non-conforming lot.
F. That granting the variance requested would not confer on the applicant any special privilege that
is denied by this Ordinance to other lands, structures, or buildings in the same district.
. Applicant response: V/e do not feel this would be a special privilege.
o Staff response: If granted, this variance would not confer on the owner a special privilege
that is currently denied by the Gallatin Zoning Ordinance to any other property or building
within this zone district.
G. The variance is the minimum variance that will make possible the reasonable use of the land,
building, or structure.
. Applicant response: The minimum variance needed is being requested.
Staff response: According to the applicant's plot plan, the requested variance is not the
minimum variance necessary to make reasonable use of the land. When all the yard areas are
calculated, there is approximately, 3,090 square feet of the 4,150 sq.ft. lot that cannot be
built on. This only leaves 1,060 square feet of buildable area. The applicant's houseplans are

for a structure that is 1,064 sq. ft., which is only a 4 sq. ft. difference. However, there is no
maximum lot coverage in the MRO district.
Based on the plot plan, to apply only the minimum variance, the house would be placed 10
feet from the west side yard instead of 1Ll feet as shown on the plan. This would reduce the
variance from 9.3 feet to 8.2 feet on the east side (side corner) yard.
H. The granting of the variance will not be detrimental to the public welfare or injurious to other
property or improvements in the area in which the property is located.
. Applicant response: No. The granting of this request will not detrimental to the public
welfare or injurious to other properties in the area.
a Staff response: If granted, the variance will not detrimental to the public welfare or injurious
to other properties in the area, since all other setbacks will be met and it will not affect sight
distance at the Bledsoe Street and Locust Avenue intersection.
I. The proposed variance will not impair an adequate supply of light and air to adjacent property,
substantially increase the congestion in the public streets, increase the danger of fire, endanger
the public safety, or substantially diminish or impair property values within the area.
. Applicant response: The request will not impair the supply of light and air to adjacent
property or increase the congestion in the area.
a Staff response: If granted, the variance will not impair an adequate supply of light and air to
adjacent property, and will not increase traffic or otherwise endanger public safety. It will
replace avacant lot with a residential structure.
15.05.060 Conditions and Restrictions by the Board
The Board may impose such conditions and restrictions upon the premises benefited by a variance as
may be necessary to comply with the provisions set out in Section 15.05.030 to reduce or minimize
the injurious effect to such variations upon surounding property and better carry out the general
intent of this Ordinance. The Board may establish expiration dates as a condition or as a part of the
variances.
The building footprint or placement should be shifted to the west 1.1 feet to provide the minimum
variance needed to accommodate the house.
If this variance request is approved, the owner shall submit another plot plan for the parcel, per
Gallatin Zoning Ordinance Section 15.03.020.C, for review by Staff to acquire building permits.
ENGINEERING DEPARTMENT COMMENTS
The Engineering Division reviewed the variance request, and had no comments.
