The Gallatin Municipal Board of Zoning Appeals met in a regular meeting on Thursday, May 27, 2021, at
5:30 p.m., in the Dr. J. Deotha Malone Council Chambers of Gallatin City Hall. Mr. Jimmy Moore, Chair,
called the meeting to order.
Chair Moore led the invocation and Ms. Gregory led the pledge of allegiance. Ms. Mudrak called the roll.
Chair Moore motioned to approve the December 17, 2020 Municipal Board of Zoning Appeals Meeting
Minutes. Mr. Puryear seconded the motion and the motion passed by roll call vote of 3 ayes; 0 nays.

Item 1: GMBZA Resolution No. 2021-002 – Dowell’s Renterprise Triplex – Conditional Use Permit (CUP-
2021-0009) – Dowell’s Renterprise, LLC – The owner and applicant request approval of a Conditional Use
Permit for Dowell’s Renterprise Triplex, to permit a multi-family residential dwelling development, per
Section 06.05.020.C of the Gallatin Zoning Ordinance, on a 1.05 +/- acre parcel (Tax Map 126B, Group A,
Parcel 016.00) – zoned R15-Medium Density Residential District, located at 657 Red River Road.
Mr. Josh King, Assistant Director of Planning, described the request for approval of a Conditional Use
Permit to add a three (3) unit multi-family residential dwelling on a 1.05 +/- acre parcel, located at 657 Red
River Road. Multi-family residential is permitted in the R15-Medium Density Residential District zone
with a Conditional Use Permit. The existing residential structure on the property will remain. Staff
recommends approval of Resolution No. 2021-002. He added that, if the Conditional Use Permit is
approved, the applicant will submit a site plan for Planning Commission approval.
Chair Moore opened the public hearing. No one came forward to speak; therefore, Chair Moore closed the
public hearing.
Mr. John Dowell, with Dowell’s Renterprise, LLC, owner and applicant, attended the meeting.

Chair Moore asked Mr. Dowell how many units currently exist on the property.
Mr. Dowell said one unit currently exists on the property and will remain.
Mr. Puryear asked about density.
Mr. King said the density allowed is four (4) units per acre.
Mr. Puryear asked if public notification was provided.
Mr. King said the public was notified and no comments were submitted to Staff.
Ms. Gregory motioned to approve Resolution No. 2021-002. Chair Moore seconded the motion and the
motion passed by 3 ayes; 0 nays.

Election of Officers
Chair Moore indicated there is still one unfilled seat on the Board.
Mr. Puryear motioned to keep the officer slate as it is, with Chair Moore, Vice Chair Schreiner, and Mr.
Puryear, Secretary.
Ms. Gregory seconded the motion and the motion passed by 3 ayes; 0 nays.

A RESOLUTION OF THE CITY OF GALLATIN MUNICIPAL BOARD OF WNING
APPEALS APPROVING A CONDITIONAL USE PERMIT FOR A LIMITED WAREHOUSING
COMMERCIAL ACTIVITIES USE, ON A 3.63 +/- ACRE PARCEL, ZONED CS -
COMMERCIAL SERVICES, LOCATED SOUTH OF TULIP POPLAR DR AND WEST OF TN-
109 (TAX MAP 1261, GROUP A, PARCEL 003.00) (CUP-2021-0010).
WHEREAS, THE CITY OF GALLATIN, TENNESSEE MUNICIPAL BOARD OF
ZONING APPEALS considered the Conditional Use Permit request for Tulip Poplar Mini Storage, a
limited warehousing commercial activities use, located south of Tulip Poplar Drive and West ofTN-109
(Tax Map 1261, Group A, Parcel 003.00), submitted by the applicant, GreenLID Design, on August 26,
2021; and
WHEREAS, THE CITY OF GALLATIN, TENNESSEE MUNICIPAL BOARD OF
ZONING APPEALS reviewed the application materials and supporting documentation submitted by
the applicant; the analysis, findings, and recommendations presented by City Staff and in the Municipal
Board of Zoning Appeals Staff Report; and the evidence and testimony presented during the meeting,
and held a public hearing as required by Article 15, Section 15.06.020 G.Z.O.; and
WHEREAS, THE CITY OF GALLATIN MUNICIPAL BOARD OF ZONING
APPEALS is required in its deliberations, pursuant to Gallatin Zoning Ordinance Section 15.04.028.F,
to indicate the specific section of the Zoning Ordinance of Gallatin, Tennessee, under which the permit
is being considered and state specific findings and any special conditions imposed in granting a
Conditional Use Permit; and
WHEREAS, the Section 08.02.010.C of the Zoning Ordinance of Gallatin, Tennessee
classifies Limited Warehousing-Commercial Activities as a Conditional Use in the CS- Commercial
Services zone district, and the Board of Zoning Appeals considers the use to comply with the General
Requirements and Special Conditions for Limited Warehousing-Commercial Activities as described in
Section 15.06.060 and Section 15.06.060.E.
NOW, THEREFORE, BE IT RESOLVED BY THE GALLATIN MUNICIPAL
BOARD OF WNING APPEALS in its deliberations finds that the applicant meets the Standards for a
Conditional Use set forth in Gallatin Zoning Ordinance Sections 15.06.030 and 15.06.040 as follows:
Section 1. The Gallatin Municipal Board of Zoning Appeals in its deliberations finds
that the applicant meets the General Requirements for a Conditional Use
Permit and Special Conditions for Limited Warehousing-Commercial
Activities set forth in Gallatin Zoning Ordinance §15.06.060 and
§15.06.060.E as follows:
1. In addition to the standards contained in this ordinance for a Limited
Warehousing-Commercial Activities, the Board of Zoning Appeals specifically
finds that there will be no adverse impact upon adjoining properties or the
neighborhood in which such use is proposed. In making this finding, the Board
shall consider the effect upon traffic congestion, overcrowding of schools,

availability of necessary public utilities, suitability of the site for the use, and such
other factors as determined by the Board. The use is so designed, located, and
proposed to be operated so that the public health, safety, and welfare will be
protected since the impact of the Limited Warehousing-Commercial Activities
will not adversely impact density in the neighborhood or create traffic congestion,
mcrease flooding, or create the potential to adversely affect school capacity
issues.;
2. The use will not adversely affect other property in the area in which it is located.
3. The use is within the provisions of "Conditional Uses" as set forth in this
ordinance.
4. The use conforms to all applicable provisions of this ordinance for the CS -
Commercial Services Zone District and is necessary for public convenience in
this location.
BE IT FURTHER RESOLVED THAT THE CITY OF GALLATIN, TENNESSEE
MUNICIPAL BOARD OF ZONING APPEALS approves a Conditional Use Permit request for a
Limited Warehousing-Commercial Activities facility located north of Tulip Poplar Drive and East of TN-
109 (Tax Map 1261, Group A, Parcel 003.00) with the following conditions:
1. Applicant will be required to submit a full Site Plan to the Planning Commission to show
the intended layout of this site. The application must meet all of the regulations adopted
by the City of Gallatin including but not limited to:
• Addresses must be assigned by E-911 at the Site Plan stage.
• The development is subject to the Gallatin Department of Electricity's (GDE)
Underground Policy.
• All of GDE's existing facilities that are required to be relocated will be at
developer's expense.
• Special attention to the landscape buffer along TN-109 and preserving mature
trees to the greatest extent possible, supplementing with evergreen trees as needed
2. Submit two (2) half-size corrected and folded copies, including one digital copy (PDF
& DWG), of the Conditional Use Permit plans to the Planning Department for review
and approval.
BE IT FURTHER RESOLVED BY THE CITY OF GALLATIN, TENNESSEE
MUNICIPAL BOARD OF ZONING APPEALS that this resolution shall take effect from and after its
final passage, the public welfare requiring such.

A limited warehousing-commercial activities use requires a conditional use permit in the CS –
Commercial Services zone district. The adjacent property owners were notified by mail about
the Conditional Use Permit request and a sign was posted on the site. A Public Hearing shall
be held on the item at the meeting.
Staff recommends approval of GMBZA Resolution No. 2021-010. The use is consistent with
other uses in the area.
CASE BACKGROUND:
Property History and Previous Approvals
The property (TAX MAP 126I, GROUP A, PARCEL 003.00) is currently vacant and has never been
platted nor addressed. It was once part of a larger tract of land bifurcated during construction of TN-
109 and the Nashville Pike interchange.

On May 1, 1979, the City Council adopted a new Zoning Ordinance and Map (Ordinance No. 079-
92). This property was zoned CS – Commercial Service at that time and has remained such.
DISCUSSION:
Proposed Development
Owner and applicant request approval of a Conditional Use Permit for Tulip Poplar Mini-Storage, to
permit a limited warehousing commercial activities use, per section 08.02.010.C of the Gallatin
Zoning Ordinance, on a 3.63 +/- acre parcel (Tax Map 126i, Group A, Parcel 003.00), zoned CS –
Commercial Services, located south of Tulip Poplar Drive and east of TN-109. (Attachment 1-1 and
Attachment 1-2)
The applicant has not submitted a complete site plan for the project but has submitted a conditional
use sketch for the Board’s consideration. If the CUP is approved, the applicant will need to submit a
full site plan for Gallatin Municipal Regional Planning Commission review and approval. This will
require additional details of bulk, area and yard regulations, bufferyards, driveways, and on site
circulation, including but not limited to sidewalks, parking layout, stormwater capacity and design.
No portion of the lot is within a special flood hazard area according to FEMA FIRM Map,
Community Panel No. 47165CO314G, dated April 17, 2012. The property is in Zone “X.”
Adjacent or Area Uses
The adjacent property to the east is vacant and zoned CS - Commercial Services. To the north across
the CSX railroad tracks is a multifamily zoned MU- Mixed Use. Directly to the South is the TN-109
and Nashville Pike interchange. Adjacent to the west of the property is TN-109, a controlled access
freeway.
Gallatin on the Move 2020 General Development and Transportation Plan
The Gallatin on the Move 2020 General Development Plan designates the property as part of the
Commercial Corridor Character Area (Attachment 1-4). Commercial/Retail are listed as primary
land uses for this character area. Included with the character area intent are:
“Provide through transportation, land use and other physical enhancements an environment
that provides a distinct sense of place, not just another commercial strip”
and
“Discourage continuous ribbons of automobile-oriented commercial development along
major corridors.”
The development strategies also indicate:
“Increase landscaping along the corridor, including in and along parking lots to provide
shade, reduce impervious surfaces, shield parking areas, and improve the appearance of
individual sites and the entire corridor.”
Staff supports the applicant’s Conditional Use Permit Application, provided a full site plan is
prepared and approved by the Planning Commission to ensure the use is compatible with other
structures in the area.

Access
This site is currently only accessible from Tulip Poplar Drive. TN-109 is a controlled access
freeway. A future site plan shall show an interconnected driveway to the property on the east for
when it develops. Sidewalks will also be required on Tulip Poplar Drive.
Parking
Table 11-01, Section A of the Gallatin Zoning Ordinance sets parking for Convenience Storage at 1
space per 10 storage units plus 1 space for every 300 feet of office. As shown on the conditional use
permit exhibit, final site plan will require 13 parking spaces. 129 units of storage and no office. At
the final site plan stage the total number of parking spaces will reflect the intensity of the
development proposed by the applicant.
Architectural Features
The applicant has not submitted architectural elevations at this time. This will be a requirement for
site plan approval. The plans shall demonstrate compliance with Section 13.08.010, Gallatin Zoning
Ordinance, Basic Design Criteria and Section 15.06.060.E.3 of the Gallatin Zoning Ordinance. The
elevation change between this site and TN-109 is a concern given the higher visibility of these units
from the major arterial roadway.
Signage
No signage has been proposed for this development. If any signs are proposed, the owner and
applicant shall submit a signage plan meeting the requirements of the Gallatin Zoning Ordinance,
Article 13, Section 13.07, and obtain sign permits from the Planning Department prior to the
installation of any signage on site.
General Requirements for Conditional Use Permit
Section 15.06.040 of the Gallatin Zoning Ordinance outlines the general requirements for granting a
Conditional Use Permit. The applicant's request meets the general requirements as listed below. A
Conditional Use Permit shall only be granted if the Board finds that it:
A. Is so designed, located, and proposed to be operated so that the public health, safety and welfare
will be protected;
• The request for a Conditional Use Permit for a Limited Warehousing Commercial Use, on
Tax Map 126i, Group A, Parcel 003.00, located south of Tulip Poplar Drive and East of TN-
109, will not significantly impact the public health, safety, or welfare of the area. The
development will be required to meet all of the requirements of the Gallatin Zoning
Ordinance, with exceptions to the required minimum setback to be voted on under a separate
variance case.
• The Limited Warehousing Commercial use will utilize public water, sanitary sewer, and
power sources from the appropriate utility companies.
• As shown on the conceptual sketch, parking for 13 vehicles will be provided for the self
storage facility. Without a formal site plan specific parking requirements and location cannot
be determined.

B. Will not adversely affect other property in the area in which it is located;
• The property is immediately surrounded by other properties zoned CS – Commercial
Services and are currently undeveloped.
• The self storage development should not adversely affect other properties in the area. The
development will not create unusual noise, light, or other adverse conditions, which would
violate the Performance Standards Regulations of the Gallatin Zoning Ordinance, Section
13.02. The owner and applicant indicated that the facility shall comply with all Performance
Standards Regulations of the Gallatin Zoning Ordinance.
C. Is within the provisions of "Conditional Uses" as set forth in this Ordinance;
• Limited Warehousing Commercial Use is a conditional use commercial activity in the CS -
Commercial Services zone district per Section 08.02.010.C,
D. Conforms to all applicable provisions of this Ordinance for the district in which it is to be located
and is necessary for public convenience in that location.
• This use does comply with the bulk regulations of the CS zone district.
• If approved, a building permit application shall be submitted to the Code Department
meeting all applicable regulations of the Gallatin Zoning Ordinance.
Special Conditions for Commercial Activities
Section 15.06.060.E of the Gallatin Zoning Ordinance outlines special conditions for Limited
Warehousing Activities. The applicant's request generally meets all of the special conditions as listed
below. Notwithstanding other issues of Code compliance, a Conditional Use Permit shall be granted
provided that the Board finds that:
E. Special Conditions for Limited Warehousing
1. The location, size, and design of such facility shall be compatible with development in the
surrounding area.
The development is proposed on a commercially zoned vacant parcel immediately
surrounded by commercially zoned vacant parcels.
2. There shall be provided along the entire site boundary fencing, screening, and landscaping, as
appropriate to protect adjoining properties.
A full fence and landscape screening to meet or exceed the GZO standards is shown on the
exhibit and greater detail will be required at the final site plan stage.
3. The use of buildings in which the exterior facade is comprised of metal construction or metal
siding shall be prohibited unless approved as an alternative material by the Planning Commission
according to provisions of Section 13.08.010 D. Buildings facades visible from a street or residential
area shall be designed according to the provisions of Section 13.08 of this Ordinance, and shall be
constructed primarily of brick, or stone, or combinations thereof, or combinations of materials
deemed acceptable by the Board. Building facades not visible from a street or residential area may
be constructed of aluminum siding, vinyl siding, or fiber cement siding. Building materials used in

the construction of the units shall not contain bright, vivid colors. The use of primary, secondary or
other bright, bold colors on building facades, roofs, doors, window frames, or awnings shall be
prohibited. Colors used in the development shall be subdued, with natural earth tones and colors
compatible with surrounding development predominating.
At the full site plan submittal, full color architectural elevations of all the proposed buildings
will be required. The applicant has acknowledged their intent to comply with the architectural
provisions outlined in this section of the Gallatin Zoning Ordinance by including a plan note:
“Proposed buildings to be constructed of stone and brick.”
4. The off-street parking requirements shall be based upon a recommendation from the Planning
Commission. All parking areas and driveways shall be paved.
All of the parking areas are shown to be striped and paved including 1 ADA accessible
space.
5. All buildings shall be separated by a minimum of thirty (30) feet.
Buildings show on the concept site plan are illustrating a minimum of 30 feet of separation
between structures on this site.
6. The setback for such activities shall be 100 feet from a major thoroughfare.
Under a separate application, the developer of this parcel has requested a variance from the
100 foot setback requirement due to site specific conditions. Staff is recommending approval on a
separate variance for this development (VAR-2021-0014)
Planning Department Comments
The Planning Department reviewed and commented on the Conditional Use Permit. These are
included as conditions of approval.
Engineering Division Comments
The Engineering Division reviewed and commented on the Conditional Use Permit. These are
included as conditions of approval.
Other Departmental Comments
The other City Departments reviewed and commented on the Conditional Use Permit with the
following comments:
• Additional addresses must be assigned by E-911 at the site plan stage.
• The development is subject to the Gallatin Department of Electricity’s (GDE) Underground
Policy.
• All of GDE’s existing facilities that are required to be relocated will be at developer’s
expense.
Findings
The owner and applicant submitted responses addressing the General Requirements and Special
Conditions pertaining to the proposed Conditional Use Permit for a Limited Warehousing
Commercial use, which is included as part of the Conditional Use Permit request.
RECOMMENDATION:
The Planning Department recommends approval of GMBZA Resolution No. 2021-010.
