(r-9417-18C) WHEREAS, THE CITY OF GALLATIN MUNICIPAL-REGIONAL PLANNING COMMISSION considered the Final Plat submitted by Amold Consulting Engineering Services, Inc. at the Special-Called meeting on September 10, 2018; and WHEREAS, THE CITY OF GALLATIN MUNICIPAL-REGIONAL PLANNING COMMISSION reviewed the application materials and supporting documentation submitted by the applicant, the analysis, findings and recommendations presented by City Staff, in the Planning Commission Staff Report and the evidence and testimony presented during the meeting. NO\ry, THEREFORE, BE IT RESOLVED BY THE GALLATIN MUNICIPAL- REGIONAL PLANNING COMMISSION as follows. Section 1. The Gallatin Municipal-Regional Planning Commission in its deliberations makes the following findings pursuant to TCA $ 13-3- 403, $13-3-404, $13-4-303, and g13-4-304 and Gallatin Subdivision Regulations, Chapter 1, Section l-104, items 1-11 and Chapter 2, Section 2-105: 1. The Final Plat is in agreement and consistent with the intent and recommendations of the Gallatin on the Move 2020 General Development & Transportation Plan for the area, and in particular, the Regional Activity Center Character Area. 2. The Final Plat is consistent with the Policy and Purpose of the Subdivision Regulations of the City of Gallatin as described in Chapter 1, Section 1-104, items 1- 11. 3. The Final Plat is consistent with the purpose and intent of the MU-Mixed Use Zoning District. 4. The Final Plat is consistent with T.C.A. Section 13-3-403, Section 13-3-404, Section 13-4-303 and Section 13-4-304. 5. The Final Plat complies with the requirements of the subdivision regulations as described in chapter 2, section 2-105, Gallatin Subdivision Regulations. 6. The legal purposes for which zoning and subdivision regulations exists have not been contravened. 7. The subdivision will not create adverse effects upon adjoining property owners or any such adverse effect can be mitigated by applying design and performance standards or is justified by the public good or welfare. 8. No one property owner or small group of property owners will benefit materially from the approval to the detriment of the general public. ITERtr I Section 2. Action - The Gallatin Municipal-Regional Planning Commission hereby approves the Final Plat for Baker's Crossing, The Forza Group, consisting of a two (2) sheet plan prepared by Arnold Engineering Consulting, of Bowling Green, Kentucky, with project number 18- 1286-L, dated August 27,2018, with the following conditions: 1. Submit detailed plans and specifications for water and sanitary sewer installations for review and approval to the Gallatin Public Utilities Department. 2. Submit a copy of the Stormwater Maintenance Agreement to the Engineering Division for review and approval. Once the document is approved by Engineering Division and recorded, the recording citation will need to be added to the plat, then provide a copy of the recorded Stormwater Maintenance Agreement to the Engineering Division. 3. Submit PDF and DWG files to the Planning Department prior to the recording of the final plat. BE IT FURTHER RESOLVED BY THE CITY OF GALLATIN, TENNESSEE MUNICIPAL-REGIONAL PLANNING COMMISSION that this resolution shall take effect from and after its final passage, the public welfare requiring such. Gnse BtcxcRout¡o: Property History and Previous Approvals On September 25, 2006, the Planning Commission recommended approval of rezoning 37.72 +/- acres from R2O-Low Density Residential, CS-Commercial Services and CG- Commercial General to MU-Mixed Use with a Preliminary Master Development Plan for Baker's Crossing (File 3-23-06) and amending the Preliminary Master Development Plan for the five (5) lots fronting on Nashville Pike, including 1208, 1212, 1214, and 1216 Nashville Pike, to accommodate the proposed extension of Tulip Poplar Drive. . The rezoning with the Preliminary Master Development Plan for Baker's Crossing passed 2nd Reading at the November 21, 2006 City Council meeting (Ordinance No. 00610-073). On August 27, 2007, the Planning Commission approved Final Master Development Plan for Commerce Union Bank at the corner of Nashville Pike (U.S. Hwy 31E) and Tulip Poplar Drive (File 8-39-07). The final plat for Bakers Crossing, Lots 1 and 2, including the west 450 feet of Tulip Poplar Drive, was also approved (P.8. 25, Pg. 208). Thefinal platfor Bakers Crossing, Phase 2, was approved in2012 (P.8. 27,P9. 181-183). This plat only included Tulip Poplar Drive right-of-way from just west of Belvedere Drive to just north of Nashville Pike. Final Platfor Bakers Crossing, The Forza Group (L-9417-18C) September 10,2018 On October 29,2008, the Planning Commission recommended amending the Preliminary Master Development Plan for Baker's Crossing (File 3-23-06) to include a 290-unit multi- family development and changed previously approved building locations. The Amended Preliminary Master Development Plan passed 2nd reading at the November 3, 2008 City Council meeting (Ordinance No. O0810-68). On August 22, 2011, the Planning Commission approved the a 2nd Amended Preliminary Master Development Plan for Bakers Crossing-Tennessee Hills (PC9856-11), as a minor amendment, for a252 multi-family unit complex and changing building locations. On April 25, 2016, the Planning Commission recommended approval of a 3rd Amended Preliminary Master Development Plan for Baker's Crossing (3-1697-16) for two (2) hotels and conference centers, general retail, a restaurant and office buildings in three (3) phases on an 8.15 +l- acre parcel. The Amended Preliminary Master Development Plan passed 2nd reading at the June 21,2016 City Council meeting (Ordinance No. 01605-34). On September 26, 2016, the Planning Commission approved the Final Master Development Plan for Bakers Crossing, Phase 1, The Forza Group (8-2285-16) for a hotel/restauranUconference building on an 8.15 +l- acre parcel. On May 22,2017, the Planning Commission approved a 4th amendment to the Preliminary Master Development Plan for Baker's Crossing, the Forza Group, as a minor amendment, and approved a revised Final Master Development Plan for Baker's Crossing, Phase 1, The Forza Group, (8-4061 -17) for a hotel/conference center building, on an 8.15 +l- acre parcel. On August 27, 2018, the Planning Commission approved a 5th amendment to the Preliminary Master Development Plan for Bakers Crossing, The Forza Group, as a minor amendment, and approved a revised Final Master Development Plan for Bakers Crossing, Phases 1 &2, The Forza Group (File 8-9176-18), revising the conference center, phase lines, parking layout, internal connections, building layouts and proposing five (5) lots, on an 8.1 5 +l- acre parcel (Tax Map 125M, Group A, Parcel 001.05). (Attachment 1-3) On August 27, 2018, the Planning Commission approved a Preliminary Plat for Baker's Crossing, Phase 2 (n.k.a The Forza Group) (File 1-9128-188), containing five (5) lots, on an 8.15 +l- acre parcel (Tax Map 125M, Group A, Parcel 001.05), located at 1460 Tulip Poplar Drive. (Attachment 1-4) Dlscuss¡ol,¡: Proposed Development The owner and applicant request approval of a Final Plat for Baker's Crossing, The Forza Group, containing five (5) lots and easements, on an 8.15 +/- acre parcel (Tax Map 1251V1, Group A, Parcel 001.05), located at 1460 Tulip Poplar Drive. (Attachment 1-2) Natural Features of the Site The site is currently under construction and has been cleared and regraded. Previously, the natural topography of the property sloped from the highest point of elevation (508') located 2 Final Platfor Bakers Crossing, The Forza Group (1-94L7-18C) September 1-0,2018 in the southeast corner of the property (intersection of the shared-access drive and N. Martin Vineyard Way), and fans out with a steady and even decline towards the lowest point of elevation (486') along the curvature of Tulip Poplar Drive right-of-way. Based on FEMA FIRM Map 471650426G shows no portion of the property is located within a flood hazard zone. Adjacent Development and Zoning The properties adjacent to the north, east, and west are vacant. The north and west properties include other parts of the Bakers Crossing development, zoned MU-Mixed Use and to the east is property zoned MU-Mixed Use being developed as Preston Park, the former Home Depot site. The area to the south is zoned MRO-Multiple Residential and Office and consists of commercial uses (i.e. Loden Vision Center, professional offices, Stella's Boutique, etc.). A partially constructed roadway is located to the east (Common Road (Area A). This roadway will become a street extension of N. Martin Vineyard Way upon recording the Preston Park, Phase 1 Final Plat. Loú Sizes All lots on the plat meet the lot area, setback, and easement requirements of the MU - Mixed Use zone district and the Amended PMDP/FMDP for Baker's Crossing, Phases 1 & 2, The Forza Group (File 8-91 76-1 8). According to the recently approved Amended PMDP/Revised FMDP (File 8-9176-18), the proposed uses and lot sizes are as follows: . Lot 1 consisting of 2.45 +/- acres, for the 4-story Hilton Garden lnn (a 102 room hotel now under construction), conference center, and parking area . Lot 2 consisting of 0.52 +l- acres, 2-story mixed use building: 2,300 s.f. retail space (lstfloor) and 5,800 s.f. restaurant (1st and 2nd floors) and parking area o Lot 3 consisting of 1.38 +/- acres, 4-story, 77 room Comfort lnn & Suites and parking area o Lot 4 consisting of 1.95 +l- acres, bio-retention/detention basin easement, shared parking area, and future development (vacant land) o Lot 5 consisting of 1.85 +/- acres, 3-story mixed use building: 12,000 s.f. retail space (lstfloor) and 20 multi-family units (2nd and 3'd floors) Access and Easements (P.U.D.E.'s) The plat shows the five (5) main access points (entrances) to the site and an additional access point to/from the south to the 50 foot-wide shared access easement (24 foot-wide shared access drive). This access point (entrance) aligns with an existing recorded shared access driveway between Tax Map 1251\A, Group A, Parcels 010.00 and 011.00. The southern driveway is within a 5O-foot wide cross access easement (24' shared access drive) along the southern portion of Lots 4 and 5 which will also serve the properties fronting Nashville Pike (Baker's Acres) (see plat note 9). This will allow an additional access from Nashville Pike to the site. The plat shows access easements extending through and along the lot boundaries to provide access to all other lots within the subdivision. 3 Final Platfor Bakers Crossing, The Forza Group (1-941-7-1SC) September 1-0,2078 This plat relies upon obtaining access to the private access (Common Road - Area A) that extends from Tulip Poplar Drive to North Martin Vineyard Way. This roadway is currently a private roadway, but will be platted as part of the adjacent Preston Park development. Until the Preston Park development is platted where "Common Road" (Area A) becomes a right-of-way, no access can be provided from Baker's Crossing, The Forza Group unless an easement is granted prior to platting. No Final Plat shall be approved until the roadway is platted or an easement is granted to the owners of Baker's Crossing, The Forza Group. The stormwater infrastructure system will be provided through 20 foot-wide storm sewer easements between the adjoining lots. Ten (10) foot-wíde Public Utility and Drainage Easements (P.U.D.E.) are shown along the perimeter of the lots except for the lots located along Tulip Poplar and Common Road (Area A) which shows a 20 foot-wide P.U.D.E. for proposed public utilities, drainage and electrical services. Ten (10) foot-wide P.U.D.E.'s will be located in the internal shared access easements. A sidewalk will be constructed along Tulip Poplar Drive. This was not constructed when the street was platted.
