Minutes of the Regular Meeting of the Gallup City Council, City of Gallup, New Mexico, held in the Council Chambers at Gallup City Hall, 110 West Aztec Avenue, at 6:00 p.m. on Wednesday, November 9, 2016. The meeting was called to order by Mayor Jackie McKinney. Upon roll call, the following were present: Mayor: Jackie McKinney Councilors: Linda Garcia Allan Landavazo Yogash Kumar Fran Palochak Also present: Maryann Ustick, City Manager Presented to the Mayor and Councilors was the Minutes of the Regular Meeting of October 25, 2016. Councilor Palochak made the motion to approve the aforementioned Minutes. Seconded by Councilor Landavazo. Roll call: Councilors Palochak, Landavazo, Garcia, Kumar and Mayor McKinney all voted yes. Mayor McKinney recommended moving Presentation and Information Item #1 to the beginning of the Agenda. Councilor Kumar made the motion to move Presentation and Information Item #1 to the beginning of the Agenda. Seconded by Councilor Palochak. Roll call: Councilors Kumar, Palochak, Landavazo, Garcia and Mayor McKinney all voted yes. 1. Four Corners Football Tournament Update — Sammy Chioda Mr. Chioda provided a recap of the Four Corners Invitational Youth Football Championships which took place in Gallup on October 29-30, 2016. 700 players and their families came to Gallup from Albuquerque, Belen, Grants, Farmington, Aztec, Towaoc, Colorado; Pueblo, Colorado; and Moab, Utah; to participate in the event. Mr. Chioda thanked the City’s staff for their work and assistance in hosting the tournament. Presented to the Mayor and Councilors were the following Discussion/Action Topics: 1. Ordinance No. C2016-12; An Ordinance Concerning the Sustainable Gallup Board, Repealing and Replacing Title 2, Chapter 1, Sections 1 Through 4 of the Municipal Code of the City of Gallup in its Entirety — Dennis Romero, Water and Sanitation Director MINUTES Regular City Council Meeting — 11/9/2016 Page 2 Bill Bright, Chairman of the Sustainable Gallup Board and Elizabeth Barriga, Environmental Program Coordinator, presented the proposed Ordinance amending the Bylaws of the Sustainable Gallup Board. Public discussion on the proposed ordinance revisions were conducted through a series of work sessions by the Sustainable Gallup Board. Councilor Garcia made the motion to approve Ordinance No. C2016-12. Seconded by Councilor Kumar. Roll call: Councilors Garcia, Kumar, Landavazo, Palochak and Mayor McKinney all voted yes. 2. Re-appointment of Gerald O’Hara and the Appointment of Rebecca Murphy to the Sustainable Gallup Board Mayor Jackie McKinney — Mayor McKinney presented his recommendation for appointments to the Sustainable Gallup Board and asked the Councilors for their approval. Mr. Bright also expressed his support of the proposed appointments. Councilor Palochak made the motion to approve the re-appointment of Gerald O’Hara and the appointment of Rebecca Murphy to the Sustainable Gallup Board. Seconded by Councilor Garcia. Roll call: Councilors Palochak, Garcia, Landavazo, Kumar and Mayor McKinney all voted yes. 3. Approval of Design/Build/Operate (DBO) Contract with CH2M Hill for the Operation of the Wastewater Treatment Plant Dennis Romero, Water — and Sanitation Director Mr. Romero said the proposed DBO Contract with CH2M Hill is under review by the City’s legal counsel. In order to provide sufficient time for the Mayor and Councilors to review the lengthy document, Mr. Romero recommended tabling the contract until the next regular meeting. Councilor Landavazo made the motion to table the Design/Build/Operate (DBO) Contract with CH2M Hill for the Operation of the Wastewater Treatment Plant until the next regular meeting. Seconded by Councilor Kumar. Roll call: Councilors Landavazo, Kumar, Garcia, Palochak and Mayor McKinney all voted yes. 4. Construction Contract Award for New Airport Fuel Farm Phase 2 — Stan Henderson, Public Works Director Mr. Henderson said Phase 1 of the new airport fuel farm provided for single aircraft refueling. Phase 2 of the project will add the capability for bulk refueling of multiple MINUTES Regular City Council Meeting — 11/9/2016 Page 3 aircraft. The engineer of record is Armstrong Consultants and completion time for the work is about 60 days due to lead time for obtaining materials for the project. Bids for the project were opened on August 11, 2016; however, the low (single) bidder was declared nonresponsive due to the non-submission of a bid bond. Bids were re advertised and opened on September 28, 2016. The apparent low bidder is Eaton Sales and Services with a total bid of $88,500 for the base bid and three bid alternatives. The construction budget consists of funding by the City in the amount of $18,904 and funding from the State in the amount of $85,078. Mr. Henderson recommended award of the construction contract to Eaton Sales & Services in the amount of $94,231.88 for the base bid, bid alternative #1 and bid alternative #2, plus gross receipts tax. He also recommended that the award of the contract be contingent on receiving the State’s funding and that authorization be given to the Mayor to execute all grant documents related to the project. Discussion followed concerning the enhanced amount of time it will take for refueling military helicopters once Phase 2 of the fuel farm improvements are in place. Councilor Kumar made the motion to approve the construction contract award for the new Airport Fuel Farm Phase 2 as presented. Seconded by Councilor Garcia. Roll call: Councilors Kumar, Garcia, Landavazo, Palochak and Mayor McKinney all voted yes. 5. Proposed Metal Detector for City Council Chambers — Jon DeYoung, Assistant City Manager Mr. DeYoung presented information relative to the cost and implementation of a metal detector to be placed at the entrance of the City Council Chambers. Staff was directed by the Mayor and Councilors to obtain the information at the June 14, 2016 Regular Meeting. The total cost for a portable TSA certified metal detector and wands are $4,427 plus an estimated annual cost of $1,022.40 for an additional security guard for the process. Mr. DeYoung asked the Mayor and Councilors for direction to move forward with the implementation of the metal detectors and the use of wands to enhance security for City Council Meetings. Discussion followed regarding the detection levels of the proposed equipment, the posting of signage outside City Hall prohibiting firearms inside the building, the usage of the proposed equipment to be only for City Council Meetings, the process for screening individuals attending City Council Meetings and the need to create policies and procedures governing the entire screening process. Chief Phillip Hart, Gallup Police Department, also addressed the Mayor and Councilors regarding the need to develop policies and procedures for the screening process. MINUTES Regular City Council Meeting — 11/9/2016 Page 4 Following discussion, Councilor Landavazo made the motion to approve the proposed metal detector for the City Council Chambers. Presented to the Mayor and Councilors were the remaining Presentation and Information Items: 2. Business Improvement District Annual Report — Francis Bee, Executive Director, Gallup Business Improvement District Louie Bonaguidi, President of the Business Improvement District (BID), and Mr. Bee presented an overview of the annual report, which encompasses the programs, projects, events, endeavors, accomplishments, and financials of the BID. Councilor Landavazo recommended that the BID offer stipends to downtown businesses to have their stores opened during events, such as the monthly Arts Crawl. Clyde (C.B.) Strain, Planning Director, answered questions regarding building code enforcement for older structures in the downtown area. Mr. Bee answered questions regarding the financials of the BID; the benefits and resources that are offered by establishing a Historic District, MainStreet and Arts and Cultural District designations; security patrols in the BID; the BID’s reimbursement program for sign improvements; and the feedback received concerning the Downtown Pedestrian Safety Project. Councilor Kumar and Mayor McKinney encouraged Mr. Bee to visit with each member of the BID to inform them about the activities and programs of the BID. Mayor McKinney asked for additional information in the future about the accounts receivable of the BID. He also recommended that the BID provide funding to decorate store fronts for property owners in the BID, especially vacant and blighted buildings. 3. First Quarter Strategic Plan Review Maryann Ustick, City Manager and — Jon DeYoung, Assistant City Manager Ms. Ustick provided an introduction to the presentation which outlines the key strategies of the plan as of September 30, 2016. Ms. Ustick and Mr. DeYoung presented a summary of the activities and milestones of each goal in the strategic plan. Brian Archuleta, Information Technology Services Director, provided an update on the status of the regional broadband strategy and facilities issues. Chief Hart briefed the Mayor MINUTES Regular City Council Meeting — 11/9/2016 Page 5 and Councilors on the purchase and installation of new in-car police cameras and the evaluation of “best practices’ for the use of body cameras. The Mayor and Councilors commended City staff for their input and work on the strategic plan. Comments by Public on Non-Agenda Items None. Comments by Mayor and City Councilors Councilor Kumar presented two checks made payable to the City of Gallup; one in the amount of $2,000 and the other in the amount of $3,000. The checks were from the Red Roof Inn and the Comfort Suites to be used for the construction of the new skateboard park. Councilor Landavazo thanked Veterans of the Armed Forces for their dedication and service to our country. Councilor Palochak will hold a Neighborhood Meeting on Thursday, November 10, 2016 at Stagecoach Elementary School at 6:00 p.m. She will also hold a second Neighborhood Meeting on Thursday, November 17, 2016 at Tobe Turpen Elementary School at 6:00 p.m. Mayor McKinney encouraged everyone to attend the Veterans Day events. The Octavia Fellin Public Library will host a presentation by Bill Martin, Vietnam Veteran from Rio Rancho, on Thursday, November 10th at 6:00 p.m. Mr. Martin will share his personal experiences while serving during the Vietnam War. Mr. Martin will also be a keynote speaker at the Veterans Day Ceremony at the Courthouse Plaza. There will also be a candlelight vigil at the Courthouse Plaza on Thursday evening, November 10th a memorial service at Hillcrest Cemetery on Friday, November jjth at 10:00 a.m., followed by a parade to the Courthouse Plaza. John Encino, Vietnam Veteran and musician, will perform at the Veterans Helping Veterans on Friday, November 11th at 6:00 p.m. Comments by City Manager Ms. Ustick introduced Liz Hannum, the new Executive Director for Gallup MainStreet.
