Upon roll call, the following were present: Dorie Rowberry Dr. Oscar A. Palomo, MD Patty Holland Tommy Nelson Upon roll call, the following were absent: Cherry Menapace Presented to the Chairwoman and Authority Board Members for their approval were the minutes of the April 9th, 2019 meeting. Board Member Holland motioned for approval of minutes as presented. Seconded by Board Member Palomo. Motion Carried. Upon roll call, the following votes were: Patty Holland (Yes) Dr. Oscar A. Palomo, MD (Yes) Tommy Nelson (Yes) ITEM ONE: Out-of-State travel request for one Animal Control Officer in September 2019 Cosy Balok, Animal Control Coordinator explained how she was requesting for her Animal Control Officer, Andrew Malicoat to attend training in Seattle, Washington. According to the Joint Powers Agreement if there’s any out of state travel staff needed to request it from the Board. Cosy would like her officer to attend the NACHO Module A training from September 9th to 13th, 2019 at the Criminal Justice Training Academy in Seattle, Washington. It’s a five (5) day training, which costs five-hundred and ninety- five dollars ($595.00). She continued by explaining how it wasn’t offered within the State of New Mexico and that was the closest location for him to attend. Cosy stated that it was extremely important that her officers kept current with their training and it helped with their safety precautions. Board Member Holland asked Cosy if she had an estimate cost for the entire trip. Nikki Lee stated that the lodging would cost about eight-hundred dollars ($800.00), meals Gallup McKinley County Animal Control Authority Meeting July 9th, 2019 Minutes Page 1 of 8 forty-five dollars ($45.00) per day for out-of-state travel and they’re not sure on the transportation cost yet, but more than likely will be an airline ticket. Ms. Lee added how Animal Control’s fiscal year 2020 travel and employee training budget had sufficient funds to cover the trip’s costs. Board Member Palomo asked for clarification on the type of training being requested. Ms. Lee reminded the Board how last year in 2018 Animal Control had requested out- of-state travel for two (2) other Animal Control Officers to attend the Module A, which was held in Las Vegas. For 2019 those two (2) officers will be attending Module B. For the new employee, Andrew Malicoat this will be his first training from NACHO whereas he’ll start with Module A and hopefully next year is able to attend Module B. Chairwoman Rowberry asked the Board Members if they had any additional questions. There were none. Chairwoman Rowberry asked if there were any other parties wishing to speak to this item. Palomo, MD (Yes) Patty Holland (Yes) ITEM TWO: Out-of-State travel request for two Animal Control Officers in December 2019 Cosy Balok, Animal Control Coordinator began by explaining that the out-of-state travel request was for the two (2) officers who had attended Module A last year. She was requesting approval for her staff to travel to Las Vegas, Nevada to attend NACHO Module B. Cosy stated that the City will only be responsible for paying for one (1) of the officer’s registration fee whereas the other officer (Tiffany Hubbard) received grant funding from Animal Protection of New Mexico to cover the five-hundred and ninety- five dollar ($595.00) fee. The city will also be responsible for their travel costs (lodging, mileage and meals). Chairwoman Rowberry asked the Board Members if they had any additional questions. There were none. Palomo, MD (Yes) Patty Holland (Yes) Tommy Nelson (Yes) ITEM THREE: Quarterly Financial Report Patty Holland, City of Gallup’s Chief Financial Officer informed the Board Members that the Animal Control Quarterly Report (Page 3-1 & 3-2) included data from the third quarter of fiscal year 2019 (July 2018 to March 2019). Board Member Holland reviewed the Quarterly Report with the Board Members. She pointed out how the largest expenditures for Animal Control were personnel costs whereas they’re right on track with payroll and benefits costs. Board Member Holland referenced how a majority of the Operations budget had been spent whereas the far right hand column showed the ending balance of each line item. The only line items that aren’t completely spent are for fuel purchases and utilities because they aren’t charged to the line item until they’re actually used. Board Member pointed out how they saved money on the capital equipment purchase, which was a box for the Animal Control unit. Board Member Holland ended by stating that they anticipate spending almost down to the last dollar of each line item besides the savings on the equipment purchase. Chairwoman Rowberry asked the Board Members if they had any additional questions. There were none. Chairwoman Rowberry asked if there were any other parties wishing to speak to this item. Palomo, MD (Yes) Tommy Nelson (Yes) Gallup McKinley County Animal Control Authority Meeting July 9th, 2019 Minutes Page 3 of 8  Patty Holland (Yes) ITEM FOUR: FY 2020 Final Approved Budget Patty Holland, City of Gallup’s Chief Financial Officer informed the Board Members that the final budget (Page 4-1) was approved by City Council for fiscal year 2020, which began on July 1, 2019. Board Member Holland explained how the budget looked a little different than the one they just seen for the quarterly report. Overall everything was kept pretty much the same but allocated a little differently from line to line to meet the needs of the department. The total budget is $659,773.00 that’s $2,203.00 less than the budget for fiscal year 2019 whereas there was a slight decrease to cut back on the expenditures. Board Member Holland stated that there was nothing new or unusual to be noted on the final approved budget. Board Member Palomo asked what the allowance line item was for. Board Member Holland stated that was for employee’s who receive a cell phone allowance being that most City departments aren’t issued company cell phones. Those eligible employees will receive a stipend for utilizing their personal cell phones for City business. She added how there are also uniform allowances, which are used for departments who specifically require certain shoes or uniforms. Board Member Holland explained that out of the total Animal Control budget the County will reimburse the City forty percent (40%). She explained how the County has already been given the total number whereas they’ve included it into their fiscal year 2020 budget. Board Member Holland stated that the Animal Control budget will still need to go before the County Commissioners for final approval. The budget also still needs to be approved by the New Mexico Department of Finance, which won’t come until probably September or October 2019. Palomo, MD (Yes) Tommy Nelson (Yes) Patty Holland (Yes) Gallup McKinley County Animal Control Authority Meeting July 9th, 2019 Minutes Page 4 of 8 ITEM FIVE: Review proposed Resolutions to establish Animal Control Fees for the City of Gallup and McKinley County Animal Control Ordinance Curtis Hayes, City Attorney explained how there were two (2) resolutions included in their agenda packets; one was for the Gallup City Council and the other was for the McKinley County Commission. Mr. Hayes explained how he was looking for previous resolutions where animal control fees were adopted. He found one from the City of Gallup from about six (6) years ago, however it had a combination of fees for both the Humane Society and Animal Control. Mr. Hayes stated that the resolution presented this afternoon only included fees that were charged by Animal Control; it didn’t include Humane Society fees. He spoke about how the City and County Ordinances both required an approval process of the fees charged by Animal Control. He did speak to Doug Decker, McKinley County Attorney about the little differences in the Ordinances, which Mr. Decker said they would be revising. The City Ordinance states in two (2) different places that the fees must be approved by City Council; Section 5-3-7 fees for licenses, permits and services and Section 5-3-9 impound fees. The difference in the County Ordinance is that in Section 7.1 it states that the County Commission sets the fees for licenses, permits and services, however the Animal Control Board actually sets the fees for impounds. Mr. Hayes explained how he and Mr. Decker agreed to wrap everything into two (2) resolutions instead of three (3). Mr. Hayes referenced the new Animal Control fee schedule where impound fees were clarified. This was if an officer went out and picked up multiple animals at a single time whereas they’re not charging an impound fee for every animal; only per trip. He spoke about another minor change, which was to insert the word “annual” before license. Again that was to clarify that cat and dog licenses had to be renewed on an annual basis. Mr. Hayes spoke about how he couldn’t find a resolution approved by the County Commission to adopt the fees so this action will take care of that. Board Member Holland asked for clarification on the Livestock After Hours Pickup Fee; is that to release the animal or to actually impound it. Cosy Balok, Animal Control Coordinator explained that was when the Animal Control Officers had to go in the middle of the night to pick up for example, cows then we’ll charge an extra fee, which goes to the City. Board Member Palomo gave an example of a dog getting out their yard and if Animal Control picked up; would they charge $175 total ($100 impound fee + $75 reclaim fee). Cosy stated yes they would charge that amount. Board Member Palomo asked if animal owner’s actually ever paid those fees. Cosy responded yes and they also work with people to where they’ll waive the $75 reclaim fee if they agree to have their animal spayed or neutered. The animal owners are also able to go through the Humane Society to receive assistance in funding to spay or neuter their animal (if available). Gallup McKinley County Animal Control Authority Meeting July 9th, 2019 Minutes Page 5 of 8 Mr. Hayes added how the impound fee was to act as a deterrent for people keeping their animals under control whereas they would be charged a penalty fee. Palomo, MD (Yes) Patty Holland (Yes) Tommy Nelson (Yes) ITEM SIX: Recognition of newly appointed Vice-Chairperson, Dorie Rowberry ITEM SEVEN: Recognition of newly appointed Board Member, Tommy Nelson ITEM EIGHT: Animal Control Shelter update Cosy Balok, Animal Control Coordinator informed the Board Members that on June 11, 2019 the City met with the animal shelter consultants. Cosy gave an overview of what things she told the consultants that the new shelter would require such as, indoor/outdoor kennels, cat condos, euthanasia & surgery rooms, a sally port, storage & office areas and natural light and windows for people to view animals. According to Cosy’s information the consultants made the necessary changes to the site plan, which are the plans presented this afternoon. Cosy presented the Board with copies of the two (2) layout plans (copies are attached hereto, marked as Exhibit A & B and made a part of these official minutes.) Cosy emphasized how it was just a preliminary layout whereas it will vary depending on the site selected. She explained how the two (2) site plans were similar; just different exterior options. Cosy mentioned how they had previously conducted a site visit at the Bernalillo Animal Shelter to get ideas for the new Gallup shelter. Clyde (C.B.) Strain, Planning & Development Director explained how the consultants actually based their preliminary floor plan on the Bernalillo shelter and the consultants made necessary changes according to staff’s recommendations. CB spoke about how there were currently two (2) Gallup McKinley County Animal Control Authority Meeting July 9th, 2019 Minutes Page 6 of 8 different site options whereas one was near the current shelter and the other off Industry Road. Both sites have their challenges so the consultants are trying to design the building to fit the site. Cosy spoke about how she didn’t like the old Kachina Plant (on Industry Road) as a selected site because of the previous use. There was a discussion between Board Members and staff regarding site criteria. Staff was unclear about the exact square footage of the building on the floor plans presented; once confirmed they will notify the Board. There was a discussion between Board Members and staff regarding the location and purpose of each room within the floor plans. It was recommended that they remove the third restroom from the floor plan. Board Member Holland asked if there were any cost estimates submitted yet. CB stated no; he believes that will be presented to the City Council. He estimated the total cost of the new shelter to be about six to eight million dollars, which would include the purchase of the land, design and construction of the building. CB spoke about how the City received a grant for four hundred thousand dollars for a shelter study. Nikki Lee mentioned how the consultants wanted to present before City Council at the end of July to pick a site. However, Mayor McKinney stated that he would like to push back maybe to August being that he recently received a call about an alternative property for the shelter. Staff will keep the Board and Mayor updated on any new progress. Open Floor: No discussion. Motion was made by Board Member Holland to adjourn meeting. Seconded by Board Member Nelson. The Animal Control Coordinator title has been changed to Animal Protection Supervisor (Cosy’s job title). And Animal Control Officer has been changed to Animal Protection Officer (four officer’s job titles). These changes have gone through the Human Resources Department whereas the Union agreed that the job titles needed to match up with what was referenced in the Animal Control Ordinance.
