When site development plan approval is required by this title, no building permit shall be issued until such approval is granted. Once a site development plan is approved, it shall expire in two (2) years, unless a building permit has been issued within that time, pursuant to the approved plan. e. Any person aggrieved by a determination regarding site development plan approval by the task force or planning department may appeal to the board of adjustment for a review of the determination. Details regarding the appeal process are contained in subsection 10-4L-2 of this chapter. 3. Charges: The charges for site plan review shall be as fixed from time to time by the city council through resolution with due public notice. Such charges shall be paid by the applicant to the city at the time of application. All application charges are nonrefundable. (Ord. C99-5, 9-28-1999) 10-4C-2: DEVELOPMENT STANDARDS FOR LANDSCAPING: A. Purpose: In order to promote and preserve visually attractive and pleasing surroundings, reduce water use erosion and runoff, and improve the quality of the environment, the city desires to include appearance improvements with the installation and maintenance of natural materials that will further improve the quality of life. Therefore, landscaping shall be provided and maintained as set forth herein. The style of landscape is not described; however, indigenous and/or drought tolerant plants are strongly recommended. 8. Landscape Guidelines: These guidelines are the mm1mum acceptable standards and shall apply to public and private property in the following circumstances: / 1. All new construction within the multi-family residential and all other nonresidential zoning districts shall require an area of not less than ten percent (10%) of the site's parking area to be landscaped. For purposes of this title, the parking area shall include all driveways, accessways, sidewalks and other surfaces excluding the building pad, fenced storage area, and docking facilities. Additions or aboveground structural modifications to existing buildings within the multi-family and all other nonresidential zoning districts which do not currently meet these guidelines, and which involve a change in use or addition of twenty five percent (25%) or more of building floor area, shall require not less than ten percent (10%) of the site's parking area (as defined in subsection 81 of this section) to be landscaped. Up to two-thirds (2/ 3) of the required landscaping may be located in the public right of way. 3. All auses 11 requiring conditional use permits as defined by the land development standards shall require an area of not less than ten percent (10%) of the site's "parking area" (as defined in subsection 81 of this section) to be landscaped. Up to one-third (1/3 ) the required landscaping may be located in the public right of way. Any building to be structurally modified, but not enlarged, that does not have area to landscape due to parking and other requirements, may be exempted or partially exempted from these requirements administratively if the review during the permitting process shows an inability to comply. (Ord. C99-5, 9-28-1999) 4. For renovations exceeding twenty five thousand dollars ($25,000) in improvements to existing buildings within all nonresidential zoning districts, landscaping shall be installed for up to twenty percent (20%) of the project valuation. Up to two-thirds (2/ 3) of the required landscaping may be located in the public right of way. (Ord. 2004-17, 12-14-2004) 5. All new construction within the RS-1, RS-2, RA-D, RA-TH, and RM-3 zoning districts shall provide one 2-inch caliper tree within the front yard setback for each one hundred feet (100') of street frontage. The planting must occur prior to the issuance of a certificate of occupancy unless a written agreement to delay installation exists. J 6. For the protection and enhancement of our native environment, in calculating the required area to be landscaped, the owner may (and is encouraged to) include natural vegetation on the site which is undisturbed by clearing of the site. c. Landscape Materials: For the purposes of this section, "landscape" shall include trees, shrubs, ground cover located throughout the City of Gallup 10-4C-2 10-4C-2 required landscaped area and an irrigation system as set forth in subsection D of this section. 1. Trees: Trees may include deciduous or conifer specimens not less than in a fifteen (15) gallon size, with a two inch (2 11 ) caliper trunk at the time of planting. A multi-trunk tree shall have not less than three (3) 1-inch caliper trunks. A minimum of two (2) live trees shall be provided for every one thousand (1,000) square ·feet of required landscaped area. Caliper measurements shall be taken at the trunk two feet (2') above grade. 2. Shrubs: Shrubs, not less than five (5) gallon size, to follow nurseryman standard, which are approximately one foot (1 ') in height and one foot (1 ') in width at the time of planting located throughout the required landscaped area. A minimum of ten (10) live shrubs shall be provided for every one thousand (1,000) square feet of required landscaped area. (Ord. C99-5, 9-28-1999) 3. Ground Cover: Ground cover shall include low shrubs, annual or perennial flowers or native grasses, decorative bark material, synthetic turf, decorative stone, gravel and colored and textured concrete. All portions of the required landscape area that are not covered by trees and shrubs shall be landscaped with ground cover. a. Decorative concrete shall be substituted for other ground cover materials only in areas where high amounts of foot traffic can be anticipated, i.e., immediately adjacent to parking areas, pedestrianways, etc. b. Irrigated turf shall be limited to ten percent (10%) of total required ground cover for nonresidential development and to twenty five percent (25%) of the total gross main floor area for residential development. New irrigated turf shall be prohibited in all residential front yards. 4. Exceptions: Large rocks/boulders indigenous to the Gallup area may be substituted for shrubbery for up to one-half (112) of the _/ required plantings, but no more than five (5), whichever is less. When trees are planted at intervals along streets, spacing shall depend on tree size, as follows: Expected Tree Height Planting Interval Large trees (40 feet +) 30 - 40 feet Medium trees (30 - 40 feet) 25 - 30 feet Small trees (to 30 feet) 20 - 25 feet Calculated maturation height should be considered when tree is placed beneath overhead lines. 4. Landscaping of all cut and fills and/or terraces shall be sufficient to prevent erosion, and all roadway slopes steeper than one foot (1 ') vertically to three feet (3') horizontally shall be planted with ground cover appropriate for the purpose and for soil conditions, water availability, and environment. 5. The 11 sight clearance triangle" shall be maintained as defined in subsection 10-4C-183 of this article. ) 6. Prior to design, all underground utility lines must be located and shown on the landscaping plan. Plantings must be located so as to not interfere, either at the time of installation or later, with the function of such underground line. City of Gallup 10-4C-2 10-4C-2 F. City Owned Property: 1. Right of way medians shall hereafter be designed with conduits for electricity and water as specified by the electric department, placed a minimum of thirty six inches (36 underground and water stubouts 11 ) in accord with the landscape design. 2. Drainage, retention, and detention areas shall be buffered in accordance with the landscaping buffer/screen chart below, except when such facilities are designed for joint use as a community or neighborhood park which facilities are exempt from buffers/ screens. 3. All city utility installations, substations, and other city facilities shall be buffered in accordance with the landscape buffer/screen chart below. G. Buffers/Screens: 1. Property Owner Responsible: All owners of property required to be landscaped under subsection A of this section or otherwise under the land development standards shall buffer their property lines in accordance with the landscape buffer/screen chart below. The type of screening required is determined by the zoning classification of the property. ./ 2. Installation: The installation of screening of the type indicated is the responsibility of the building permit applicant prior to the issuance of a certificate of occupancy. Opaque Screen , Type A: A screen that is opaque from the ground to the height of at least five feet (5') with intermittent visual opening from the opaque portion to a height of at least twenty feet (20') . An opaque screen is intended to exclude all visual contact between uses and to create a strong impression of spatial separation . The opaque screen may be a combination wall, fence, landscaped earth berm, planted and/or existing vegetation. All landscaping in the buffer area must have an irrigation system . Trees and shrubs shall be located so that their outermost limbs touch at the time of maturity. Semiopaque Screen, Type B: A screen that is opaque from the ground to a height of three feet (3'), with intermittent visual openings from above the opaque portion to a height of at least twenty feet (20') . The semiopaque screen is intended to partially block visual contact between uses and to create a strong impression of the separation of spaces. The semiopaque screen may be composed of a combination wall, fence, landscaped earth berm, planted and/or existing vegetation. Trees and shrubs will be located so that their outermost limbs touch at the time of maturity. Suggested planting patterns that will achieve this standard are included below. TYPE B: SEMI-OPAQUE SCREEN ) : )O' Wall Shrubs 5. Broken Screen , Type C: A screen composed of intermittent visual obstructions from the ground to a height of at least twenty feet (20'). City of Gallup 10-4C-2 10-4C-2 The broken screen is intended to create the impression of a separation of spaces without necessarily eliminating visual contact between the spaces. It may be composed of a combination wall , fence, landscaped earth berm, planted vegetation , or existing vegetation. Trees and shrubs shall be located so that their outermost limbs touch at the time of maturity. Suggested planting patterns which will achieve this standard are included below. TYPE C: BROKEN SCREEN : ... H. Site Plan Review: A landscape plan indicating the type, size and location of landscaping along with one foot (1 ') contours shall be submitted in conjunction with the application for the building permit. All plans shall be at a scale of one inch equals ten feet (1" = 1O'} or one inch equals twenty feet {1" = 20'). \ I. Installation: The landscaping shall be installed before the completion of building construction and prior to the issuance of a certificate of occupancy unless a written agreement has been made with the city. Such agreements extending the time of installation will be for a maximum period of nine (9) months. J. Maintenance: The owner of the landscaped property shall be responsible to maintain it in a healthy, clean, trimmed, weed free and litter free condition. Dead plant material shall be replaced with new plant material within thirty {30) days or until weather permits. All plant growth in required landscaped areas shall be controlled by pruning or trimming so that it will not interfere with the installation, maintenance or repair of any public utility, nor restrict pedestrian or vehicular traffic, nor constitute a traffic hazard. ) K. Enforcement: Failure to abide by the maintenance standards will be considered a nuisance subject to abatement provisions of this code . L. Variances: Where it can be shown that strict compliance with the requirements of these regulations can not be met, due to City of Gallup 10-4C-2 10-4C-2 unavailability of sufficient land, a variance may be sought in accordance to section 10-4L-3 of this chapter. M. Design: When designing the layout of landscaping materials, it is suggested that the plant materials be spaced for their mature size to avoid interfering with walkways, doorways, and parking stalls; and to avoid the appearance of cluttered landscaping. N. Plant Species: The plant species selected should be adaptive to the city's climate. Planting materials may be drawn from the following list.
