The regular meeting of the Planning and Zoning Commission was called to order at 6:00 p.m. by
Chairman Kent Wilson.
Upon roll call, the following were present:

Chairman Wilson began the meeting by welcoming Commissioner Cresto whom replaced Frank
Kozeliski. He thanked him for volunteering and looked forward to working with him.
Chairman Wilson asked if any Commissioner had a conflict of interest for any agenda item and if so
to recuse him/herself prior to discussing the particular item.

Chairman Wilson administered the oath required by State Law for public forum.
Chairman Wilson stated anyone wishing to speak limit their comments to three minutes and not to
duplicate a previous point; they will have one opportunity to testify.
ITEM ONE: CASE # 19-00700001: Request by Kerry A. Chicharello, property owner, for a
Conditional Use Permit to allow for a short-term rental as an accessory use to the Mixed-Use
Neighborhood Zone District (MXN). The property is located at 307 E. Hill Avenue; more
particularly described as Lots 19, 20 & 21, Block 21, A & P Railway Co. Addition.
CB Strain began by using the overhead projector to display the GIS Map to show the property’s
location. He also displayed the property’s boundary survey (Page 1-6) where it showed the single-
family dwelling unit located on the lot. CB explained how the property lied within the Mixed-Use
Neighborhood Zone District (MXN). According to the Use Table 10-3-1 within the City of Gallup
Land Development Standards (LDS) it lists a short-term rental as an accessory conditional use, which
was why the applicant came before the Commission requesting approval. Within the code there are
use specific standards attached to the short-term rentals whereas the conditions are listed as follows:
1. Owner shall pay all applicable local, state, and federal taxes including sales and lodging
taxes.
2. The owner is responsible for ensuring the accessory short-term rental meets all applicable
local, state, and federal regulations.
3. Parties renting the designated bedroom or unit shall have access to a private or shared full
bathroom.
4. Guest stays may only occur within the dwelling unit that the owner or resident manager
occupies.
5. Occupancy of the accessory short-term rental shall not exceed the occupancy allowed for
single-family use as defined in the Municipal Code. (Meaning that it has to stay as a single-
family dwelling and it can’t expand into something other than that.)
6. In single-family residential zone districts, all vehicles associated with the accessory short-
term rental use shall be parked in designated parking areas, such as driveways and garages, or
on-street parking, where permitted. No parking shall occur on lawns or sidewalks. (CB
added that within the MXN zone district on-street parking was permitted for everybody so
they would be able to utilize that as well.)

CB used the overhead projector to display the applicant’s site plan (Page 1-4) and pointed to the
driveway and on-street parking spaces. The Planning and Zoning Commission would have final
approval of this conditional use permit whereas it wouldn’t have to go before any other board. CB
informed the Commission that the applicant had submitted a statement answering the nine (9)
questions in regards to the acceptable grounds for approval (Page 1-3). FINDINGS OF
CONCLUSION: CB stated that the findings of staff for the proposed request met the Acceptable
Grounds for Requesting and Granting a Conditional Use Permit. CB recommended approval of the
conditional use permit; Resolution Number RP2019-05. The Gallup Task Force (GTF) did review
the request whereas the Fire Department was the only department that made comments. CB
informed the Commission that a representative from the Fire Department was present to answer any
questions they had.
Commissioner Dooley asked the Fire Department if they had re-inspected the property to verify that
there were smoke detectors installed (per their submitted GTF comments). Jon Pairett, Fire Inspector
approached the podium and introduced himself. Mr. Pairett explained how the said property was
considered a residential property whereas only a home safety inspection would be conducted. Those
inspection requirements only consist of notifying the Fire Department if they have working smoke
alarms and a fire extinguisher in their home. Commissioner Dooley stated that she realized the
property was a single-family home and now that it was being rented she wanted to know if there was
a transitional liability or any additional requirements. CB stated that there was nothing in the code
other than what was laid out in the resolution conditions that the City requires. The character of the
dwelling is to remain the same and they’re not changing anything in regards to the structure or
appearance whereas it would be just like any other rental; except that it’s for short-term.
Commissioner Dooley stated she understood, but because there were going to be additional people in
the home not related to them she would think that smoke detectors would be inspected. CB stated
that when the applicant completes their City Business License Checklist the Fire Department will
check the smoke detectors at that time. Commissioner Dooley thanked CB for his explanation.
Commissioner Mackenzie-Chavez stated that she understood the home would be checked at the time
of the Business License application, but asked when it will be rechecked. CB stated that he wasn’t
sure what the Fire Department’s policy was on reinspecting single-family dwellings; however it
would be the responsibility of the property owner to maintain those safety features. Nikki Lee
reminded the Commission that this was the second conditional use permit for a short-term rental
whereas it was a new use they’re regulating. She explained how the Planning Department has
created a new procedure where they’ll follow-up one (1) year after the business license has been
issued. Ms. Lee spoke about how a conditional use permit was approved for Patricia Olson in
November 2018 whereas in November 2019 they’ll do a follow-up inspection with the Planning and
Fire Departments to ensure they’re still in compliance.
Kerry Chicharello, property owner approached the podium and introduced himself. Mr. Chicharello
stated that he had installed smoke detectors at his home located at 307 E. Hill Avenue because it was
listed on the Gallup Task Force comments. He stated that he also has a fire extinguisher within the
home. Chairman Wilson stated that he read Mr. Chicharello’s statement regarding the intent of the
short-term rental and wanted to ask Mr. Chicharello if he was going to advertise his property as a

rental. Mr. Chicharello stated yes; he was working with the online AirBNB website to promote his
rental property. He explained how the website performs a mini background check and requires a
photo ID or driver’s license, which he makes a requirement for guests to stay at his home. Mr.
Chicharello added how he works at the hospital and seen there was a need for short-term rentals for
medical staff working on contract whereas many of them don’t have a place to stay. So he also
advertises to those medical staff where his short-term rental gives them a place to stay. Chairman
Wilson pointed out how using the AirBNB website opens up his rental property to other guests
besides only hospital personnel. Mr. Chicharello stated that was correct, but they also have to pass
the mini background check to secure himself and his home.
Commissioner Dooley stated that she agreed with Mr. Chicharello’s comment regarding medical
staff needing rentals and asked if he was going to follow the U.S. Department of Housing and Urban
Development (HUD) requirements where no more than two (2) people were allowed per bedroom.
Mr. Chicharello stated yes; he only advertises for one (1) bedroom for one (1) person. Chairman
Wilson thanked Mr. Chicharello for speaking.
Chairman Wilson asked if there was anyone wishing to speak against this case. There were none.
Chairman Wilson asked if there were any other interested parties wishing to speak. There were none.
Chairman Wilson stated that the hearing was closed.
Motion to approve or deny the request for Case Number 2019-00700001. Commissioner Long
motioned for approval of Item One. Seconded by Commissioner Mackenzie-Chavez. Motion
Carried.

ITEM TWO: CASE # 19-00100001: Request by Clinton & Mary Balok, property owners, for the
Annexation of a Tract of Land lying within Section 8, T15N, R18W containing approximately
1.3093 acres with an initial zoning designation of Rural Residential Zone District (RR). Said
property is located at 19 Hamilton Road. This item will also go before the City Council for final
approval at its regular meeting to be held on August 27th, 2019.
CB began by using the overhead projector to display the GIS Map pointing to the property’s location.
The property being requested for an annexation was a triangular shaped lot south of Hamilton Road.
CB explained that whenever there was an annexation and there was a right-of-way adjacent to the

property the right-of-way would be included in the annexation per State law. So the property owners
are including that portion of Hamilton Road into the annexation. CB stated that this annexation was
pretty simple whereas it only included one (1) lot that contained less than one (1) acre and with the
Hamilton Road right-of-way the total came out to 1.3093 acres. CB stated that the code required at
least fifteen percent (15%) of the boundary line be contiguous and it exceeded that requirement. CB
continued by stating that the request met all the other requirements per the City annexation policies
whereas the City has no additional requirements at this time. CB used the overhead projector to
display the annexation plat and pointed to the triangular lot and the Hamilton Road right-of-way. CB
explained how the Gallup Task Force (GTF) reviewed the annexation request whereas Public Works
and Water/Wastewater were the only commenting departments. CB informed the Commission that
the Water/Wastewater Department was present to answer any questions; Public Works however was
unable to attend. CB will answer any questions the Commission has on behalf of Public Works. CB
explained how the Planning and Zoning Commission’s recommendation through Resolution No.
RP2019-06 will be forwarded to City Council. The annexation request will go before the City
Council for final approval at their regular August 27, 2019 meeting.
Commissioner Pawlowski noted how the Water and Wastewater Departments comments were similar
requiring the property owner to extend water/sewer lines to the western edge of the property and
deferring the extension until further area development. Commissioner Pawlowski asked if that was a
typical standard procedure. Dennis Romero, Water/Wastewater Director approached the podium and
introduced himself. Mr. Romero stated yes that was a common procedure listed by his department in
the GTF comments.
Chairman Wilson asked what further area of development the extension deferral was referring to.
CB explained how that meant if they did any further improvements to their property or if they just
wanted the water line extended it would be at the cost of the property owner. It doesn’t need to
necessarily be any development on the site because there’s already an existing single-family
dwelling, but if they wanted to service that lot they City is not going to require it up front. If and
when the property owners want to, it will be at the expense of the property owner.
Commissioner Cresto asked if the water lines were currently extended to the lot being annexed into
the City. CB used the overhead projector to display the GIS Map showing the water and sewer lines.
CB pointed to where the water and sewer lines ended on the corner of Hamilton Road and Balok
Street. If the property owners wanted those lines extended to their property they would have to bring
all the way from the corner (of Hamilton Road and Balok Street) to their lot at 19 Hamilton Road.
Mr. Romero added how that distance is about four-hundred and ninety feet (490’) to five-hundred
feet (500’). CB stated that what the code requires is that it be extended to the edge of the property
line that way if anything gets annexed further down the road it will continue where they left off.
Chairman Wilson asked if the property on the corner (of Hamilton Road and Balok Street) would
have to extend it across their property also if that area is developed. CB stated that the motorcycle
shop on the corner currently has water and sewer service from their frontage so if the Balok’s wanted
water or sewer extended to their properties they would have to front the cost and could put a lien on
the line. CB pointed out how the motorcycle shop property wouldn’t be forced to participate because
they’re not initiating the request and already have service. Mr. Romero confirmed that the

information CB was explaining was correct. Mr. Romero stated that currently the motorcycle shop is
serviced to the east. Mr. Romero gave an example of property to the west wanting to extend water
service whereas they would be responsible for that portion of the line. The Balok’s could then go
further to their property and come up with an agreement with neighbors to share the cost, which is
something the utilities calls, “The principle of cost causation.” Mr. Romero reiterated that whoever
was forcing or requiring the request of the line extension was the party responsible for the cost. Mr.
Romero stated that if it turned out for any reason the City were to run a water or sewer line within a
certain amount of feet then they would be eligible at no-cost to hook up into that line, but at this point
he didn’t see that happening.
Commissioner Mackenzie-Chavez had a question regarding the City Engineer’s comments during the
GTF review. The comment states that the annexation shall require the owner to implement Hamilton
Road improvements and will be subject to the City of Gallup Land Development Standards
compliance. CB explained how that meant if the property owners ever decided to improve Hamilton
Road with pavement, curb gutter or sidewalk they would improve it at their own cost.
Commissioner Dooley stated that once the property was annexed into the City and if development
occurred to place a business there, would they fall under the new LDS code requirements to improve
the sidewalks? CB explained how the lot being annexed was a single-family lot, which was why it
was being zoned as rural residential. It’s rural residential because a majority of the neighboring
owners have animals/livestock and also because it’s a larger sized lot. CB explained how the lot
wouldn’t be developed for a business because it already had a single-family dwelling. If the property
owners did want to develop a business on the lot they would have to first subdivide the lot, however
there’s no way to get a frontage to cover the existing house and the remaining area.
Chairman Wilson asked the Commissioners if they had any further questions. There were none.
Chairman Wilson asked if there was anyone wishing to speak in favor of this case. Clinton Balok,
property owner approached the podium and introduced himself as a lifelong resident of the
community. Mr. Balok stated that he knew Hamilton Road was a County road, but wanted to know
if it was inside City limits. CB stated that the eastern portion toward US Highway 491 was within
City limits and to the west was within County limits. However if the annexation is approved that
portion of Hamilton Road directly adjacent to the Balok property will be incorporated into the City
limits. Mr. Balok also mentioned how he has practiced in the area for forty (40) years and has never
been able to vote in a City election; even though his business and services were within the City of
Gallup. By annexing his property into the City, Mr. Balok believes that it will increase the value of
his house while also allowing him to vote in a City election. Mr. Balok stated that he hopes the
Commission votes in favor of his request and thanked them for their time.
Chairman Wilson stated that the hearing was closed.
