The regular meeting of the Planning and Zoning Commission was called to order at 6:00 p.m. by
Chairman Kent Wilson. Chairman Wilson stated that the meeting was being live streamed for the
public through the City of Gallup’s Facebook page.
Upon roll call, the following were present:

to recuse him/herself prior to discussing the particular item.

Presented to the Chairman and Commissioners for their approval were the minutes of the June 8th, 2022
special meeting. Commissioner Mackenzie-Chavez motioned for the approval of the minutes as
presented. Seconded by Commissioner Pawlowski. Motion Carried

Chairman Wilson administered the oath required by State Law for public forum.
Chairman Wilson stated that anyone wishing to speak limit their comments to three minutes and not to
duplicate a previous point; they will have one opportunity to testify. Chairman Wilson also reminded
the Commission that the meeting was being live streamed so everyone needed to speak loud and clear
for the public to hear.

ITEM ONE: CASE # 22-01000002: Request by Rhett and Sarah W. Renoud, property owners, for
the City of Gallup to vacate a five foot (5’) wide utility easement along the entire length of the northern
and western property boundary lines to allow the construction of a new fence. The property is located
at 3302 Chee Dodge Boulevard; more particularly described as Lot 13, Block 4, Mentmore East Unit
2. This item will go before City Council for final approval on July 26, 2022.
CB Strain began by explaining how the property owners were requesting to vacate a five foot (5’)
wide utility easement along the northern and western boundary line of the property. He explained
how the subdivision was platted in 1975 whereas it was a common practice to dedicate easements
along property lines in anticipation for any utilities that might be located there in the future. Usually,
utilities are not installed within these easements being they try to install utilities within the frontage
of lots. CB spoke about how easements cause a restriction for owners whereas they are not allowed
to build on top of those easements. The whole point of an easements is to stay clear from any
structures so crews can get in there and maintain or access utility lines. In this case, there are no city
utilities installed within the easements and there are no plans to install utilities in those easements in
the future. CB emphasized how Mentmore was already an established neighborhood where a
majority of the properties had full service of utilities with water, sewer, gas, and electric. The Gallup
Task Force (GTF) did review the request and had no issues with the vacation. CB used the overhead
projector to display the boundary survey (Page 1-3) pointing to the location of the easement. He
spoke about how Mentmore was strange because there were several dedicated easements that had
fences built over them legally and illegally. This can cause issues for crews when trying to access
utilities or transformers. However, in this case there are not any issues. CB recommended approval of
the vacation request. The Commission’s positive or negative recommendation will go before the City
Council on July 26, 2022 for final approval.
Chairman Wilson asked the Commissioners if they had any questions for staff.
Commission Cresto stated that he was concerned being that the NM Gas Company submitted a GTF
comment stating that they had an active gas line within the easement being vacated. It seems like that
line serves both sides of the properties. Commissioner Cresto asked CB if the gas lines were allowed
to be located within a city dedicated easements or if there would be some type of agreement. CB
responded that it was a case-by-case basis. CB explained that when they develop subdivisions,
sometimes not just city utilities were located in the same trench; the gas lines could also be located in
those same easements, however they would have to be separated a certain distance. In this case, the
only utility located within the easement was a gas line. CB stated that he did reach out to NM Gas
Company notifying them of this action whereas they did not have an issue with it. CB recommended
that the property owners reach out to the gas company again to make sure it was not an issue.
However, from a city standpoint, it was not an issue to vacate the easement. CB added how the
owners would have to do a line locates prior to doing any construction of their new fence; just to
make sure they are not building on top of the gas line.
Commissioner Cresto asked where the gas meter and line was located. Madam Secretary, Nikki Lee

used the overhead projector to display Page 1-8. Ms. Lee informed Commissioner Cresto that the
yellow portion was the area being vacated and the red circled area was where the gas meter was
located, which serves both 3302 and 3304 Chee Dodge Blvd. CB added how the property owners
were present this evening and could answer any specific questions regarding the gas line being that
they have been in communication with the gas company.
Rhett Renoud approached the podium and introduced himself as the property owner. He stated that
he did reach out to the NM Gas Company and spoke with Irma Bustamante, Operations Supervisor of
Gallup and the Project Manager out of Albuquerque. Mr. Renoud stated that Irma did visit his
property and was okay with the vacation. Being that CB and Irma recommended approvals, he
thought that everything would be okay with the City Council. Mr. Renoud quoted Irma, “I just
wanted to make sure you are aware that the existing service line was in that area.” Mr. Renoud
informed the Commission that he did exchange pictures of the property with Irma. He continued by
explaining how the gas company marked the lines where the gas lines were located; the lines run in
from the neighbor’s property onto 3302 Chee Dodge Blvd. Mr. Renoud was informed by the Project
Manager that there was no problem with pouring concrete over the gas lines; they only requested that
no block wall shall obstruct the gas line.
Chairman Wilson thanked Mr. Renoud for speaking in favor of the case and asked the Commission if
they had any questions.
Commissioner Cresto asked Mr. Renoud if his gas service line would be running onto his neighbor’s
property. He was unsure if they would be creating another issue down the road. Mr. Renoud
responded stating that the gas line comes off the road into the neighbor’s property then onto his
property at 3302 Chee Dodge Blvd. The Project Manager from the NM Gas Company explained that
gas lines were similar to water lines whereas they do not really follow the dedicated easements; they
follow the least restrictive path. Mr. Renoud stated that yes the gas line did cross the property line but
not the full length of the easement.
CB reiterated how the Gallup Task Force had no issues with the gas line being placed there. And the
property owner has reached out to the gas company and received instructions on what to do. CB
emphasized how he recommended a positive recommendation to the City Council.
Chairman Wilson asked if there was anyone wishing to speak against this case. There were none.
Chairman Wilson asked if there were any other interested parties wishing to speak to this case. There
were none.
Chairman Wilson stated that the hearing was closed.
Motion to approve or deny the request for Case Number 22-01000002. Commissioner Pawlowski
motioned for approval (positive recommendation) of Item One. Seconded by Commissioner
Mackenzie-Chavez. Motion Carried.

DESCRIPTION: REZONE
The property owner is requesting a zone change in order to build an addition to his home. The
property is presently zoned Rural Holding Zone (RHZ) whereas RHZ does not allow any uses.
The property has had a nonconforming status for several years since there was a residential
structure on a lot zoned RHZ. However, the owner’s desire to construct an addition will expand
the nonconformity which the City of Gallup Land Development Standards does not allow. In order
to allow the owner to construct an addition to his home, the property must be rezoned. Therefore,
the property owner is requesting the zoning be changed to Rural Residential (RR).
The rezone request will be heard by the Planning and Zoning Commission at their August 10th,
2022 meeting, any conditions for approval should be included in staff’s recommendation to the
Commission.

COMMUNITY PLANNER COMMENTS:

P1.) Property is currently zoned Rural Holding Zone (RHZ) Zone District, the
property owner is illegally constructing an attached garage onto the existing non-
conforming single family dwelling unit. A rezone is necessary to bring the current
non-conforming single family dwelling unit into conformance and to allow the
illegal garage to be constructed legally, provided the owner applies for a building
permit. Being that this is an approximately 4-acre lot the most appropriate zone
designation would be Rural Residential (RR) Zone District.
P2.) Ok to proceed to public hearing.
CITY ENGINEER COMMENTS: Public Works has no issues with Rezone.
WATER DEPARTMENT COMMENTS: Water department has no issues with
rezone.
WASTEWATER DEPARTMENT COMMENTS: Wastewater department has no
issues with rezone.
ELECTRIC DEPARTMENT COMMENTS: Electric Department has no issues
with the rezone.
FIRE DEPARTMENT COMMENTS: Fire Department has no issues with rezone.
Any fire code requirements will be addressed during future plans review process.
SOLID WASTE COMMENTS: No Solid Waste Issues
CENTURYLINK COMMENTS: No conflicts with Lumen.
NM GAS COMPANY COMMENTS: NMGC does not have facilities in the area,
we have no issue with the rezoning.
COMCAST COMMENTS: Comcast does not have any comments or concerns
here.
NM DEPT. OF TRANSPORTATION COMMENTS:
The proposed Rezoning case does not impact the NMDOT, and therefore I have
no comments to provide.
