Chairman Wilson stated that the meeting was being live streamed for the public through the City of Gallup’s Facebook page. Upon roll call, the following were present: Chairman K. Wilson Commissioner K. Mackenzie-Chavez Commissioner F. Pawlowski Commissioner J. Cresto Upon roll call, the following were absent: Commissioner M. Long Commissioner K. Spolar Chairman Wilson asked if any Commissioner had a conflict of interest for any agenda item and if so to recuse him/herself prior to discussing the particular item. Upon roll call, the following votes were: Chairman K. Wilson (No) Commissioner K. Mackenzie-Chavez (No) Commissioner F. Pawlowski (No) Commissioner J. Cresto (No) Presented to the Chairman and Commissioners for their approval were the minutes of the May 10th, 2023 regular meeting. Commissioner Cresto motioned for approval of the minutes as presented. Seconded by Commissioner Pawlowski. Motion Carried. Upon roll call, the following votes were: Commissioner J. Chairman Wilson stated that anyone wishing to speak limit their comments to three minutes and not to duplicate a previous point; they will have one opportunity to testify. Chairman Wilson also reminded the Commission that the meeting was being live streamed so everyone needed to speak loud and clear for the public to hear. Planning and Zoning Commission Meeting June 14th, 2023 Page 1 of 7 ITEM ONE: CASE # 22-00200003: Request by Jack Rymer, Pilot Travel Centers on behalf of Rico Land & Cattle Co., property owner, for Final Plat approval of a Major Subdivision; Replat No. 1 of Parcel 1, Menapace Section 26 Subdivision. The property is generally located south of 3303 W. Highway 66; subdivision contains 116.4968 acres M/L. Chairman Wilson stated that the item has been removed from the agenda and will be presented at a later date. ITEM TWO: CASE # 23-00900002: Request initiated by Hozho Academy, Cyle Balok to amend Title 10 “Land Development Standards” of the Municipal Code of the City of Gallup allowing Air Supported Structures in the General Commercial (GC) and Heavy Commercial (HC) Zone District. This item was previously presented to the Planning and Zoning Commission on April 12, 2023 and to the City Council on April 25, 2023 without actual text amendment language. The newly drafted text amendment language will now be presented. This item will go before the City Council for final approval on June 27, 2023. CB Strain began by explaining how Hozho Academy was again approaching the city with the proposed text amendment to allow Air Supported Structures as an accessory use to a school. They’re located within the General Commercial (GC) Zone District and would like to limit the accessory use to only the General Commercial (GC) and Heavy Commercial (HC) Zone Districts. CB spoke about how they included the HC Zone District because it made no sense to allow it in the less intense district (GC) and not allow in the more intense district (HC); it should be allowed in both GC and HC. The structure itself is proposed to be 80 feet tall and 115,200 square feet whereas it would be located at Hozho Academy at 515 Park Avenue. He continued to state that currently Air Supported Structures were not permitted as a principal, conditional or accessory use within the GC or HC Zone Districts. Hozho Academy is pushing to allow a standalone Air Supported Structure on the property where the school is located. The proposed structure is 240 feet in width and 480 feet in length for an overall square footage of 115,200 and an overall structural height of 80 feet. Hozho Academy is claiming that the proposed structure will not generate a need for additional off-street parking spaces because of how they plan to utilize the structure. Hozho Academy claims that the structure will only be used for their physical education activities however, during the off-season, the structure would be made available to the public for sporting events or any other type of events they want to rent it out to. Staff is proposing to add text amendment language to allow Educational Facilities located within the GC and HC Zone Districts to place Air Supported Structures on the property with certain use-specific standards. CB stated that the first proposed amendment to the Land Development Standards is amending Use Table 10-3-1. He explained how that was the table that told people what uses were permitted in what zone districts. Staff is proposing to add Air Supported Structures as an Accessory Conditional Use within the GC and HC Zone Districts. The second proposed amendment is to revise section 10–3-C-b-iii Educational Facility, Primary/Secondary to accommodate Air Support Structures as a Conditional Use. CB referred to Resolution No. RP2023-5 explaining how the underlined language was new language and read aloud the following proposed text language: Planning and Zoning Commission Meeting June 14th, 2023 Page 2 of 7 Section 2. Section 10-3-C-b “Civic and Institutional Uses” Subsection 10-3-C-b-iii “Educational Facility, Primary/Secondary” is amended by addition of new language as follows: 10-3-C-b-iii Educational Facility, Primary/Secondary 2. Air Supported Structures are permissive as a conditional accessory use within the General Commercial (GC) and Heavy Commercial (HC) Zone Districts only, provided they obtain a Conditional Use Permit per Section 10-5-B-d-iii. 3. Uses accessory to the primary Educational Facility are not required to provide additional parking, provided the facility meets the minimum required off-street parking per Table 10-4-4 Required Off-Street Parking Supply. CB explained how that meant the city would not require additional parking to accommodate the Air Support Structure, but the school itself would need to meet the minimum parking requirements. Section 3. Section 10-3-C “Specific Use Standards” is amended by addition of a new Subsection 10-3-C-jj “Accessory Uses: Air Supported Structures” as follows: 10-3-C-jj Accessory Uses: Air Supported Structures. CB pointed out how this is a new section. 1. Air Supported Structures shall be permitted as an Accessory Conditional Use to Educational Facilities located within the General Commercial (GC) and Heavy Commercial (HC) Zone Districts only. 2. Air Supported Structures shall not exceed a maximum structure height of eighty feet (80 ft) and shall comply with the building height standards of the underlying zone district to the maximum extent feasible. CB explained how that meant the underlying zone district height was still in place whereas they would like them to get as close to that as possible, but they’re allowed to go up to 80 feet if that’s what the structural design called for, according to the square footage of the structure. 3. Air Supported Structures shall comply with the setback standards of the underlying zone district except when abutting a residential zone district, including the RR, SFR, MFRL, MFRH, and MHP zone districts. When abutting these zone districts, Air Supported Structures shall be setback a minimum of twenty-five feet (25 ft) from any lot line shared with a residential zone district. CB explained that if they’re surrounded by General Commercial, they just meet the regular setbacks required for any structure, however if up against any one of those residential zone districts they needed to be 25 feet away from them. 4. Air Supported Structures shall require a Type C buffer per Section 10-4-c-d-vii along any property lines that abut the RR, SFR, MFRL, MFRM, MFRH, and MHP zone districts. CB explained how the Type C buffer was a landscape buffer whereas it was specified in the code. If they’re next to a residential zone district they will have to meet that buffer requirement. 5. This use shall not require independent off-street parking, parking for the primary Educational Facility shall comply with the minimum requirements of Table 10-4-4 Required Off-Street Parking Supply. CB initially thought there was a typographical error here, but later realized it was correct as presented. CB continued to state that the next text amendment to the code would be to revise Table 10–4–4 Planning and Zoning Commission Meeting June 14th, 2023 Page 3 of 7 Required Off-Street Parking Supply. He explained how the minimum number of parking spaces for an Educational Facility, Primary/Secondary use was currently 5 spaces per 1,000 square feet. However, after reviewing it with the consultants it was decided that 5 was a little excessive whereas staff is proposing to reduce it to 4 spaces per 1,000 square feet. The last amendment that staff proposed was to add a definition for Air Supported Structures to the Definition Section 10-6. CB read aloud the proposed definition, “Air Supported Structures- a structure that uses internal pressurized air as the main support of the structure and is accessed via airlocks.” He stated that was just a general definition of what it was. CB spoke about how under the current parking regulations, Hozho Academy was required to have 275 off-street parking spaces for the school. Hozho Academy actually has 176 off-street parking spaces leaving the school 99 spaces short from the minimum number of parking spaces required. Because of this the school is considered non-conforming, which is referenced in section 10–5–C–g-4-ci “Expansion of Nonconforming Use.” It states that, “No nonconforming use shall be enlarged or increased, nor extended to occupy a greater area of land than was occupied at the effective date of adoption or amendment of the Land Development Standards.” CB explained how that meant it was considered nonconforming because they didn’t meet the minimum standard. According to the code, they can’t expand upon the use with any additional square footage or anything like that. This means that Hozho Academy in its current state (without the minimum number of parking spaces), will not be able to place an Air Supported Structure on the property. Unless the principal school comes into compliance with the current parking standards. The current standard, would require an additional 99 off-street parking spaces to be added, however, with the proposed text amendment this evening it will reduce the number of required parking spaces from 5 to 4 per 1,000 square feet. CB stated that if the Commission recommended approval of reducing the parking requirements, it would drop the 99 to 44 parking spaces, which was more than half. This would require Hozho Academy to provide a total of 220 off-street parking spaces; an additional 44 off-street parking spaces on top of the 176. That would bring the school into compliance, which in turn will allow the placement of the Air Supported Structure. CB stated that with all the proposed text amendments discussed this evening, it would apply to any school within the GC and HC Zone Districts; it’s not just specific to Hozho Academy. He continued to state that they cannot design regulations for one specific site; it needs to be for any GC or HC Zone District site that has a school and wants to do something similar. CB stated that it was the findings of staff that the proposed text amendment to the Gallup Land Development Standards concerning Air Supported Structures would provide minimum health, safety and welfare standards to protect the general public from any adverse effects that the proposed Air Supported Structure may pose. The Planning and Zoning Commission’s recommendation will be presented to the City Council for final approval at their regular meeting on June 27, 2023. Chairman Wilson asked the Commissioners if they had any questions for staff. Commissioner Cresto asked CB why the Industrial Zone District was left out of the Use Table 10-3-1 when deciding where to allow Air Supported Structures. He thought that those types of structure would be ideal for manufacturing uses located within the Industrial Zone District. CB responded that the text amendment request that came to them was only for schools; accessory use to schools. Industrial uses were not proposed, however if in the future the Commission wants to look at adding that they can. CB Planning and Zoning Commission Meeting June 14th, 2023 Page 4 of 7 emphasized how staff just goes off what the request is and goes from there. Nikki Lee, Madam Secretary added that when the item was presented to the City Council for discussion, they were adamant about only allowing Air Supported Structures in the GC and HC Zone Districts. Chairman Wilson stated that if a business wanted to build an Air Supported Structure of whatever height, they would have to go through the same process and submit a text amendment request. CB stated that was correct. Ms. Lee added that the request was only to allow as an accessory use to a school in the GC and HC Zone Districts. She didn’t believe that there were any schools zoned Industrial. CB stated that the intent of the request was so that Air Supported Structures could be used for sporting facilities. He’s not saying that in the future it couldn’t be considered, but right now no one has approached the city with that request. Chairman Wilson asked if there was anyone wishing to speak in favor of this case. Cyle Balok, Hozho Academy approached the podium and thanked the Commission. Chairman Wilson asked Mr. Balok if he agreed with the 44 parking spaces. Mr. Balok responded yes; they’re in the process of trying to figure that out. The 44 parking spaces seemed reasonable to Hozho Academy and believed they could make it happen. Chairman Wilson asked if that would require additional paving on their property. Mr. Balok responded yes; they will have some more usable space on the property as they continue to develop the property. He spoke about how the old convent was demolished between Hozho’s elementary and high school whereas now there’s a big hill of dirt that they’ve been slowly working to level out, which would give them more useable space for parking. Also, north of where the proposed Air Supported Structure would be placed could be used for parking; there’s a big flat space there. Mr. Balok continued to state that there was quite a bit of land that could be paved and used for parking whereas there were a variety of options to reasonably provide the 44 parking spaces. Commissioner Mackenzie-Chavez stated that she was also going to ask about the parking, but was glad that it would work for them. Mr. Balok stated that they needed more parking anyway so it was a good excuse to redo some parking areas. Chairman Wilson asked the Commissioners if they had any additional questions for Mr. Balok. There were none. Chairman Wilson asked if there was anyone wishing to speak against this case. There were none. Chairman Wilson asked if there were any other interested parties wishing to speak to this case. There were none. Chairman Wilson stated that the hearing was closed. Motion for a positive or negative recommendation to the City Council for Case Number 2023- 00900002. Commissioner Pawlowski motioned for a positive recommendation of Item Two. Cresto (Yes) INFORMATION ITEMS ITEM THREE: City Council Actions Taken ITEM FOUR: May 2023 Building Permit Activity Report Chairman Wilson asked CB how they were looking on building permits; up, down or average. CB stated that it was about average, but they’re starting to pick up with construction. He spoke about how the new Pilot project will be starting and will be coming before the Commission soon for final plat approval. There was a new Popeye’s restaurant opened on the east side. And some new buildings for the Starbucks next to the Champion Car Wash on the east side and Domino’s where the old Zia Motel was located. Chairman Wilson asked if there were any other demolition projects going on. CB stated not for demolition, but the old Red Lion Hotel on the west side was being converted to multi-family units. Last he heard was that they were having some issues with NMCID, but should be moving forward with that project soon. Chairman Wilson asked if there was anything new going on with the Philipina Subdivision (near the old Pepsi building). Ms. Lee stated that they were in the process of revising their plat so they could go before the Commission for Preliminary Plat approval, but they’re having some issues on addressing the GTF Comments. OPEN FLOOR: Chairman Wilson asked if there was anyone in attendance that would like to comment on a non-agenda item. Chairman Wilson asked CB if the Commissioner vacancy for Loren Miller has been filled yet. CB responded yes by Sabrina Ezzell who works for the University of New Mexico. She will attend the next Commission meeting in July. Commissioner Mackenzie-Chavez asked about the motels that were shut down along East Highway 66 (Blue Spruce, Arrowhead, and Lariat); are they being worked on? CB stated that one of the motels submitted a building permit for renovations, but as far as he knew the Blue Spruce wasn’t planning on doing anything. CB reminded the Commission how they amended the code to allow multi-family in the HC Zone District. That will allow the old motels to do conversions thereby repurposing the motels and providing the much-needed housing, which was commonly happening around the state.
