The special meeting of the Planning and Zoning Commission was called to order at 6:00 p.m. by Vice-
Chairman Matthew Long. Chairman Long stated that the meeting was being live streamed for the
public through the City of Gallup’s Facebook page.

Chairman Long stated that anyone wishing to speak limit their comments to three minutes and not to
duplicate a previous point; they will have one opportunity to testify. Chairman Long also reminded the
Commission that the meeting was being live streamed so everyone needed to speak loud and clear for
the public to hear.
ITEM ONE: CASE # 22-00200003: Request by Jack Rymer, Pilot Travel Centers on behalf of Rico
Land & Cattle Co., property owner, for Final Plat approval of a Major Subdivision; Replat No. 1 of
Parcel 1, Menapace Section 26 Subdivision. The property is generally located south of 3303 W.
Highway 66; subdivision contains 116.4956 acres M/L.
CB Strain began by explaining how the applicants went through the Preliminary Plat phase and now
they’re at the Final Plat approval phase. The subdivision lies within the Heavy Commercial (HC) Zone
District. And a truck stop is a conditional use for that district whereas they will be coming before the
Commission in August for Conditional Use Permit approval. Generally, the way it works is they would
get their subdivision approved, then get their Conditional Use Permit, and then get their building
permits. CB spoke about how they worked with Pilot to kind of fast track their building permits because
they were on a tight schedule. Pilot’s permit is waiting for the Final Plat to be approved being that staff
cannot issue a building permit until the final plat is approved and recorded at the county courthouse.
Their subdivision is classified as a Major Subdivision, which means there is some infrastructure that
needs to be installed consisting of curb, gutter, sidewalks, roadway construction, a cul-de-sac, and
underground utilities. Generally, as a rule of thumb, the Preliminary Plat approval gives them the go
ahead to install those improvements and they come back after they’re installed to request for Final Plat
approval. The Subdivision Regulations gives the city the authority to approve in two different ways;
they either install the infrastructure or they bond the infrastructure installation. In this case because
they want to move forward with issuing the building permit so they can get started on their project they
submitted a bond for those improvements for the amount the improvements are going to cost. However,
CB believed that they were already on their way with installing those improvements. But they’re not
going to be installed by the time the Final Plat gets recorded. CB stated that they were trying to fast
track it for them with the bond. The City Attorney reviewed the bond and approved it whereas there’s
a letter regarding that. CB wanted to explain where the property was located for anybody that was
unfamiliar with the subdivision. The property is near the Gallup High School at the west end of town.
CB used the overhead projector to display the property on the GIS Map. He pointed to the large tract
to the south, which belonged to Rico Land & Cattle Co. (Menapce) and to the two smaller tracts to the
north, which belonged to CHEV3307W, LLC and SPEED3303W, LLC (Mora). CB then used the
overhead projector to display the Final Plat. He spoke about how the subdivision was cutting out a
portion of the Menapace tract, which will allow for development of that section along with the Mora
properties, which is where the Pilot Gas Station will be located. They have to improve Mario Street
and install a cul-de-sac, which is where the utilities will be installed along with the the surface roadway,
sidewalk, and all the drainage. CB spoke about how it was a phased subdivision. He pointed out how
they have three frontages; Twin Buttes Road, Rico Road and a right-of-way to the south end of the
property (although it does not have a street name yet). The City of Gallup Land Development Standards
states that all frontages must be covered with utility infrastructure, which includes water, wastewater,
curb, gutter, sidewalks, street improvements, and all of that. CB stated that they do allow for phased

development whereas this was going to be Phase 1 for Pilot, which was why they were subdividing.
Phase 2 is in the back, which is the southern portion, larger tract of land. So, what will happen is,
if/when Rico Land & Cattle Co. decides to develop that southern portion, they could either subdivide
again or go straight to Phase 2 of development. However, the city is unsure what they plan to do with
that southern portion in the future. If they decide to move forward with Phase 2 of development, they
would come back before the Commission for the second Major Subdivision. At that time, the city will
determine what utilities need to be installed and what roadways improved depending on the type of
development they go with. CB emphasized how right now, they were only addressing Phase 1 and at
a later date will address Phase 2. With Phase 1, if the Commission approves the plat this evening, staff
will record the Final Plat along with the Subdivision Agreement. When Phase 2 is developed, the
infrastructure will be part of those Phase 2 requirements. The recorded plat will carry with the land
whereas if it ever changes hand, it carries with the land. CB stated that all the lots met the minimum
lot sizes per the Land Development Standards for the Heavy Commercial (HC) Zone District. And all
the requirements have been met for the Subdivision Regulations with the submittal of the bond for the
infrastructure installation. CB added how the infrastructure installation will have to be completed prior
to the opening of the Pilot Gas Station. If the utilities aren’t installed, they just won’t have utilities
whereas meters won’t get set and they won’t have service to the property. The utilities in Mario Street
needs to be completed as part of this development. CB stated that the applicants have complied with
everything that’s required of them per the Subdivision Regulations. He reminded the Commission,
how the applicants will be coming before the Board next month with a Conditional Use Permit request,
which was a standard approval being that it was a conditional use within that district.
Chairman Long asked the Commissioners if they had any questions for staff. There were none.
Chairman Long asked if there was anyone wishing to speak in favor of this case.
Jack Rymer, Pilot Travel Centers approached the podium and thanked CB for his positive
recommendation. Mr. Rymer wanted to clarify that they were underway with the construction of all
the site improvements. That was something that they would complete prior to opening the Pilot Travel
Center. Mr. Rymer understood that a truck stop was a conditional use in the code and will request
approval next month, which was not an issue for them. He stated that he hoped to the have the
Commission’s support next month when approving the Conditional Use Permit.
Chairman Long asked the Commissioners if they had any additional questions for Mr. Rymer. There
were none.

Commissioner Mackenzie-Chavez asked if the report was correct stating that there was a million and a half
in grading and excavation permits. CB stated that was correct due to Pilot pulling a grading and excavation
permit.
OPEN FLOOR:
Chairman Long asked if there was anyone in attendance that would like to comment on a non-agenda
item.
Chairman Long reminded the Commission how there was a Joint Work Session on Tuesday, July 25,
2023 at 4:00 p.m. in the El Morro Events Center. CB stated that the Planning and Zoning Commission
and the City Council will get an update on the Growth Management Master Plan Update project. To
let them know everything that’s been taking place and also to get input from both parties. The plan
should be updated about every five years whereas the city is a little behind, but the project is moving
along pretty well. Commissioner Cresto asked how often they will be able to give input and when will
they see it again. CB stated that they’re scheduled to have it completed by the end of the year. It is
basically a complete rewrite of the master plan. CB spoke about how they currently have two
documents; an updated version in 2009 and an added supplemental version in 2016. Now they’re
updating the whole document whereas they’ll be combined into one document. CB emphasized how
they needed the Commission and City Council’s input. And as far as technical stuff they will go over
it. Chairman Long asked if they were going to see the information before the Joint Work Session. CB
responded yes; they will be emailed to everyone. Commissioner Spolar stated that he recalled this was
the second session they were having for the plan. CB explained how they’ve already had kind of a
general session; however, this was more of the meat and potato’s part whereas there’s a lot more to
review this time.
Motion was made by Commissioner Cresto to adjourn the meeting. Seconded by Commissioner Pawlowski.

Commercial (HC) Zone District whereas this type of use is not allowed without approval of a
Conditional Use Permit. The Planning & Zoning Commission will consider this request at their
August 9th, 2023 regular meeting; any conditions for approval should be included in staff’s
recommendation to the Commission.

P3.) This use shall be screened from view from each property line not facing a
public street using Type C buffer as described in Section 10-4-C-d-vii “Required

P4.) The incidental Cannabis Sales of goods produced on the property is
allowed, provided it complies with Section 10-3-C-j-iii Cannabis Sales and the
New Mexico Cannabis Regulations Act.
P5.) Incidental outdoor storage is permitted, provided it complies with Section 10-
3-C-z.
P6.) Comply with all off-street parking requirements for Cannabis Manufacturing

CITY ENGINEER COMMENTS: Public Works has no issues with the Conditional
Use Permit. Any requirements for pedestrian infrastructure improvements shall

Update project. During the Joint Work Session, the project team received input to inform the
