CALL MEETING TO ORDER PLEDGE OF ALLEGAINCE 2. ROLL CALL: COMMISSIONERS: Denier, Jones, Gerling, Johnson and Jackson. 3. PUBLIC COMMENTS: Under Government Code Section 54954.3, members of the audience may address the Commission on non-agenda items. Speakers may address the Commission on any agenda item during consideration of the item. Speakers shall restrict their comments to issues that are within the subject matter jurisdiction to the Planning Commission and limit comments to a maximum of three minutes. Please fill out a speaker sheet located on the table inside the entrances to the Council Chambers and forward the completed speaker sheet to the Recording Secretary. 4. INFORMATION/CONSENT CALENDAR: A. SUBJECT: Election of Officers RECOMMENDATION: Pursuant to Galt Municipal Code §2.70.060, election of a Planning Commission Chairman and Vice Chairman shall be conducted at the first regular meeting of the following year after a January 1st of each year. B. SUBJECT: Minutes of the December 12, 2024, Regular Meeting. RECOMMENDATION: The Planning Commission approve the minutes of the December 12, 2024 Regular Meeting. C. SUBJECT: Minutes of the February 5, 2025, Special Meeting. RECOMMENDATION: The Planning Commission approve the minutes of the February 5, 2025 Special Meeting. CITY OF GALT PLANNING COMMISSION AGENDA PAGE 2 REGULAR MEETING OF FEBRUARY 13, 2025 5. PUBLIC HEARING: A. SUBJECT: Tattoo Parlor Conditional Use Permit (CUP) at 812 C Street RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the Planning Commission adopt a resolution approving a CUP at 812 C Street, Galt CA 95632. CEQA: This project is exempt from the California Environmental Quality Act in accordance with State CEQA Guidelines, Section 15061 (b)(3) (Common Sense Exemption) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations). B. SUBJECT: Housing Element Program Implementation RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the City Council introduce an ordinance amending Chapters 18.12 and 18.16 of the Galt Municipal Code, in accordance with the adopted 2021-2029 Housing Element Implementation Program HE-K. CEQA: This project is exempt from the California Environmental Quality Act in accordance with State CEQA Guidelines, Section 15061(b)(3) (Common Sense Exemption) of the State CEQA Guidelines (Chapter 3 of Division 6 of Title 14 of the California Code of Regulations) C. SUBJECT: Ordinance Amending the City of Galt Municipal Code Regarding Accessory Dwelling Units and Junior Accessory Dwelling Units RECOMMENDATION: 1. Receive presentation; and 2. Open public hearing to receive comments; and 3. Upon closing the public hearing, recommend that the Planning Commission find that the adoption of the proposed ordinance is statutorily exempt from review under the California Environmental Quality Act (“CEQA”) under Public Resources Code section 21080.17; and that the Planning Commission adopt a resolution recommending that the City Council adopt the proposed ordinance, attached thereto as Exhibit “A”. CEQA: Under California Public Resources Code section 21080.17, CEQA does not apply to the adoption of an ordinance by a city or county implementing the provisions of Article 2 of Chapter 13 of Division 1 of Title 7 of the Government Code, which is California’s ADU law and which also regulates JADUs, as defined by section 66313. Therefore, the adoption of the proposed ordinance is statutorily exempt from CEQA in that it implements state ADU law. 6.
